T\u00fcrkiye&#8217;de 2012 y\u0131l\u0131 sonunda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne ili\u015fkin derdest davalara bak\u0131ld\u0131\u011f\u0131nda 172 bin 723 hakaret davas\u0131n\u0131n, 2 bin 539 ter\u00f6r propagandas\u0131na konu olmu\u015f davan\u0131n, 406 su\u00e7 ve su\u00e7luyu \u00f6vme konusunda a\u00e7\u0131lan dava olmak \u00fczere toplam 176 bin 247 davan\u0131n devam etti\u011fini anlatan K\u0131l\u0131\u00e7, &#8221;Davalar\u0131n say\u0131s\u0131na bak\u0131ld\u0131\u011f\u0131nda, sorumlulu\u011fun sadece yarg\u0131 mensuplar\u0131na y\u00fcklenmesinin b\u00fcy\u00fck bir insafs\u0131zl\u0131k olaca\u011f\u0131n\u0131 belirtmek isterim&#8221; diye konu\u015ftu.<\/p>\n<p style=\"text-align: justify;\">A\u00e7\u0131lm\u0131\u015f davalar\u0131n y\u00fczde 98&#8217;inin hakaret davas\u0131 oldu\u011funu vurgulayan K\u0131l\u0131\u00e7, \u015funlar\u0131 kaydetti: &#8221;Bunun nedenleri \u00fczerinde durulmal\u0131d\u0131r. Siyaset kurumlar\u0131n\u0131n gerilim \u00fczerine kurduklar\u0131 politik yakla\u015f\u0131mlar, diyalog k\u00fclt\u00fcr\u00fcn\u00fc ortadan kald\u0131rmakta, \u00e7o\u011fulcu ve ho\u015fg\u00f6r\u00fcl\u00fc duygular, yerini nefret duygular\u0131na ve s\u00f6ylemine b\u0131rakmakta, b\u00f6ylece bireyler ve kurumlar sorun \u00e7\u00f6zmek i\u00e7in bir araya gelerek demokrasinin m\u00fczakere imkan\u0131ndan mahrum kalmaktad\u0131rlar. Toplumda en masum sorunlar bile ideolojik bir bak\u0131\u015ftan ge\u00e7irildikten sonra hemen rejim krizine d\u00f6n\u00fc\u015ft\u00fcr\u00fclmekte, derin siyasal ayr\u0131\u015fmalar sonunda bar\u0131\u015f k\u00fclt\u00fcr\u00fcnden uzakla\u015f\u0131lmaktad\u0131r. Nefret s\u00f6yleminden siyasi rant elde edenler k\u0131sa vadede kazanm\u0131\u015f g\u00f6r\u00fclse de uzun d\u00f6nemde toplumu ayr\u0131\u015ft\u0131rman\u0131n gelecek ku\u015faklara b\u0131rak\u0131lan kirli bir miras oldu\u011funu anlayacaklard\u0131r. Hangi kutsal de\u011fer ad\u0131na yap\u0131l\u0131rsa yap\u0131ls\u0131n hakaret, kin, nefret ve \u015fiddete \u00e7a\u011fr\u0131 s\u00f6ylemlerini ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn korumas\u0131 alt\u0131nda kabul etmek asla m\u00fcmk\u00fcn de\u011fildir.&#8221;<\/p>\n<p style=\"text-align: justify;\"><strong>&#8216;\u00d6l\u00e7\u00fcs\u00fczl\u00fck her konuda olumsuzluklar\u0131 besleyen en b\u00fcy\u00fck kaynakt\u0131r&#8217;\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Temel hak ve \u00f6zg\u00fcrl\u00fckler konusunda ya\u015fanan hak ihlallerinin, yetkililerin makul ve \u00f6l\u00e7\u00fcl\u00fc olamama gibi olumsuzluklar\u0131ndan kaynakland\u0131\u011f\u0131n\u0131n da s\u00f6ylenebilece\u011fini ifade eden K\u0131l\u0131\u00e7, \u015f\u00f6yle devam etti: &#8221;G\u00fcvenlik ve \u00f6zg\u00fcrl\u00fckler aras\u0131nda olmas\u0131 gereken dengenin evrensel \u00f6l\u00e7\u00fclere uydurulamamas\u0131, sorunlar\u0131n