Kamuya yans\u0131yan tav\u0131rlar\u0131 ve muhalefet \u015ferhleri de hukuk\u00e7u olmad\u0131\u011f\u0131n\u0131 do\u011frular niteliktedir. Kald\u0131 ki ele\u015ftiriler, sadece hukuk\u00e7u olmamas\u0131ndan kaynaklanmamaktad\u0131r.\u00a0<!--more--><\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi Ba\u015fkan\u0131 Ha\u015fim K\u0131l\u0131\u00e7, bu g\u00f6reve se\u00e7ildikten sonra zaman zaman medyada \u00e7\u0131k\u0131\u015flar yaparak kamuya mal olmu\u015f \u00f6nemli ve duyarl\u0131 konularda, adeta son s\u00f6z\u00fc s\u00f6yleyen bir bilge ki\u015fi tavr\u0131 i\u00e7inde, g\u00f6r\u00fc\u015flerini a\u00e7\u0131klamakta, \u00fclkeyi y\u00f6nlendirmeye \u00e7al\u0131\u015fmaktad\u0131r. \u00d6zellikle iktidar partisi ile muhalefet partileri aras\u0131nda tart\u0131\u015fma konusu olan ya\u015famsal hukuki konularda hakem rol\u00fcn\u00fc \u00fcstlenmekte; ancak genelde iktidar partisinin benimsedi\u011fi g\u00f6r\u00fc\u015flerle \u00f6rt\u00fc\u015fen de\u011ferlendirmeler yapmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">\u0130\u015fte, Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n 2011 y\u0131l\u0131 i\u00e7inde yapt\u0131\u011f\u0131, bas\u0131na yans\u0131yan s\u00f6ylem ve de\u011ferlendirmelerinden baz\u0131lar\u0131<\/span>:<\/p>\n<p style=\"text-align: justify;\"><strong>\u00c7\u00f6z\u00fcm beklemek bo\u015funa\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Ha\u015fim K\u0131l\u0131\u00e7, 2011 y\u0131l\u0131 \u015eubat ay\u0131n\u0131n ilk g\u00fcn\u00fc, Anayasa Mahkemesi\u2019ne atanan yeni \u00fcyenin yemin t\u00f6reninde, isimlendirmemekle birlikte Yarg\u0131tay ve Dan\u0131\u015ftay\u2019\u0131 hedef alarak bu kurumlar\u0131 ve mensuplar\u0131n\u0131 \u201c\u00f6nerilen her \u00e7\u00f6z\u00fcm\u00fc \u2018kaos yarat\u0131r\u2019 nitelemesiyle pe\u015finen reddetme al\u0131\u015fkanl\u0131\u011f\u0131nda\u201d olmakla itham etmi\u015f; yarg\u0131 g\u00fcc\u00fcn\u00fc vesayete d\u00f6n\u00fc\u015ft\u00fcrd\u00fcklerini, bunu yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ile me\u015frula\u015ft\u0131rmaya \u00e7al\u0131\u015ft\u0131klar\u0131n\u0131 ve bunun hukuk devletinde yeri olmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p style=\"text-align: justify;\">Bu konu\u015fmay\u0131 yeterli g\u00f6rmemi\u015f, 15 \u015eubat tarihli bir gazeteye verdi\u011fi a\u00e7\u0131klamada ele\u015ftirinin dozunu art\u0131rarak Yarg\u0131tay ve Dan\u0131\u015ftay\u2019\u0131 \u201cbug\u00fcne dek uyumaktan ba\u015fka bir \u015fey\u201d yapmamakla su\u00e7lam\u0131\u015ft\u0131r. Bu y\u00fcksek mahkemelerdeki dosya birikimi sorununun \u00e7\u00f6z\u00fcm\u00fc i\u00e7in de k\u0131sa ve basit bir y\u00f6ntem \u00f6nermi\u015ftir: Anayasa Mahkemesi Ba\u015fkan\u0131\u2019na g\u00f6re Yarg\u0131tay ve Dan\u0131\u015ftay Ba\u015fkanlar\u0131 kendi \u00fcyeleriyle toplan\u0131p bu konuyu aralar\u0131nda tart\u0131\u015fmalar\u0131 halinde sorun \u00e7\u00f6z\u00fclecektir.