Dairesi, Zorlu Grubu&#8217;nun 800 milyon dolarl\u0131k rekor fiyatla sat\u0131n ald\u0131\u011f\u0131 Zincirlikuyu&#8217;daki Karayollar\u0131 arazisi&#8217;nin imar plan\u0131 de\u011fi\u015fikli\u011fini oy birli\u011fiyle iptal etti.<\/strong><\/p>\n<p style=\"text-align: justify;\">TMMOB \u015eehir Planc\u0131lar Odas\u0131, \u0130stanbul, Be\u015fikta\u015f \u0130l\u00e7esi, Ortak\u00f6y, 30 ada, 157 say\u0131l\u0131 parsele ili\u015fkin 27 Aral\u0131k 2006&#8217;da \u00d6zelle\u015ftirme Y\u00fcksek Kurulu&#8217;nca (\u00d6YK) onaylanan 1\/5000 \u00f6l\u00e7ekli koruma ama\u00e7l\u0131 naz\u0131m imar plan\u0131 de\u011fi\u015fikli\u011finin iptaline ve y\u00fcr\u00fctmesinin durdurulmas\u0131na karar verilmesi istemiyle Dan\u0131\u015ftay&#8217;da dava a\u00e7m\u0131\u015ft\u0131.<\/p>\n<p style=\"text-align: justify;\">Davayla ilgili esas incelemesini tamamlayan Dan\u0131\u015ftay 6. Dairesi, naz\u0131m imar plan\u0131 de\u011fi\u015fikli\u011fini oy birli\u011fiyle iptal etti.<!--more--><\/p>\n<p style=\"text-align: justify;\">Daire&#8217;nin karar\u0131nda, 2960 say\u0131l\u0131 Bo\u011fazi\u00e7i Kanunu&#8217;nun 1. maddesinde, bu Kanunun amac\u0131n\u0131n; \u0130stanbul Bo\u011fazi\u00e7i Alan\u0131n\u0131n k\u00fclt\u00fcrel ve tarihi de\u011ferlerini ve do\u011fal g\u00fczelliklerini kamu yarar\u0131 g\u00f6zetilerek korumak ve geli\u015ftirmek ve bu alandaki n\u00fcfus yo\u011funlu\u011funu art\u0131racak yap\u0131lanmay\u0131 s\u0131n\u0131rlamak i\u00e7in uygulanacak imar mevzuat\u0131n\u0131 belirlemek ve d\u00fczenlemek oldu\u011funun belirtildi\u011fi, Kanun&#8217;un &#8220;Tan\u0131mlar&#8221; ba\u015fl\u0131kl\u0131 maddesinde, &#8220;Bo\u011fazi\u00e7i Alan\u0131&#8221;n\u0131n tan\u0131m\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131 kaydedildi.<\/p>\n<p style=\"text-align: justify;\">3194 say\u0131l\u0131 \u0130mar Kanunu&#8217;nun &#8220;Tan\u0131mlar&#8221; ba\u015fl\u0131kl\u0131 maddesinde de &#8220;Yap\u0131&#8221; tan\u0131m\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131 an\u0131msat\u0131lan kararda, konutun, &#8220;yap\u0131 tan\u0131m\u0131n\u0131n kapsam\u0131na girdi\u011fi gibi, kendi ba\u015f\u0131na kullan\u0131labilen, \u00fcst\u00fc \u00f6rt\u00fcl\u00fc ve insanlar\u0131n i\u00e7ine girebilecekleri ve insanlar\u0131n oturma, \u00e7al\u0131\u015fma, e\u011flenme veya dinlenmelerine veya ibadet etmelerine, hayvanlar\u0131n ve e\u015fyalar\u0131n korunmas\u0131na yarayan binalar\u0131n&#8221; da yap\u0131 kapsam\u0131na girdi\u011fi belirtildi.<\/p>\n<p style=\"text-align: justify;\">Dairenin daha \u00f6nce verdi\u011fi kararlarda, &#8220;ATM koruna\u011f\u0131n\u0131n&#8221; ve &#8220;LPG dolum tank\u0131 tesisinin&#8221; de yap\u0131 niteli\u011finde oldu\u011funa karar verildi\u011fi an\u0131msat\u0131lan kararda, &#8220;yap\u0131&#8221; ifadesinin, i\u00e7ine konutu da alan \u00e7ok genel bir tan\u0131mlamay\u0131 i\u00e7erdi\u011fi belirtildi.<\/p>\n<p style=\"text-align: justify;\"><strong>BO\u011eAZ\u0130\u00c7\u0130 KANUNU&#8217;NDAK\u0130 SINIRLAMA<\/strong><\/p>\n<p style=\"text-align: justify;\">&#8220;Bo\u011fazi\u00e7i Alan\u0131nda ve Etkilenme B\u00f6lgesi&#8221;nde kalan bir ta\u015f\u0131nmaz \u00fczerinde ancak &#8220;taban alan\u0131 kat say\u0131s\u0131 y\u00fczde 15 ve 5 kat\u0131 ge\u00e7memek \u015fart\u0131 ile konut yap\u0131labilece\u011finin&#8221; Bo\u011fazi\u00e7i Kanunu ile kurala ba\u011fland\u0131\u011f\u0131 vurgulanan kararda, &#8220;Bo\u011fazi\u00e7i Kanunu&#8217;nun bu maddesinde yer alan s\u0131n\u0131rlaman\u0131n, sadece konut yap\u0131m\u0131 i\u00e7in ge\u00e7erli oldu\u011funu, dava konusu plan de\u011fi\u015fikli\u011finde belirtilen nitelikte yap\u0131lacak yap\u0131lar i\u00e7in kanunda bir s\u0131n\u0131rlama \u00f6ng\u00f6r\u00fclmedi\u011fini kabul etmek, Kanun&#8217;un a\u00e7\u0131k h\u00fckm\u00fc kar\u015f\u0131s\u0131nda m\u00fcmk\u00fcn de\u011fildir&#8221; denildi.