b\u00fcy\u00fcyerek \u00f6telenmesine neden olmaktad\u0131r. \u00d6l\u00e7\u00fcs\u00fczl\u00fck her konuda olumsuzluklar\u0131 besleyen en b\u00fcy\u00fck kaynakt\u0131r. \u00d6l\u00e7\u00fcs\u00fczl\u00fcklerin sebep oldu\u011fu hak ihlalleri, direnme hakk\u0131n\u0131n me\u015fru zeminini olu\u015fturma gibi bir sonucu da beraberinde getirmektedir. Y\u00fczy\u0131llar boyunca insanl\u0131\u011f\u0131n ortak akl\u0131ndan s\u00fcz\u00fclerek gelen demokratik toplum d\u00fczeninin gerekleri esas al\u0131nd\u0131\u011f\u0131 takdirde, sorunlar\u0131 \u00e7\u00f6zebilme \u015fans\u0131m\u0131z olduk\u00e7a y\u00fcksektir. Ge\u00e7mi\u015fte evrensel anlay\u0131\u015flardan uzakla\u015farak bize \u00f6zg\u00fc uygulamalarla geli\u015ftirilen laiklik, sosyal devlet anlay\u0131\u015f\u0131, devleti kurtarma duygular\u0131 demokrasinin orijinal b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozarak \u00f6zellikle d\u00fc\u015f\u00fcnce, inan\u00e7 ve bunlar\u0131 ifade edebilme alan\u0131nda derin yaralar a\u00e7m\u0131\u015f ve onar\u0131lmas\u0131 g\u00fc\u00e7 izler b\u0131rakm\u0131\u015ft\u0131r. Kavramlar\u0131n a\u00e7\u0131k, net ve \u00f6ng\u00f6r\u00fclebilir olmay\u0131\u015f\u0131, keyfi yorumlar\u0131n do\u011fmas\u0131na, sahip olunan takdir hakk\u0131n\u0131n k\u00f6t\u00fcye kullan\u0131lmas\u0131na ve sonu\u00e7ta ma\u011fdur ve mazlum bir kitlenin olu\u015fmas\u0131na yol a\u00e7m\u0131\u015ft\u0131r.&#8221;<\/p>\n<p style=\"text-align: justify;\">D\u00fcn hak ihlaline u\u011fram\u0131\u015f mazlumlarla bug\u00fcn ayn\u0131 ihlalleri ya\u015fayan insanlar\u0131n kimliklerinin farkl\u0131 olmas\u0131n\u0131n bu d\u00fc\u015f\u00fcnceyi de\u011fi\u015ftirmeyece\u011fini kaydeden K\u0131l\u0131\u00e7, &#8221;Bask\u0131 ve korku temeline dayanan bu yanl\u0131\u015f uygulamalar, insanlar\u0131 hayata yans\u0131tamad\u0131klar\u0131 ancak, i\u00e7 d\u00fcnyalar\u0131nda hapsedilmi\u015f inan\u00e7lar ve beyinlerinden d\u0131\u015far\u0131 \u00e7\u0131karamad\u0131klar\u0131 d\u00fc\u015f\u00fcncelerle ba\u015f ba\u015fa b\u0131rakm\u0131\u015ft\u0131r. \u0130nsan onuruna yap\u0131lm\u0131\u015f i\u015fkence olarak da nitelenen bu iklimden h\u0131zla uzakla\u015fmak kamu g\u00fcc\u00fcn\u00fc elinde tutan yasama, y\u00fcr\u00fctme ve yarg\u0131 organlar\u0131n\u0131n en temel g\u00f6revidir&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">\u0130deolojik vesayeti tahkim etmek \u00fczere insan onuru ile oynayanlar\u0131n tarihin hi\u00e7bir d\u00f6neminde kazanan taraf olmad\u0131\u011f\u0131n\u0131 vurgulayan K\u0131l\u0131\u00e7, &#8221;\u0130nan\u00e7 ve d\u00fc\u015f\u00fcnceleri ifade konusunda ya\u015fanan olumsuzluklar\u0131n giderilmesi i\u00e7in, samimi niyetin varl\u0131\u011f\u0131 ve \u00e7\u00f6z\u00fcm\u00fc konusunda g\u00fc\u00e7l\u00fc bir irade sergilemek zorunday\u0131z. Yasama g\u00fcc\u00fcn\u00fc kullananlar\u0131n gayretleri umut vericidir. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne ili\u015fkin sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fc konusunda yap\u0131lan de\u011fi\u015fiklikler, idari ve yarg\u0131sal uygulamalarda kar\u015f\u0131l\u0131k bulabilirse halk\u0131m\u0131z\u0131 hak etti\u011fi noktaya ta\u015f\u0131yabiliriz&#8221; diye konu\u015ftu.<\/p>\n<p style=\"text-align: justify;\"><strong>Ter\u00f6r sorunu\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi Ba\u015fkan\u0131 Ha\u015fim K\u0131l\u0131\u00e7, t\u00fcm bunlar ifade edilirken, T\u00fcrkiye&#8217;nin yakla\u015f\u0131k 40 y\u0131l\u0131 a\u015fan bir s\u00fcre\u00e7te ya\u015fad\u0131\u011f\u0131 ter\u00f6r sorununun da g\u00f6zard\u0131 edilemeyece\u011fini dile getirerek, &#8221;Ekonomi ve demokrasi konusunda sorunsuz ya\u015fayan g\u00fc\u00e7l\u00fc \u00fclkeler de bile ar\u0131z\u0131 olarak ortaya \u00e7\u0131kan ter\u00f6r eylemleri sonunda, temel hak ve \u00f6zg\u00fcrl\u00fcklerin b\u0131rak\u0131n\u0131z s\u0131n\u0131rlanmas\u0131n\u0131, nas\u0131l ortadan kald\u0131r\u0131ld\u0131\u011f\u0131n\u0131 hepimiz yak\u0131ndan biliyoruz&#8221; de\u011ferlendirmesinde bulundu.<\/p>\n<p style=\"text-align: justify;\">&#8221;Cumhuriyetin 90 y\u0131ll\u0131k \u00f6mr\u00fcn\u00fcn 45 y\u0131l\u0131n\u0131 ter\u00f6rle i\u00e7 i\u00e7e ya\u015fayarak ge\u00e7iren T\u00fcrkiye&#8217;nin ba\u015fta can\u0131yla bedel \u00f6deyenler olmak \u00fczere ekonomik, sosyal ve siyasal alanda hesab\u0131 yap\u0131lmayan kay\u0131plar\u0131 g\u00f6zetildi\u011finde, bu devletin ne kadar g\u00fc\u00e7l\u00fc bir b\u00fcnyeye sahip oldu\u011funu belirtmek gerekir&#8221; diyen K\u0131l\u0131\u00e7, &#8221;T\u00fcrkiye zor bir zaman t\u00fcnelinde, zor davalarla kar\u015f\u0131 kar\u015f\u0131yad\u0131r. Bunlar\u0131 konu\u015faca\u011f\u0131z, ele\u015ftirileri alaca\u011f\u0131z ve demokratik ilkelerin onar\u0131c\u0131 g\u00fcc\u00fc kullan\u0131larak, bar\u0131\u015f i\u00e7inde ya\u015fayan ayd\u0131nl\u0131k bir T\u00fcrkiye&#8217;ye hep beraber y\u00fcr\u00fcyece\u011fiz&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7, \u015f\u00f6yle devam etti: &#8221;Yarg\u0131 mensuplar\u0131na yurt d\u0131\u015f\u0131ndaki geli\u015fmelerin yak\u0131ndan incelenebilmesi i\u00e7in sunulan imkanlar, Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;nde a\u00e7\u0131lm\u0131\u015f davalar\u0131n \u00e7\u00f6z\u00fcm\u00fc konusunda ortaya konulan irade, uzun yarg\u0131lanma s\u00fcreci, uzun tutukluluk, cezalar\u0131n infaz\u0131, birikmi\u015f davalar\u0131n h\u0131zla sonu\u00e7land\u0131r\u0131lmas\u0131 gibi konularda alm\u0131\u015f oldu\u011fu inisiyatifi takdirle kar\u015f\u0131l\u0131yorum. Bunlar\u0131 ifade ederken farkl\u0131 inan\u00e7, farkl\u0131 etnik ve ideolojik d\u00fc\u015f\u00fcnce sahiplerinin ya\u015fad\u0131\u011f\u0131 75 milyon insan\u0131 i\u00e7inde bar\u0131nd\u0131ran bir b\u00fcy\u00fck \u00fclkede sorunlar\u0131n olmad\u0131\u011f\u0131n\u0131 s\u00f6ylemiyorum. Sorunlar\u0131m\u0131z var ancak, bunlar\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in samimi bir gayretin varl\u0131\u011f\u0131n\u0131 da g\u00f6rmemezlikten gelemeyiz.