{"id":50390,"date":"2012-04-04T22:18:38","date_gmt":"2012-04-04T19:18:38","guid":{"rendered":"http:\/\/www.korhanyilmaz.com\/?p=50390"},"modified":"2012-04-05T11:22:14","modified_gmt":"2012-04-05T08:22:14","slug":"toplu-sozlesme-yasasi-kabul-edildi","status":"publish","type":"post","link":"http:\/\/www.korhanyilmaz.com\/?p=50390","title":{"rendered":"Toplu s\u00f6zle\u015fme yasas\u0131 kabul edildi"},"content":{"rendered":"<p style=\"text-align: center;\"><a href=\"http:\/\/www.korhanyilmaz.com\/wp-content\/uploads\/2012\/04\/A0226.jpg\"  class=\"lightview\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter  wp-image-50391\" src=\"http:\/\/www.korhanyilmaz.com\/wp-content\/uploads\/2012\/04\/A0226.jpg\" alt=\"\" width=\"308\" height=\"224\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">Kamu g\u00f6revlilerine toplu s\u00f6zle\u015fme hakk\u0131 tan\u0131yan Kamu G\u00f6revlileri Sendikalar\u0131 Kanunu&#8217;nda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun Tasar\u0131s\u0131, TBMM Genel Kurulu&#8217;nda kabul edilerek yasala\u015ft\u0131.<\/p>\n<p style=\"text-align: justify;\">Yasa, Anayasa&#8217;da yap\u0131lan de\u011fi\u015fiklik uyar\u0131nca, memurlar ile di\u011fer kamu g\u00f6revlilerine tan\u0131nan toplu s\u00f6zle\u015fme hakk\u0131n\u0131n kullan\u0131lmas\u0131n\u0131 d\u00fczenliyor.<\/p>\n<p style=\"text-align: justify;\">Toplu s\u00f6zle\u015fme yap\u0131lma usul\u00fc, taraflar\u0131, kapsam\u0131, toplu s\u00f6zle\u015fmeden yararlanacaklar\u0131, toplu s\u00f6zle\u015fme h\u00fck\u00fcmlerinin emeklilere yans\u0131t\u0131lmas\u0131n\u0131, Kamu G\u00f6revlileri Hakem Kurulu&#8217;nun olu\u015fumu ve \u00e7al\u0131\u015fma esaslar\u0131n\u0131 belirliyor.<!--more--><\/p>\n<p style=\"text-align: justify;\">Kamu G\u00f6revlileri Sendikalar\u0131 Kanunu&#8217;nun ad\u0131 yasayla, Kamu G\u00f6revlileri Sendikalar\u0131 ve Toplu S\u00f6zle\u015fme Kanunu olarak de\u011fi\u015ftiriliyor.<\/p>\n<p style=\"text-align: justify;\">Kanun, sendika kurucusu olabilmek i\u00e7in en az 2 y\u0131ldan beri kamu g\u00f6revlisi olarak \u00e7al\u0131\u015fma \u015fart\u0131n\u0131, sendika kurucular\u0131n\u0131n kurulu\u015f i\u015flemleri i\u00e7in valiliklere n\u00fcfus c\u00fczdan\u0131 \u00f6rne\u011fi ve ikametgah belgesi verme zorunlulu\u011funu kald\u0131r\u0131yor.<\/p>\n<p style=\"text-align: justify;\">Konfederasyon kurucular\u0131 ise ilk genel kurula kadar sevk ve idare edeceklerin kimlikleri yerine sadece isimlerini bildirebilecekler.<\/p>\n<p style=\"text-align: justify;\">Genel Kurul&#8217;un yap\u0131lmas\u0131 i\u00e7in bin \u00fcye gerekecek<\/p>\n<p style=\"text-align: justify;\">Sendika \u015fubelerinin Genel Kurullar\u0131n\u0131n delegelerle yap\u0131labilmesi i\u00e7in 500 de\u011fil, bin \u00fcyesi olmas\u0131 gerekecek.