Bu ger\u00e7eklere ula\u015fmakla hak ve \u00f6zg\u00fcrl\u00fckleri ihlal edilmi\u015f olanlar\u0131n haklar\u0131n\u0131 zaman\u0131nda ve adilce teslim etmi\u015f oluruz. \u0130\u015fte bug\u00fcn, bu sanat\u0131n icras\u0131 s\u0131ras\u0131nda ortaya \u00e7\u0131kan engellerin kald\u0131r\u0131lmas\u0131 i\u00e7in geli\u015fen teknikler konu\u015fulacak, b\u00f6ylece, yarg\u0131n\u0131n asli g\u00f6revi olan ya\u015fanm\u0131\u015f hak ihlallerini ortadan kald\u0131rmak i\u00e7in \u201cvicdan birli\u011fini\u201d sa\u011flam\u0131\u015f olaca\u011f\u0131z. Yarg\u0131n\u0131n topluma sundu\u011fu yegane \u00fcr\u00fcn\u00fc adalettir. Ve bu \u00fcr\u00fcn\u00fcn alternatifi de yoktur. Adalet hizmetlerinin onar\u0131c\u0131 niteli\u011fi, \u00fcretim kalitesi ve zaman\u0131nda da\u011f\u0131t\u0131m\u0131n varl\u0131\u011f\u0131 ile g\u00fc\u00e7 kazan\u0131r. Aksi durum bunal\u0131m, kaos ve vicdanlar\u0131 isyana s\u00fcr\u00fcklemekten ba\u015fka sonu\u00e7 do\u011furmaz. \u0130\u015fte \u201chukukun haks\u0131zl\u0131\u011f\u0131\u201d olarak da tan\u0131mlayaca\u011f\u0131m\u0131z bu kaotik duruma \u00e7\u00f6z\u00fcm bulma zorunda oldu\u011fumuzu belirtmek isterim.<\/p>\n<p style=\"text-align: justify;\">T\u00fcrk yarg\u0131 d\u00fcnyas\u0131nda ya\u015fanan b\u00fcy\u00fck sorunlar\u0131n, uygulama s\u00fcrecinde ya\u015fanan olumsuzluklardan kaynakland\u0131\u011f\u0131n\u0131 s\u00f6ylemek yanl\u0131\u015f olmayacakt\u0131r. Hakimin tarafs\u0131zl\u0131\u011f\u0131n\u0131n sa\u011flanamamas\u0131, mesleki e\u011fitimdeki eksiklikler, evrensel de\u011ferlere uzakl\u0131k gibi nedenler \u201cuygulamada\u201d toplumu ikna edecek g\u00fc\u00e7l\u00fc kararlar\u0131n \u00e7\u0131kmas\u0131na imkan vermemektedir. Do\u011fan bu bo\u015fluk her seferinde siyaset kurumlar\u0131nca yasal d\u00fczenlemeler yap\u0131lmak suretiyle doldurulmu\u015f ve yarg\u0131n\u0131n yorum alan\u0131 daralt\u0131lm\u0131\u015ft\u0131r. Bunu bir \u015fekilde yarg\u0131ya olan g\u00fcvensizlik olarak da tan\u0131mlayabilirsiniz. YARGININ HESABINI VEREMED\u0130\u011e\u0130 SINIR TANIMAZ UYGULAMALARI A\u011eIR BEDELLER \u00d6DENMES\u0130 SONUCUNU DO\u011eURMU\u015e, ANAYASA VE YASALARDA RAD\u0130KAL DE\u011e\u0130\u015e\u0130MLER\u0130N YAPILMASININ HAKLI NEDEN\u0130N\u0130 OLU\u015eTURMU\u015eTUR. Bu dili nas\u0131l kullan\u0131rsan\u0131z hukuk devleti ona g\u00f6re olu\u015fur ve geli\u015fir. Hakimin i\u00e7 d\u00fcnyas\u0131ndaki endi\u015fe, kayg\u0131, korku, idolojik bask\u0131, dostluk ve d\u00fc\u015fmanl\u0131k duygular\u0131ndan ar\u0131nd\u0131r\u0131lmas\u0131, tarafs\u0131zl\u0131\u011f\u0131n olmazsa olmaz ko\u015fuludur. Bu s\u00fcrecin y\u00fcr\u00fct\u00fclmesinde ba\u015fta Cumhuriyet savc\u0131lar\u0131 ve hakimler olmak \u00fczere, uygulay\u0131c\u0131lara \u00f6nemli sorumluluk d\u00fc\u015fmektedir. Kamuoyunda bu mahkemelerin (\u00d6zel yetkili mahkemeler \u2013 CMK m 250 ile g\u00f6revli) g\u00f6rev alan\u0131na giren su\u00e7lar\u0131n soru\u015fturmas\u0131 ve kovu\u015fturmas\u0131 s\u0131ras\u0131nda yap\u0131lan uygulamalar sebebiyle ortaya \u00e7\u0131kan baz\u0131 olumsuz alg\u0131lar\u0131 da g\u00f6rmezden gelemeyiz.<\/p>\n<p style=\"text-align: justify;\">Ancak bu m\u00fccadele verilirken devletler, ki\u015filerin sahip olduklar\u0131 hak ve \u00f6zg\u00fcrl\u00fcklerin zedelenmemesi, ihlal edilmemesi i\u00e7in gerekli dikkat ve \u00f6zeni azam\u00ee d\u00fczeyde g\u00f6stermek zorundad\u0131rlar. Bu su\u00e7lar\u0131n soru\u015fturulmas\u0131 ve kovu\u015fturulmas\u0131nda yasalarda d\u00fczenlenen temel hak ve \u00f6zg\u00fcrl\u00fckleri k\u0131s\u0131tlayan h\u00fck\u00fcmler; Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi h\u00fck\u00fcmleri ve Avrupa \u0130nsan Haklar\u0131 Mahkemesi i\u00e7tihatlar\u0131 da g\u00f6z \u00f6n\u00fcnde bulundurulmak suretiyle \u00f6zenle ve dikkatle uygulanmal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">Avrupa \u0130nsan Haklar\u0131 Mahkemesi i\u00e7tihatlar\u0131nda da belirtildi\u011fi \u00fczere; yap\u0131lacak i\u015flemlerde me\u015fru ama\u00e7, orant\u0131l\u0131l\u0131k ve gereklilik kriterlerine uygun hareket edilmesidir.