<\/p>\n<p style=\"text-align: justify;\">Kararda, dava konusu plan de\u011fi\u015fikli\u011fi ile burada yap\u0131lacak yap\u0131lardaki maksimum y\u00fcksekli\u011fin tescilli idari blok binas\u0131ndan uzakl\u0131k ile ba\u011flant\u0131l\u0131 olarak bu binan\u0131n 1.5 ile 2 misli y\u00fcksekli\u011fini a\u015fmayaca\u011f\u0131, planlama alan\u0131ndaki toplam in\u015faat alan\u0131n\u0131n y\u00fczde 15&#8217;inin ticaret, y\u00fczde 10&#8217;unun y\u00f6netim, y\u00fczde 10&#8217;unun sosyo-k\u00fclt\u00fcrel tesis, y\u00fczde 35&#8217;inin rezidans ve y\u00fczde 30&#8217;unun turizm kongre merkezi kullan\u0131m\u0131na ayr\u0131ld\u0131\u011f\u0131 ifade edildi.<\/p>\n<p style=\"text-align: justify;\">6. Daire karar\u0131nda, &#8220;Bu itibarla, 2960 say\u0131l\u0131 Bo\u011fazi\u00e7i Kanunu&#8217;nda belirtilen nitelikte, yo\u011funlukta ve y\u00fckseklikte bir yap\u0131la\u015fma \u00f6ng\u00f6r\u00fclmemi\u015f olmas\u0131 nedeniyle dava konusu plan de\u011fi\u015fikli\u011finde kanuna uygunluk bulunmamaktad\u0131r&#8221; denildi.<\/p>\n<p style=\"text-align: justify;\"><strong>B\u0130L\u0130RK\u0130\u015e\u0130 RAPORU<\/strong><\/p>\n<p style=\"text-align: justify;\">Dava konusu imar plan\u0131 de\u011fi\u015fikli\u011finin \u015fehircilik ilkelerine, planlama esaslar\u0131na ve kamu yarar\u0131na uygun bulunup bulunmad\u0131\u011f\u0131n\u0131n incelenmesi amac\u0131yla yerinde ke\u015fif ve bilirki\u015fi incelemesi yap\u0131ld\u0131\u011f\u0131 kaydedilen kararda, bilirki\u015fi raporunda \u00f6zetle, &#8220;dava konusu plan de\u011fi\u015fikli\u011fi ile alanda \u00f6ng\u00f6r\u00fclen geli\u015fmenin, \u00e7evredeki di\u011fer parsellerde de g\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, par\u00e7ac\u0131 bi\u00e7imde, birbirleriyle b\u00fct\u00fcnle\u015fmeyen ve bu nedenle nitelikli kentsel mekanlar (ve kent merkezi alanlar\u0131) yaratamayan bir plan yakla\u015f\u0131m\u0131yla ele al\u0131nm\u0131\u015f olmas\u0131n\u0131n \u015fehircilik ilkeleri ve planlama esaslar\u0131 a\u00e7\u0131s\u0131ndan olumlu bulunmad\u0131\u011f\u0131&#8221;n\u0131n tespit edildi\u011fi bildirildi.<\/p>\n<p style=\"text-align: justify;\">Bilirki\u015fi raporuna g\u00f6re, plan de\u011fi\u015fikli\u011fi ile dava konusu ta\u015f\u0131nmaz \u00fczerinde \u00f6ng\u00f6r\u00fclen yap\u0131la\u015fma ko\u015fullar\u0131n\u0131n Bo\u011fazi\u00e7i Kanunu&#8217;nun &#8220;Etkilenme B\u00f6lgesi&#8221;nde izin verdi\u011fi yap\u0131la\u015fma ko\u015fullar\u0131n\u0131n olduk\u00e7a \u00fczerinde oldu\u011fu belirtilen kararda, \u015funlar kaydedildi:<\/p>\n<p style=\"text-align: justify;\">&#8220;Bo\u011fazi\u00e7i etkilenme b\u00f6lgesinin, metropoliten kentsel geli\u015fmeden, Bo\u011fazi\u00e7i alan\u0131na ge\u00e7i\u015f b\u00f6lgesi olarak say\u0131lan Ortak\u00f6y vadisinin, metropoliten kentsel alan ile bulu\u015ftu\u011fu ta\u00e7 noktas\u0131ndaki tampon b\u00f6lgede yer alan, Bo\u011fazi\u00e7i alan\u0131na ait \u00f6zellikleri ta\u015f\u0131mas\u0131 ve vadi ye\u015fil alanlar b\u00fct\u00fcnselli\u011finin, co\u011frafi ve do\u011fal yap\u0131 s\u00fcreklili\u011finin korunmas\u0131 gereken bir alanda, yukar\u0131da belirtilen nitelikte ve yo\u011funlukta yap\u0131la\u015fma ko\u015fullar\u0131 \u00f6ng\u00f6r\u00fclmesinde \u015fehircilik ilkelerine, planlama esaslar\u0131na ve kamu yarar\u0131na da uygunluk bulunmamaktad\u0131r.&#8221;<\/p>\n<p style=\"text-align: justify;\">Daval\u0131 Ba\u015fbakanl\u0131k \u00d6zelle\u015ftirme \u0130daresi Ba\u015fkanl\u0131\u011f\u0131n\u0131n bu karar\u0131 temyiz etme hakk\u0131 bulunuyor.