&#8221;<\/p>\n<p style=\"text-align: justify;\">Konferansta, t\u00fcm \u00f6zg\u00fcrl\u00fcklerin da\u011f\u0131t\u0131m\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131 kav\u015fak olarak nitelenen ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn konu\u015fulaca\u011f\u0131n\u0131 belirten K\u0131l\u0131\u00e7, ak\u0131l ve d\u00fc\u015f\u00fcncenin, insano\u011flunun yarat\u0131lanlar\u0131n en \u015fereflisi olarak kabul g\u00f6rmesini sa\u011flad\u0131\u011f\u0131n\u0131 anlatt\u0131. Descartes&#8217;in, &#8221;D\u00fc\u015f\u00fcn\u00fcyorum o halde var\u0131m&#8221; s\u00f6z\u00fcne at\u0131fta bulunan K\u0131l\u0131\u00e7, &#8221;Descartes&#8217;de insan\u0131n varl\u0131k sebebini, d\u00fc\u015f\u00fcnmek ve d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcn\u00fc ifade edebilme ile a\u00e7\u0131klamaktad\u0131r. Denilebilir ki d\u00fc\u015f\u00fcnmek ve d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcn\u00fc ifade edebilme \u00f6zg\u00fcrl\u00fc\u011f\u00fc yoksa, insanda yoktur. Yarat\u0131l\u0131\u015f bu ger\u00e7ek \u00fczerine kurulmu\u015f, \u00f6l\u00fcm \u00f6tesi sorumluluk tezini ortaya koyan \u00f6\u011fretiler de e\u015frefi mahluk kavram\u0131n\u0131 ak\u0131l ve d\u00fc\u015f\u00fcnce ile izah etmi\u015flerdir. Kimine g\u00f6re, hayat hakk\u0131ndan bile \u00f6ncelikli olan d\u00fc\u015f\u00fcnceyi ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc, insan olman\u0131n tek \u015fart\u0131 olarak kabul g\u00f6rm\u00fc\u015ft\u00fcr&#8221; \u015feklinde konu\u015ftu.<\/p>\n<p style=\"text-align: justify;\">\u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn, insanl\u0131k tarihi s\u00fcrecinde \u00e7ok \u00e7etin m\u00fccadelelerin konusu oldu\u011funu ve en de\u011ferli varl\u0131klar\u0131n bu u\u011furda feda edildi\u011fini vurgulayan K\u0131l\u0131\u00e7, s\u00f6zlerini \u015f\u00f6yle s\u00fcrd\u00fcrd\u00fc: &#8221;Birey olarak, devlet olarak, yada bas\u0131n mensubu kimli\u011fimizle bug\u00fcn ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc konusunda \u00f6zge\u00e7mi\u015fimizi sorgulayarak, gelecek ku\u015faklara sorun b\u0131rakmaman\u0131n gayreti i\u00e7inde olmam\u0131z gerekti\u011fini belirtmek istiyorum. Amac\u0131m\u0131z, \u00e7a\u011fda\u015f d\u00fcnya uygulamalar\u0131 ile \u00f6rt\u00fc\u015fmeyen ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne ili\u015fkin sorunlu alanlar\u0131n, bir kez daha ortaya konularak onar\u0131c\u0131 ve tedavi edici anlay\u0131\u015flar\u0131n \u0131\u015f\u0131\u011f\u0131nda \u00e7\u00f6z\u00fcm\u00fcn\u00fc sa\u011flamakt\u0131r. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne ili\u015fkin sorunlar\u0131 iki ana eksen etraf\u0131nda de\u011ferlendirebiliriz. Birincisi, yaz\u0131l\u0131 kurallar\u0131n a\u00e7\u0131k, net, yada \u00f6ng\u00f6r\u00fclebilir olmamas\u0131 nedeniyle ortaya \u00e7\u0131kan hak ihlalleri, ikincisi ise uygulamay\u0131 y\u00f6neten kamu g\u00f6revlilerinin sahip oldu\u011fu takdir hakk\u0131n\u0131n bilin\u00e7li veya bilin\u00e7siz \u015fekilde k\u00f6t\u00fcye kullanmas\u0131 yada \u00f6nyarg\u0131lar\u0131n, \u00e7\u0131kar hesaplar\u0131n\u0131n ve keyfi yorumlar\u0131n sebep oldu\u011fu olumsuzluklard\u0131r.&#8221;<\/p>\n<p style=\"text-align: justify;\">Bu iki ana kaynaktan beslenen ihlallerin kat\u0131l\u0131mc\u0131lar taraf\u0131ndan ayr\u0131nt\u0131l\u0131 bir \u015fekilde konu\u015facaklar\u0131n\u0131 belirten K\u0131l\u0131\u00e7, &#8221;Ancak ana hatlar\u0131 ile baz\u0131 tespitleri yeniden g\u00fcndeme getirmek istiyorum. Gerek Anayasa ve yasalar\u0131m\u0131zda, gerekse Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nde, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne ili\u015fkin yasaklar ve s\u0131n\u0131rlama sebeplerine bak\u0131ld\u0131\u011f\u0131nda a\u00e7\u0131kl\u0131k, netlik ve \u00f6ng\u00f6r\u00fclebilirlik y\u00f6n\u00fcnden ayn\u0131 niteliklere sahip d\u00fczenlemeler oldu\u011funu s\u00f6ylemek yanl\u0131\u015f olmayacakt\u0131r&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7, \u015funlar\u0131 s\u00f6yledi: &#8221;\u00c7er\u00e7eve niteli\u011findeki bu ilkeler ve kavramlar ayn\u0131 olmakla birlikte sorun b\u00fcy\u00fck \u00f6l\u00e7\u00fcde uygulama a\u015famas\u0131nda ortaya \u00e7\u0131kmaktad\u0131r. Evrensel ilke ve kavramlarla \u00f6rt\u00fc\u015fmeyen yorum ve anlay\u0131\u015flar, \u00e7a\u011fda\u015f d\u00fcnya ile ba\u011flar\u0131m\u0131z\u0131 koparmaktad\u0131r. \u00dclkemizde de temel hak ve \u00f6zg\u00fcrl\u00fcklerin evrensel boyutla \u00f6rt\u00fc\u015f\u00fcr \u015fekilde ele al\u0131nmas\u0131 ve uluslararas\u0131 standartlarda korumaya kavu\u015fmas\u0131 amac\u0131yla mevzuat\u0131m\u0131zda \u00e7ok say\u0131da ve \u00f6nemli de\u011fi\u015fiklikler yap\u0131lm\u0131\u015ft\u0131r. Yap\u0131lan bu reformlar sayesinde, temel hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkin uluslararas\u0131 metinlerle anayasal h\u00fck\u00fcmler aras\u0131nda b\u00fcy\u00fck \u00f6l\u00e7\u00fcde paralellik sa\u011flanm\u0131\u015ft\u0131r. Bununla birlikte bu de\u011fi\u015fikliklerin uygulamada yeterince etkilerini g\u00f6stermedi\u011fi d\u00fc\u015f\u00fcncesi, yasama organ\u0131n\u0131 hak ve \u00f6zg\u00fcrl\u00fckleri evrensel ilkelerle daha da g\u00fc\u00e7lendirmek amac\u0131yla baz\u0131 ad\u0131mlar atmaya zorunlu k\u0131lm\u0131\u015ft\u0131r. Bunlardan ilki, 2004 y\u0131l\u0131nda 5170 say\u0131l\u0131 Anayasa de\u011fi\u015fikli\u011fine dair Kanun ile Anayasa&#8217;n\u0131n &#8216;Milletleraras\u0131 antla\u015fmalar\u0131 uygun bulma&#8217; ba\u015fl\u0131kl\u0131 90. maddesinin son f\u0131kras\u0131na eklenen c\u00fcmledir. \u0130kincisi de 2010 y\u0131l\u0131nda yap\u0131lan anayasa de\u011fi\u015fikli\u011fi ile Anayasa Mahkemesinin g\u00f6revleri aras\u0131na eklenen &#8216;bireysel ba\u015fvuru&#8217; yoludur.