<\/p>\n<p style=\"text-align: justify;\">3 y\u0131lda bir toplanan ola\u011fan genel kurullar, 4 y\u0131l\u0131 a\u015fmamak \u00fczere t\u00fcz\u00fcklerde belirtilen s\u00fcrede yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">Genel Kurul&#8217;a kat\u0131lacaklara, iki genel kurul toplant\u0131s\u0131 aras\u0131ndaki d\u00f6neme ili\u015fkin faaliyet ve hesap raporu, denetleme kurulu veya denet\u00e7i raporu, gelecek d\u00f6neme ili\u015fkin b\u00fct\u00e7e \u00f6nerisi, elektronik ortamda da g\u00f6nderilebilecek, internet sitesinde ilan edilecek.<\/p>\n<p style=\"text-align: justify;\">\u015eubelerde, bir denet\u00e7i yerine en \u00e7ok 5 denet\u00e7i olabilecek. Ama\u00e7lar\u0131na uyan uluslararas\u0131 kurulu\u015flara \u00fcye olabilen sendika ve konfederasyonlar, bundan sonra t\u00fcz\u00fcklerinde g\u00f6sterilen ama\u00e7lar\u0131 ger\u00e7ekle\u015ftirmek \u00fczere uluslararas\u0131 kurulu\u015f kurabilecek.<\/p>\n<p style=\"text-align: justify;\">Kamu i\u015fvereninin; sendika i\u015fyeri ile il ve il\u00e7e temsilcisinin i\u015fyerini de\u011fi\u015ftirmesindeki &#8220;hakl\u0131 bir neden&#8221; \u015fart\u0131 kald\u0131r\u0131l\u0131yor.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130l ve il\u00e7e temsilcili\u011fi kurulabilecek<\/strong><\/p>\n<p style=\"text-align: justify;\">Sendika \u015fubesi bulunmayan il ve il\u00e7elerde, il ve il\u00e7e temsilcili\u011fi kurulabilecek. Kamu g\u00f6revlileri sendikalar\u0131 ile konfederasyonlar, toplu s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmelerinde taraf olmaya yetkili olacak.<\/p>\n<p style=\"text-align: justify;\">Devlet Personel Ba\u015fkanl\u0131\u011f\u0131&#8217;n\u0131n ba\u011fl\u0131 oldu\u011fu Bakan\u0131n ba\u015fkanl\u0131\u011f\u0131nda, en \u00e7ok \u00fcyeye sahip 3 konfederasyon genel ba\u015fkan\u0131, her bir hizmet kolunda en \u00e7ok \u00fcyeye sahip kamu g\u00f6revlileri sendikas\u0131 ba\u015fkan\u0131 ve Devlet Personel Ba\u015fkan\u0131&#8217;ndan olu\u015fan &#8220;Kamu Personeli Dan\u0131\u015fma Kurulu&#8221; olu\u015fturulacak.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fyerlerinde yap\u0131lan tespite g\u00f6re, kamu g\u00f6revlilerinden en \u00e7ok \u00fcye kaydetmi\u015f sendika, i\u015fyeri sendika temsilcisi se\u00e7meye yetkili olacak. \u0130\u015fyerindeki kamu g\u00f6revlisi say\u0131s\u0131 200&#8217;e kadarsa 1, 201-600 aras\u0131nda ise en \u00e7ok 2, 601-1000 aras\u0131nda ise en \u00e7ok 3, 1001-2000 aras\u0131nda ise en \u00e7ok 4, 2000&#8217;den fazla ise en \u00e7ok 5 i\u015f yeri sendika temsilcisi se\u00e7ilebilecek.<\/p>\n<p style=\"text-align: justify;\"><strong>Toplu s\u00f6zle\u015fme kapsam\u0131 ve taraflar\u0131<\/strong><\/p>\n<p style=\"text-align: justify;\">Toplu s\u00f6zle\u015fme; kamu g\u00f6revlilerinin mali ve sosyal haklar\u0131n\u0131 d\u00fczenleyen mevzuat h\u00fck\u00fcmleri dikkate al\u0131narak, kamu g\u00f6revlilerine uygulanacak katsay\u0131 ve g\u00f6stergeler, ayl\u0131k ve \u00fccretler, her t\u00fcrl\u00fc zam ve tazminatlar, ek \u00f6deme, toplu s\u00f6zle\u015fme ikramiyesi, fazla \u00e7al\u0131\u015fma \u00fccreti harc\u0131rah, ikramiye, do\u011fum, \u00f6l\u00fcm ve aile yard\u0131m\u0131 \u00f6denekleri, cenaze giderleri, yiyecek ve giyecek yard\u0131mlar\u0131, di\u011fer mali ve sosyal haklar\u0131 kapsayacak.