<\/p>\n<p style=\"text-align: justify;\">Ba\u015fkan, i\u015f yo\u011funlu\u011fu sorununu ve \u00e7\u00f6z\u00fcm\u00fcn\u00fc \u00e7ok basite indirgemi\u015ftir ki, bu da sorunun boyutlar\u0131n\u0131 ve nedenlerini bilmedi\u011fini, bu konuda herhangi bir ara\u015ft\u0131rma yapmad\u0131\u011f\u0131n\u0131 ortaya koymaktad\u0131r. Esasen yarg\u0131yla ancak Anayasa Mahkemesi \u00fcyeli\u011fine se\u00e7ildikten sonra tan\u0131\u015fan bir kimseden yarg\u0131n\u0131n, \u00f6zellikle idari ve adli yarg\u0131n\u0131n sorunlar\u0131yla ilgili ger\u00e7ek\u00e7i bir de\u011ferlendirme, tan\u0131 ve \u00e7\u00f6z\u00fcm \u00f6nerisi beklemek de bo\u015funad\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>Konu\u015fmadan \u00f6nce ara\u015ft\u0131rmal\u0131\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Ba\u015fkan, konu\u015fmas\u0131nda \u201cbug\u00fcne dek\u201d deyimini kullanmakla \u201cuyku\u201d halini \u00e7ok geni\u015f bir zaman aral\u0131\u011f\u0131na yaym\u0131\u015f; bundan \u00f6nceki Yarg\u0131tay ve Dan\u0131\u015ftay Ba\u015fkanlar\u0131n\u0131 da su\u00e7lamalar\u0131n\u0131n kapsam\u0131na alm\u0131\u015ft\u0131r. Yarg\u0131n\u0131n sorunlar\u0131 ve \u00e7\u00f6z\u00fcm \u00f6nerileri her y\u0131l Adli Y\u0131l a\u00e7\u0131l\u0131\u015f\u0131nda ve \u0130dari Yarg\u0131 g\u00fcn\u00fcnde Ba\u015fkanlar\u0131n devlet erk\u00e2n\u0131 \u00f6n\u00fcnde yapt\u0131\u011f\u0131 konu\u015fmalarda a\u00e7\u0131k se\u00e7ik dile getirildi\u011fi gibi, kurum i\u00e7inde geni\u015f bir kat\u0131l\u0131mla haz\u0131rlanan ve yetkili ve ilgili makamlara sunulan rapor ve incelemelerle de ortaya konulmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bir \u00f6rnek vermek gerekirse, tam ba\u011f\u0131ms\u0131z, g\u00fc\u00e7l\u00fc, h\u0131zl\u0131 i\u015fleyen bir yarg\u0131 i\u00e7in Anayasada ve otuza yak\u0131n yasada de\u011fi\u015fiklik yap\u0131lmas\u0131n\u0131 \u00f6ng\u00f6ren Dan\u0131\u015ftay raporu, ayr\u0131nt\u0131l\u0131 gerek\u00e7eleri ile birlikte, gere\u011fi i\u00e7in 2 Ekim 2003 tarihinde, Dan\u0131\u015ftay Genel Sekreteri taraf\u0131ndan ilgili Devlet Bakan\u0131 eli ile Ba\u015fbakanl\u0131\u011fa sunulmu\u015ftur. Bilgi i\u00e7in TBMM Ba\u015fkanl\u0131\u011f\u0131 ba\u015fta olmak \u00fczere, y\u00fcksek mahkeme ba\u015fkanl\u0131klar\u0131na, ilgili bakanl\u0131klara ve siyasi partilere g\u00f6nderilmi\u015ftir (3 Mart 2003 g\u00fcnl\u00fc Cumhuriyet, Milliyet, Terc\u00fcman, Sabah, Zaman, Yeni \u015eafak gazeteleri). Bu tarihten \u00f6nce ve sonra da, de\u011fi\u015fik tarihlerde, \u00f6zellikle idari yarg\u0131 ile ilgili yasalarda de\u011fi\u015fiklik \u00f6neren yaz\u0131lar ilgili makamlara sunulmu\u015f; bunlardan baz\u0131lar\u0131 ilgi g\u00f6rm\u00fc\u015f, baz\u0131lar\u0131 s\u00fcmen alt\u0131 edilmi\u015ftir. Say\u0131n K\u0131l\u0131\u00e7, Dan\u0131\u015ftay ve Yarg\u0131tay i\u00e7in a\u011f\u0131r ithamda bulunmadan \u00f6nce kendi kurumunda bir inceleme ve ara\u015ft\u0131rma yapma zahmetine katlanm\u0131\u015f olsayd\u0131 b\u00f6ylesine vahim bir hataya d\u00fc\u015fmeyecekti.