<\/p>\n<p style=\"text-align: justify;\">Avrupa \u0130nsan Mahkemesi \u0130\u00e7tihatlar\u0131na bakt\u0131\u011f\u0131m\u0131zda, devletlere i\u015flenen su\u00e7larla etkin bir soru\u015fturma yap\u0131lmas\u0131 g\u00f6revi y\u00fcklenirken, bunun yan\u0131nda, adil yarg\u0131lanma hakk\u0131 \u00fcst ba\u015fl\u0131\u011f\u0131 alt\u0131nda san\u0131klar\u0131n sahip olduklar\u0131 masumiyet karinesi, makul s\u00fcrede yarg\u0131lanma ve silahlar\u0131n e\u015fitli\u011fi gibi haklar\u0131n da dikkatle korundu\u011fu ve bu haklar\u0131n ihlalinden devletlerin sorumlu tutuldu\u011fu g\u00f6r\u00fclmektedir.<\/p>\n<p style=\"text-align: justify;\">Ulusal g\u00fcvenlik kayg\u0131lar\u0131yla bireysel g\u00fcvenlik taleplerine s\u0131rt \u00e7eviren \u00fclkeler, sonu\u00e7ta ulusal g\u00fcvenliklerini sa\u011flayacak sosyal me\u015fruiyetten yoksun kalabilirler.<\/p>\n<p style=\"text-align: justify;\">Unutulmamal\u0131d\u0131r ki, temel hak ve \u00f6zg\u00fcrl\u00fcklere orant\u0131s\u0131z m\u00fcdahaleler, hukukun asla tasvip etmedi\u011fi bir husustur.<\/p>\n<p style=\"text-align: justify;\">Ceza muhakemesinin amac\u0131; her ne suretle olursa olsun, maddi ger\u00e7e\u011fe ula\u015fmak olmay\u0131p maddi ger\u00e7e\u011fi, d\u00fcr\u00fcstl\u00fck ilkesi ve hukuk devletinin gereklerine uygun bir s\u00fcre\u00e7 sonucunda ortaya \u00e7\u0131karmakt\u0131r. ANCAK, UYGULAMADA HAK\u0130MLER\u0130N tutuklama, tutuklu\u011fun devam\u0131 veya tahliye talebinin reddi kararlar\u0131nda yeterli gerek\u00e7e g\u00f6stermeden MATBU \u015eEK\u0130LDE AYNI \u0130BARELER\u0130 KULLANARAK KARAR VERD\u0130KLER\u0130 Y\u00d6N\u00dcNDE ZAMAN ZAMAN \u015e\u0130KAYETLER YAPILMAKTADIR.<\/p>\n<p style=\"text-align: justify;\">Bu durum hem T\u00fcrk kamuoyunda hem de uluslar aras\u0131 kurumlarda s\u00fcrekli ele\u015ftiri konusu yap\u0131lmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bu nedenlerle, tutuklamaya, tutuklaman\u0131n devam\u0131na veya bu husustaki bir tahliye isteminin reddine ili\u015fkin kararlarda, kuvvetli su\u00e7 \u015f\u00fcphesi ve tutuklama nedenlerinin varl\u0131\u011f\u0131 ile tutuklama tedbirinin \u00f6l\u00e7\u00fcl\u00fc oldu\u011funun somut olgularla gerek\u00e7elendirilerek a\u00e7\u0131k\u00e7a yaz\u0131lmas\u0131 gerekti\u011fi maddede yap\u0131lan de\u011fi\u015fiklikle a\u00e7\u0131k\u00e7a d\u00fczenlemi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Buna g\u00f6re, h\u00e2kim veya mahkeme, tutuklamaya, tutuklaman\u0131n devam\u0131na veya tahliye isteminin reddine ili\u015fkin karar verirken kuvvetli su\u00e7 \u015f\u00fcphesinin varl\u0131\u011f\u0131n\u0131, tutuklama nedenlerinin varl\u0131\u011f\u0131n\u0131 ve somut olayda tutuklama tedbirinin \u00f6l\u00e7\u00fcl\u00fc oldu\u011fu somut olgularla gerek\u00e7elendirilecektir.<\/p>\n<p style=\"text-align: justify;\">CMK 250. MADDE KAPSAMINA G\u0130REN SU\u00c7LAR BAKIMINDAN \u00d6ZEL SORU\u015eTURMA VE KOVU\u015eTURMA USULLER\u0130NDEN BAZILARI KALDIRILMAKTADIR.<\/p>\n<p style=\"text-align: justify;\">Uzun zamand\u0131r kamuoyunda ve doktrinde ele\u015ftirilere u\u011frayan CMK\u2019n\u0131n 250. maddesi uyar\u0131nca g\u00f6revli olan \u00f6zel yetkili mahkemelerin g\u00f6revine giren su\u00e7larda uygulanan \u00f6zel soru\u015fturma ve kovu\u015fturma usullerinden baz\u0131lar\u0131 y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lmaktad\u0131r.