<\/p>\n<p style=\"text-align: justify;\">Toplu s\u00f6zle\u015fme h\u00fck\u00fcmleri, s\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131 tarihi takip eden 2 mali y\u0131l i\u00e7in ge\u00e7erli olacak. Toplu s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmelerine, kamu idaresi ad\u0131na Kamu \u0130\u015fveren Heyeti, kamu g\u00f6revlileri ad\u0131na ise Kamu G\u00f6revlileri Sendikalar\u0131 Heyeti kat\u0131lacak. Kamu \u0130\u015fveren Heyeti; Devlet Personel Ba\u015fkanl\u0131\u011f\u0131&#8217;n\u0131n ba\u011fl\u0131 oldu\u011fu Bakan\u0131n ba\u015fkanl\u0131\u011f\u0131nda, \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131, \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131, Kalk\u0131nma Bakanl\u0131\u011f\u0131, Maliye Bakanl\u0131\u011f\u0131, Hazine M\u00fcste\u015farl\u0131\u011f\u0131, Devlet Personel Ba\u015fkanl\u0131\u011f\u0131 temsilcilerinden olu\u015facak.<\/p>\n<p style=\"text-align: justify;\">Kamu G\u00f6revlileri Sendikalar\u0131 Heyeti 15 \u00fcyeden olu\u015facak. En fazla \u00fcyeye sahip sendika temsilcisinin g\u00f6r\u00fc\u015fmelere kat\u0131lmamas\u0131 halinde, en fazla \u00fcyeye sahip ikinci s\u0131rada bulunan sendika, heyete dahil edilecek.<\/p>\n<p style=\"text-align: justify;\"><strong>Toplu s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmeleri<\/strong><\/p>\n<p style=\"text-align: justify;\">Toplu s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmeleri, son rakam\u0131 tek olan y\u0131llarda yap\u0131lacak. Kamu g\u00f6revlilerinin geneline y\u00f6nelik toplu s\u00f6zle\u015fme teklifleri, Kamu G\u00f6revlileri Sendikalar\u0131 Heyeti&#8217;nin konfederasyon temsilcisi \u00fcyeleri; her bir hizmet koluna ili\u015fkin toplu s\u00f6zle\u015fme teklifleri ise heyetin ilgili sendika temsilcisi \u00fcyesi taraf\u0131ndan haz\u0131rlanacak ve g\u00f6r\u00fc\u015fmelerin ba\u015flama tarihinden en az 1 hafta \u00f6nce Kamu \u0130\u015fveren Heyeti&#8217;ne sunulmak \u00fczere Devlet Personel Ba\u015fkanl\u0131\u011f\u0131&#8217;na verilecek.<\/p>\n<p style=\"text-align: justify;\">Toplu s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmelerine A\u011fustos ay\u0131n\u0131n ilk i\u015fg\u00fcn\u00fc ba\u015flanacak. S\u00fcre\u00e7, Kamu G\u00f6revlileri Hakem Kurulu karar\u0131n\u0131n al\u0131nmas\u0131 da dahil olmak \u00fczere en ge\u00e7 A\u011fustos ay\u0131n\u0131n son i\u015fg\u00fcn\u00fc tamamlanacak.<\/p>\n<p style=\"text-align: justify;\"><strong>Belediyelerde s\u00f6zle\u015fme imzalanmas\u0131<\/strong><\/p>\n<p style=\"text-align: justify;\">Belediye Meclisi taraf\u0131ndan \u00e7al\u0131\u015fanlara sosyal denge tazminat\u0131n\u0131n \u00f6denmesine karar verilmesi halinde, s\u00f6zle\u015fme d\u00f6neminde verilecek sosyal denge tazminat\u0131 tutar\u0131n\u0131 belirlemek \u00fczere, belediye ba\u015fkan\u0131 ile en \u00e7ok \u00fcyeye sahip sendika aras\u0131nda toplu s\u00f6zle\u015fme s\u00fcrecinin tamamlanmas\u0131n\u0131 izleyen 3 ay i\u00e7erisinde s\u00f6zle\u015fme yap\u0131labilecek.