<\/p>\n<p style=\"text-align: justify;\"><strong>Ald\u0131\u011f\u0131 kararlar do\u011fruluyor\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Ha\u015fim K\u0131l\u0131\u00e7, 14 Eyl\u00fcl 2011 tarihinde ikinci kez Anayasa Mahkemesi Ba\u015fkanl\u0131\u011f\u0131\u2019na se\u00e7ildi. Se\u00e7im sonras\u0131 yapt\u0131\u011f\u0131 konu\u015fmada, muzaffer bir kumandan edas\u0131 ile bu se\u00e7imin hukuk e\u011fitimi olmamas\u0131n\u0131 ele\u015ftirenlere en b\u00fcy\u00fck cevap oldu\u011funu ileri s\u00fcrd\u00fc. Sonucu \u00f6nceden belli olan bir se\u00e7imle Anayasa Mahkemesi Ba\u015fkanl\u0131\u011f\u0131\u2019na se\u00e7ilmi\u015f olmas\u0131n\u0131n Say\u0131n K\u0131l\u0131\u00e7\u2019a y\u00f6neltilen s\u00f6z konusu iddiaya nas\u0131l cevap te\u015fkil etti\u011fini anlamak m\u00fcmk\u00fcn de\u011fildir. \u00c7\u00fcnk\u00fc kendisinin hukuk e\u011fitimi olmad\u0131\u011f\u0131 yal\u0131n bir ger\u00e7ektir ve kamuya yans\u0131yan s\u00f6z ve tav\u0131rlar\u0131 ve kararlarda yer alan muhalefet \u015ferhleri de hukuk\u00e7u olmad\u0131\u011f\u0131n\u0131 do\u011frular niteliktedir. Kald\u0131 ki kendisine y\u00f6neltilen ele\u015ftiriler, ileride a\u00e7\u0131klanaca\u011f\u0131 \u00fczere, sadece hukuk\u00e7u olmamas\u0131ndan kaynaklanmamaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>Ayd\u0131nl\u0131k\u2019taki makalenin i\u00e7eri\u011fine yan\u0131t vermedi\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Se\u00e7imden on iki g\u00fcn sonra, 26 Eyl\u00fcl 2011 g\u00fcnl\u00fc Ayd\u0131nl\u0131k Gazetesi\u2019nde, eski CHP Milletvekili \u015eahin Meng\u00fc, Wikileaks belgelerine dayanarak kendisi ile ilgili bir makale yay\u0131mlad\u0131. K\u0131l\u0131\u00e7\u2019\u0131n, 29 Ocak 2010\u2019da ABD B\u00fcy\u00fckel\u00e7isi James F. Jeffrey\u2019yi ziyaret edip kendisine, siyasi partilerin kapat\u0131lmas\u0131, asker ki\u015filerin sivil mahkemelerde yarg\u0131lanmalar\u0131 gibi konularda, Anayasa Mahkemesi\u2019nin verdi\u011fi kararlar hakk\u0131nda bilgi aktard\u0131\u011f\u0131n\u0131, DTP\u2019nin kapat\u0131lmas\u0131 nedenlerini, Anayasan\u0131n de\u011fi\u015ftirilmesi gereklili\u011fini a\u00e7\u0131klad\u0131\u011f\u0131n\u0131 duyurdu. Ayn\u0131 makalede \u201cBu \u015fahs\u0131n \u00f6zel yetenekleri de vard\u0131r. \u00c7ocuklar\u0131 avukatl\u0131k staj\u0131 yaparken kimseye haber vermeden yurt d\u0131\u015f\u0131na gitmi\u015f, bu ortaya \u00e7\u0131k\u0131nca Ha\u015fim K\u0131l\u0131\u00e7 o tarihteki Baro Ba\u015fkan\u0131ndan \u00e7ocuklar\u0131n\u0131n stajlar\u0131n\u0131n yak\u0131lmamas\u0131 i\u00e7in ricac\u0131 olmu\u015ftu\u201d bilgisine de yer verdi.