&#8221;<\/p>\n<p style=\"text-align: justify;\"><strong>&#8216;Bireysel ba\u015fvuru bir \u00e7are olarak d\u00fc\u015f\u00fcn\u00fclm\u00fc\u015ft\u00fcr&#8230;&#8217;\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Anayasan\u0131n 90. maddesinde yap\u0131lan bu de\u011fi\u015fikli\u011fin, &#8221;\u0130nsan haklar\u0131 konusunda yeni a\u00e7\u0131l\u0131mlar&#8221; sa\u011flamas\u0131n\u0131n temenni edildi\u011fini vurgulayan K\u0131l\u0131\u00e7, &#8221;Bu h\u00fckm\u00fcn \u00f6zellikle bug\u00fcne kadar milletleraras\u0131 insan haklar\u0131 normlar\u0131n\u0131 do\u011frudan uygulamakta \u00fcrkek, \u00e7ekingen ve mesafeli davranan yarg\u0131\u00e7lar\u0131m\u0131z\u0131 bu konuda te\u015fvik edece\u011fi, daha do\u011fru bir ifadeyle zorlayaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclmekteydi&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">&#8221;Anayasa&#8217;n\u0131n 90. maddesinde yap\u0131lan de\u011fi\u015fiklikle, Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;ndeki ba\u015fvurular\u0131 ve verilen ihlal kararlar\u0131n\u0131 minimum d\u00fczeye \u00e7ekmede bir ilerleme sa\u011flayamad\u0131\u011f\u0131ndan, bireysel ba\u015fvurunun bir \u00e7are olarak d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcn\u00fc&#8221; ifade eden K\u0131l\u0131\u00e7, \u015f\u00f6yle konu\u015ftu: &#8221;Bireysel Ba\u015fvuru yolunun a\u00e7\u0131lmas\u0131 asl\u0131nda, Anayasa&#8217;n\u0131n 90. Maddesinin son f\u0131kras\u0131na eklenen c\u00fcmlenin amac\u0131yla da \u00f6rt\u00fc\u015fmektedir. Bu iki anayasal de\u011fi\u015fikli\u011fin birbirinden ba\u011f\u0131ms\u0131z olarak d\u00fc\u015f\u00fcn\u00fclmemesi gerekir. Aksine bu iki d\u00fczenleme birbirini tamamlamakta, hatta biri di\u011ferinin amac\u0131n\u0131n ger\u00e7ekle\u015ftirmesine ivme kazand\u0131rmak gibi bir i\u015flev de g\u00f6rmektedir. Bireysel ba\u015fvurunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc konusunda da, T\u00fcrkiye&#8217;deki uygulama ile Avrupa \u0130nsan Haklar\u0131 Mahkemesi kararlar\u0131ndaki anlay\u0131\u015f fark\u0131n\u0131n ortadan kalkmas\u0131na imkan sa\u011flayaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Ancak, adli, idari ve askeri yarg\u0131n\u0131n k\u00fcrs\u00fclerinde g\u00f6revli hakimlerimizin endi\u015felerinin giderilmesi ve uluslararas\u0131 s\u00f6zle\u015fme h\u00fck\u00fcmlerinin uygulanmas\u0131 konusunda cesaretlendirilmesinin, y\u00fcksek yarg\u0131 organlar\u0131n\u0131n risk y\u00fcklenerek ortaya koyacaklar\u0131 i\u00e7tihatlarla desteklenmesine ba\u011fl\u0131 oldu\u011funu s\u00f6ylemek yanl\u0131\u015f olmayacakt\u0131r.