<\/p>\n<p style=\"text-align: justify;\">Mahalli idarenin vadesi ge\u00e7mi\u015f vergi, sosyal g\u00fcvenlik primi ile Hazine&#8217;ye olan bor\u00e7 toplam\u0131n\u0131n b\u00fct\u00e7e gelirlerinin y\u00fczde 10&#8217;unu a\u015fmas\u0131 veya ayl\u0131k ve \u00fccret borcu bulunmas\u0131 ya da personel giderinin b\u00fct\u00e7e gelirlerinin belediyede y\u00fczde 30&#8217;unu, il \u00f6zel idaresinde ise y\u00fczde 25&#8217;ini a\u015fmas\u0131 hallerinde s\u00f6zle\u015fme\u00a0yap\u0131lamayacak.<\/p>\n<p style=\"text-align: justify;\"><strong>Uyu\u015fmazl\u0131k hali<\/strong><\/p>\n<p style=\"text-align: justify;\">Toplu s\u00f6zle\u015fme s\u00fcreci sonunda toplu s\u00f6zle\u015fme imzalanamamas\u0131 halinde, \u00fczerinde uzla\u015f\u0131lan ve uzla\u015f\u0131lmayan konular\u0131 i\u00e7eren toplant\u0131 tutana\u011f\u0131, Kamu G\u00f6revlileri Sendikalar\u0131 Heyeti Ba\u015fkan\u0131, sendika temsilcisi ve Kamu \u0130\u015fveren Heyeti Ba\u015fkan\u0131 taraf\u0131ndan imzalanacak.<\/p>\n<p style=\"text-align: justify;\">Toplu s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmelerinin uzla\u015fmazl\u0131kla sonu\u00e7lanmas\u0131 ve toplant\u0131 tutana\u011f\u0131 imzalanamamas\u0131 halinde g\u00f6r\u00fc\u015fmelerin uzla\u015fmazl\u0131kla sonu\u00e7land\u0131\u011f\u0131na dair tespit tutana\u011f\u0131 tutulacak.<\/p>\n<p style=\"text-align: justify;\">Tutana\u011f\u0131n imzalanmas\u0131ndan veya g\u00f6r\u00fc\u015fmelerin uzla\u015fmazl\u0131kla sonu\u00e7land\u0131\u011f\u0131n\u0131n tespit tutana\u011f\u0131 ile belirlenmesinden itibaren, 3 i\u015f g\u00fcn\u00fc i\u00e7erisinde Kamu G\u00f6revlileri Hakem Kurulu&#8217;na ba\u015fvurulabilecek. 2012 ve 2013 y\u0131llar\u0131na ili\u015fkin toplu s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmelerine, kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren 1 ay i\u00e7inde ba\u015flanacak.<\/p>\n<p style=\"text-align: justify;\"><strong>Yetki tespiti yap\u0131lacak<\/strong><\/p>\n<p style=\"text-align: justify;\">Yetkili sendika ve konfederasyonlar\u0131n belirlenmesinde kurumlarca yap\u0131lacak tespit, 2012 y\u0131l\u0131 i\u00e7in 15 Haziran 2012 tarihi esas al\u0131narak ger\u00e7ekle\u015ftirilecek ve en ge\u00e7 29 Haziran 2012 tarihine kadar \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131&#8217;na g\u00f6nderilecek. Tespit, 10 A\u011fustos 2012 tarihine kadar Resmi Gazete&#8217;de yay\u0131mlanacak.<\/p>\n<p style=\"text-align: justify;\">\u0130dareler ile sendikalar aras\u0131nda imzalanan s\u00f6zle\u015fmelerin uygulanmas\u0131na, s\u00f6zle\u015fmelerde \u00f6ng\u00f6r\u00fclen s\u00fcrelerin sonuna kadar devam edilebilecek. S\u00f6zle\u015fmelerin uygulanmas\u0131na devam edilen d\u00f6nem i\u00e7in ayr\u0131ca s\u00f6zle\u015fme yap\u0131lamayacak.