<\/p>\n<p style=\"text-align: justify;\">\u0130ki g\u00fcn sonra 28 Eyl\u00fcl g\u00fcnl\u00fc Milliyet Gazetesi\u2019nde, Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n Fikret Bila\u2019ya yapt\u0131\u011f\u0131 a\u00e7\u0131klama yay\u0131mland\u0131. Anayasa Mahkemesi Ba\u015fkan\u0131 olarak bir b\u00fcy\u00fckel\u00e7iye ya da herhangi birine bilgi sunmak, rapor vermek, arz etmek gibi kavramlarla ifade edilebilecek bir konumunun ve \u00fcslubunun olamayaca\u011f\u0131n\u0131, bunu onursuzluk sayd\u0131\u011f\u0131n\u0131 sert ve kesin bir dille a\u00e7\u0131klayan K\u0131l\u0131\u00e7, AKP\u2019nin kapat\u0131lmas\u0131 davas\u0131 ile ilgili bilgi verdi\u011fi iddialar\u0131n\u0131, \u201cTamamen as\u0131ls\u0131z bir iddiad\u0131r. Ben b\u00fcy\u00fckel\u00e7iyi ziyaret etti\u011fimde kapatma davas\u0131 neticelenmi\u015fti. Bu nedenle konu da olmad\u0131. Elbette bu ziyaret s\u0131ras\u0131nda, \u00fclke meseleleri ve d\u00fcnya meseleleri konusunda sohbet gere\u011fi olarak konu\u015fmalar yap\u0131lm\u0131\u015ft\u0131r\u201d ifadeleri ile yan\u0131tlad\u0131. \u015eahin Meng\u00fc\u2019n\u00fcn yaz\u0131s\u0131nda AKP\u2019nin kapat\u0131lmas\u0131ndan de\u011fil, genel olarak \u201csiyasi partilerin kapat\u0131lmas\u0131\u201d konusundan s\u00f6z edildi\u011fi halde K\u0131l\u0131\u00e7\u2019\u0131n neden AKP \u00fczerinden yan\u0131t verdi\u011fi anla\u015f\u0131lamad\u0131. K\u0131l\u0131\u00e7, konu\u015fuldu\u011fu ileri s\u00fcr\u00fclen di\u011fer konulara ve makalede yer alan somut iddiaya ise yan\u0131t vermedi.<\/p>\n<p style=\"text-align: justify;\"><strong>Dan\u0131\u015ftay\u2019la ilgili uygulamalar\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">25 Ekim 2011 tarihinde HSYK taraf\u0131ndan d\u00fczenlenen sempozyumda konu\u015fan Ha\u015fim K\u0131l\u0131\u00e7, \u201c2010 y\u0131l\u0131nda yap\u0131lan Anayasa de\u011fi\u015fiklikleri ile y\u0131llard\u0131r olu\u015fan askeri ve yarg\u0131sal vesayetin varl\u0131\u011f\u0131na son verilmesini, T\u00fcrk demokrasisi ad\u0131na \u00f6nemli bir ilerleme olarak\u201d g\u00f6rd\u00fc\u011f\u00fcn\u00fc s\u00f6yledi. Referandumda de\u011fi\u015ftirilen Anayasan\u0131n yarg\u0131 ile ilgili kurallar\u0131 yeterince tart\u0131\u015f\u0131ld\u0131; bunlara yeniden d\u00f6nmek istemiyorum.<\/p>\n<p style=\"text-align: justify;\">Referandumdan sonra olu\u015fturulan HSYK\u2019n\u0131n yapt\u0131\u011f\u0131 uygulamalar, Anayasa de\u011fi\u015fikli\u011fi paketinin tek amac\u0131n\u0131n \u201cYarg\u0131y\u0131 AKP paralelinde siyasalla\u015ft\u0131rarak ele ge\u00e7irmek, ba\u011f\u0131ms\u0131z yarg\u0131y\u0131 yok etmek\u201d oldu\u011funu \u0131srarla savunanlar\u0131 hakl\u0131 \u00e7\u0131kard\u0131. HSYK\u2019n\u0131n, bilinen g\u00fcncel davalarda g\u00f6revli h\u00e2kim ve savc\u0131lar i\u00e7in ald\u0131\u011f\u0131 kararlar kamuoyunda yakinen izleniyor ve tart\u0131\u015f\u0131l\u0131yor.<\/p>\n<p style=\"text-align: justify;\">Ben sadece Dan\u0131\u015ftay\u2019la ilgili uygulamalar\u0131n bir k\u0131sm\u0131n\u0131 temel alarak ve Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n bunlar\u0131 g\u00f6zden ka\u00e7\u0131rm\u0131\u015f olabilece\u011fini d\u00fc\u015f\u00fcnerek kendisine baz\u0131 sorular y\u00f6neltece\u011fim. Asl\u0131nda bu sorular\u0131n ger\u00e7ek muhatab\u0131 ayn\u0131 sempozyumda \u201cYeni yap\u0131n\u0131n (HSYK) adil, tarafs\u0131z ve etkin bir yarg\u0131lama i\u00e7in at\u0131lan bir ad\u0131m\u201d oldu\u011funu s\u00f6yleyen Adalet Bakan\u0131 Sadullah Ergin olmal\u0131yd\u0131. Ne var ki Anayasa Mahkemesi\u2019nin ve HSYK\u2019n\u0131n yeni yap\u0131s\u0131n\u0131 Bakan\u2019dan daha hararetli bir \u015fekilde savunan ve uzun s\u00fcreden beri Anayasa Mahkemesi\u2019nde uygulaman\u0131n i\u00e7inde olan Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n durumu daha iyi de\u011ferlendirebilece\u011fini ve g\u00f6r\u00fc\u015f\u00fcn\u00fcn gerek\u00e7elerini a\u00e7\u0131klama f\u0131rsat\u0131 yarataca\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnerek sorular\u0131m\u0131 kendisine y\u00f6neltiyorum:<\/p>\n<p style=\"text-align: justify;\"><strong>Ha\u015fim K\u0131l\u0131\u00e7\u2019a sorular\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>1.<\/strong> \u0130lgili kurulu\u015f olarak Dan\u0131\u015ftay\u2019dan hi\u00e7bir talep gelmedi\u011fi halde iki yeni daire kuruldu; Kurumun kadrolar\u0131na 61 \u00fcye ve ba\u015fkan kadrosu eklendi. Bu kadrolar\u0131n yakla\u015f\u0131k d\u00f6rtte \u00fc\u00e7\u00fcne HSYK, d\u00f6rtte birine Cumhurba\u015fkan\u0131 taraf\u0131ndan atamalar yap\u0131ld\u0131. Yeni kurulan dairelere ve atanan \u00fcyelere uzun s\u00fcre yer bulunamad\u0131. \u0130htiya\u00e7, talep ve \u00f6n haz\u0131rl\u0131k olmadan Dan\u0131\u015ftay\u2019a bu kadrolar ni\u00e7in verildi?<\/p>\n<p style=\"text-align: justify;\"><strong>2.<\/strong> HSYK taraf\u0131ndan \u00fcye kadrolar\u0131na yap\u0131lan se\u00e7imlerde k\u0131dem ve ehliyet unsurlar\u0131 g\u00f6zard\u0131 edildi. \u0130dari yarg\u0131da daha k\u0131demli, ehil ve kimisi doktoras\u0131n\u0131 yapm\u0131\u015f yeterli say\u0131da h\u00e2kim ve savc\u0131 mevcut iken bunlar atlanarak genellikle \u00e7ok gen\u00e7 ya\u015fta olanlar\u0131n se\u00e7ilmelerinde \u00f6zel bir ama\u00e7 m\u0131 izlendi?<\/p>\n<p style=\"text-align: justify;\"><strong>3.<\/strong> Bu atamalar yap\u0131ld\u0131ktan sonra Dan\u0131\u015ftay\u2019da bir blok olu\u015ftu ve se\u00e7imlerde, sonu\u00e7lar\u0131 do\u011frudan etkileyecek \u015fekilde, belli say\u0131da Dan\u0131\u015ftay meslek mensubu ayn\u0131 y\u00f6nde oy kullanmaya ba\u015flad\u0131. Bunu do\u011frulayan \u00e7ok say\u0131da \u00f6rnek, bu \u00f6rneklerin \u00e7o\u011funun trajikomik \u00f6yk\u00fcs\u00fc ve ilgin\u00e7 perde arkas\u0131 sahneleri var. Ayr\u0131nt\u0131ya girmek istemiyorum. Siz muhtemelen bunlar\u0131n \u00e7o\u011funu biliyorsunuz; bilmiyorsan\u0131z ara\u015ft\u0131r\u0131rsan\u0131z en \u00e7arp\u0131c\u0131lar\u0131n\u0131 bulursunuz. De\u011fi\u015fikli\u011fi nas\u0131l yorumluyorsunuz?<\/p>\n<p style=\"text-align: justify;\">B\u00fct\u00fcn bu yasal de\u011fi\u015fiklikler ve uygulamalarla sizin deyiminizle, yarg\u0131sal vesayetin (?) varl\u0131\u011f\u0131na son verilmek istenirken bir yanl\u0131\u015fl\u0131k oldu da yarg\u0131 y\u00fcr\u00fctmenin vesayeti alt\u0131na m\u0131 sokuldu? Yoksa ileri demokrasilerde yarg\u0131n\u0131n yap\u0131s\u0131 b\u00f6yle mi olu\u015fturuluyor?<!--nextpage--><\/p>\n<p style=\"text-align: justify;\"><strong>Say\u0131\u015ftay \u00fcyeli\u011fine 21 ki\u015filik \u00f6zel listeden girdi\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Say\u0131\u015ftay\u2019\u0131n 1985 se\u00e7imlerinde ge\u00e7ici bir kanun maddesi \u00e7\u0131kar\u0131ld\u0131. Yirmi bir \u00fcyenin se\u00e7imi, iktidar yanl\u0131s\u0131 bir kimlik ta\u015f\u0131yan Plan ve B\u00fct\u00e7e Komisyonu\u2019na verildi. B\u00f6ylece Ha\u015fim K\u0131l\u0131\u00e7, mesleki k\u0131dem esas\u0131 g\u00f6z ard\u0131 edilerek 35 ya\u015f\u0131nda Say\u0131\u015ftay \u00fcyeli\u011fine getirildi.<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi, Anayasa\u2019da yer alan y\u00fcksek mahkemelerden biridir ve \u00e7ok \u00f6nemli g\u00f6revlerle donat\u0131lm\u0131\u015ft\u0131r: Asli g\u00f6revi kanunlar\u0131n, kanun h\u00fckm\u00fcnde kararnamelerin, TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn ve Anayasa de\u011fi\u015fikliklerinin Anayasa\u2019ya uygunlu\u011funu denetlemektir. Anayasa, bu g\u00f6revinin yan\u0131nda Y\u00fcksek Mahkeme\u2019ye en az bunun kadar \u00f6nemli ba\u015fka g\u00f6revler de vermi\u015ftir. Bireysel ba\u015fvurular\u0131 karara ba\u011flamak, baz\u0131 kamu g\u00f6revlilerini g\u00f6revleriyle ilgili su\u00e7lardan dolay\u0131 Y\u00fcce Divan s\u0131fat\u0131yla yarg\u0131lamak, siyasi partilerin kapat\u0131lmas\u0131 hakk\u0131ndaki davalara bakmak, siyasi partilerin mali denetimini yapmak, milletvekillerinin yasama dokunulmazl\u0131klar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na ve milletvekilli\u011finin d\u00fc\u015fmesine ili\u015fkin TBMM kararlar\u0131na yap\u0131lan itirazlar\u0131 incelemek bu g\u00f6revler aras\u0131ndad\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>Anayasa Mahkemesi\u2019nin \u00f6nemi\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi\u2019nin g\u00f6revlerinin kapsam ve niteli\u011fi, ba\u015flang\u0131\u00e7 b\u00f6l\u00fcm\u00fcnde \u201cdemokrasiye a\u015f\u0131k T\u00fcrk evlatlar\u0131n\u0131n vatan ve millet sevgisine emanet ve tevdi\u2019\u2019 olunan Anayasa\u2019n\u0131n, eylemli ve etkili bir \u015fekilde korunmas\u0131 ve do\u011fru olarak uygulanmas\u0131 g\u00f6revinin Anayasa Mahkemesi\u2019ne verildi\u011fini g\u00f6stermektedir.<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi\u2019nin g\u00f6rev ve yetki alan\u0131 bir anlamda TBMM\u2019nin g\u00f6rev ve yetkileri ile paralellik g\u00f6sterir. Verdi\u011fi her karar, do\u011frudan ve dolayl\u0131 olarak, az veya \u00e7ok \u00f6l\u00e7\u00fcde toplumu ve onun y\u00f6n\u00fcn\u00fc etkiler. Bir kanunun iptal edilmesi onun uygulanmamas\u0131, o kanunla getirilen hak ve y\u00fck\u00fcml\u00fcl\u00fcklerin kald\u0131r\u0131lmas\u0131 sonucunu do\u011furur. Yetkililer taraf\u0131ndan a\u00e7\u0131lan iptal davas\u0131n\u0131n reddedilmesi ise o kanunun uygulanmas\u0131 i\u00e7in bir izin niteli\u011findedir. Bu noktada Anayasa Mahkemesi, hemen hemen yasama meclisinin rol\u00fcn\u00fc \u00fcstlenmi\u015f olmaktad\u0131r. Bir siyasi partinin kapat\u0131lmas\u0131, \u00fcyelerinin belli s\u00fcreyle siyaset yapmalar\u0131n\u0131n yasaklanmas\u0131 \u00fclkenin siyasal tablosunu ve d\u00fczenini de\u011fi\u015ftirir, y\u00f6netimine yans\u0131r ve gelece\u011fe d\u00f6n\u00fck etkiler yarat\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>Yarg\u0131\u00e7lar\u0131n nitelikleri\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00dcstlendikleri g\u00f6revin niteli\u011fi, verdikleri kararlar\u0131n \u00fclke i\u00e7indeki etkileri bu Y\u00fcksek Mahkeme\u2019nin yarg\u0131\u00e7lar\u0131n\u0131n ya\u015f, \u00f6\u011frenim durumu, hizmet s\u00fcresi, belli meslek sahibi olmak gibi Anayasa\u2019da g\u00f6sterilen objektif niteliklere sahip olmalar\u0131n\u0131 gerektirir. Bunun yan\u0131nda Anayasa\u2019da \u00f6ng\u00f6r\u00fclen temel ilkelerle bar\u0131\u015f\u0131k; bu ilkelerle ba\u011fda\u015fmayan ideolojilerden uzak; gerekti\u011finde toplumun isteklerini de g\u00f6zetip, kurallar\u0131n\u0131 \u00e7a\u011fa uygun yorumlarla Anayasa\u2019y\u0131 canl\u0131, ya\u015fayan ve dinamik bir i\u00e7eri\u011fe kavu\u015fturabilecek d\u00fczeyde e\u011fitim ve bilgiye sahip olmal\u0131d\u0131rlar. Bu da etkili g\u00fc\u00e7 odaklar\u0131na, kendi d\u00fc\u015f\u00fcnce ve duygular\u0131na kar\u015f\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 koruyarak hukuk kurallar\u0131 i\u00e7inde karar verebilen bir ki\u015filik yap\u0131s\u0131na sahip olmalar\u0131n\u0131 gerektirir. Bu nedenlerle gerek \u00fcyelerin gerekse ba\u015fkan\u0131n se\u00e7iminde yetkili kurullar ve Cumhurba\u015fkan\u0131, \u00e7ok duyarl\u0131 ve se\u00e7ici davranmak zorundad\u0131rlar. Dostluk, arkada\u015fl\u0131k, hem\u015fehrilik, ayn\u0131 siyasi, ideolojik g\u00f6r\u00fc\u015flere veya ayn\u0131 dernek, kurulu\u015f ve topluluklara mensubiyet gibi hizmet d\u0131\u015f\u0131 \u00f6zellikler g\u00f6zetilerek yap\u0131lacak se\u00e7imler mahkemenin yap\u0131s\u0131n\u0131 bozar, mahkemeye tevdi edilen g\u00f6revin istenilen bi\u00e7imde yerine getirilmesine engel olur ve etkilerini y\u0131llarca s\u00fcrd\u00fcr\u00fcr.<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi \u00fcyelerinin se\u00e7ilmelerinde g\u00f6sterilmesi gereken bu duyarl\u0131l\u0131k, g\u00f6revlerinin ifas\u0131 s\u0131ras\u0131nda da say\u0131n \u00fcyeler ve ba\u015fkan taraf\u0131ndan ayn\u0131 titizlikle korunmal\u0131 ve s\u00fcrd\u00fcr\u00fclmelidir. Kendileri, \u00f6zellikle tarafs\u0131zl\u0131klar\u0131n\u0131 g\u00f6lgeleyecek eylem ve s\u00f6ylemlerden ka\u00e7\u0131nmal\u0131d\u0131rlar.<\/p>\n<p style=\"text-align: justify;\"><strong>Say\u0131\u015ftay\u2019a 1985 operasyonu<\/strong><\/p>\n<p style=\"text-align: justify;\">Halen bu y\u00fcce kurulu\u015fun ba\u015fkan\u0131 olan Ha\u015fim K\u0131l\u0131\u00e7, \u00fcyeli\u011fe se\u00e7ildi\u011fi g\u00fcnden itibaren s\u0131k s\u0131k medyan\u0131n ilgi oda\u011f\u0131 olmu\u015f; \u00f6zellikle Anayasa Mahkemesi \u00fcyeli\u011fine se\u00e7ilme s\u00fcreci de\u011fi\u015fik y\u00f6nleri ile ele\u015ftirilmi\u015ftir. Say\u0131n ba\u015fkan\u0131n, Anayasa Mahkemesi Ba\u015fkanl\u0131\u011f\u0131\u2019na kadar y\u00fckselme s\u00fcreci ger\u00e7ekten ilgin\u00e7tir; bu s\u00fcre\u00e7 1985 senesinde ba\u015flam\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">12 Mart 1985 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 3162 say\u0131l\u0131 kanunun ge\u00e7ici 3\u2019\u00fcnc\u00fc maddesi, Say\u0131\u015ftay \u00fcyelerinin se\u00e7iminde yeni bir y\u00f6ntem getirdi. O tarihe kadar Say\u0131\u015ftay \u00fcyelerinin se\u00e7imi, 832 Say\u0131l\u0131 Say\u0131\u015ftay Kanunu h\u00fck\u00fcmlerine g\u00f6re Say\u0131\u015ftay Genel Kurulu\u2019nun g\u00f6sterdi\u011fi adaylar aras\u0131ndan TBMM Plan ve B\u00fct\u00e7e Komisyonu taraf\u0131ndan yap\u0131l\u0131yor ve TBMM Genel Kurulu\u2019nun onay\u0131na sunuluyordu. 3162 say\u0131l\u0131 kanun, Say\u0131\u015ftay Kanunu\u2019nun \u00fcyelerin se\u00e7imini d\u00fczenleyen as\u0131l maddelerinde herhangi bir de\u011fi\u015fiklik yapmadan, ge\u00e7ici 3\u2019\u00fcnc\u00fc maddesinde \u00fcye se\u00e7imlerinin bir defaya mahsus olmak \u00fczere TBMM Plan ve B\u00fct\u00e7e Komisyonu\u2019nca do\u011frudan yap\u0131lmas\u0131 kural\u0131n\u0131 koydu. B\u00f6ylece \u00fcye adaylar\u0131n\u0131n tespitinde Say\u0131\u015ftay Genel Kurulu devreden \u00e7\u0131kar\u0131ld\u0131 ve se\u00e7im, b\u00fct\u00fcn a\u015famalar\u0131 ile Anayasa\u2019ya g\u00f6re 40 \u00fcyesinden en az 25 \u00fcyesi iktidar partisi veya partilerine tahsis edilen, bu yap\u0131s\u0131 ile iktidar yanl\u0131s\u0131 bir kimlik ta\u015f\u0131yan Plan ve B\u00fct\u00e7e Komisyonu\u2019na verilmi\u015f oldu.<!--nextpage--><\/p>\n<p style=\"text-align: justify;\"><strong>Hukukun yok say\u0131ld\u0131\u011f\u0131 21 y\u0131ll\u0131k bir s\u00fcre\u00e7: \u00d6zal, Anayasa Mahkemesi \u00fcyeli\u011fine kimi se\u00e7mesi gerekti\u011fini biliyordu\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Ha\u015fim K\u0131l\u0131\u00e7, 1985\u2019te Say\u0131\u015ftay \u00fcyeli\u011fine getirilmi\u015ftir. Anayasa\u2019n\u0131n o tarihte y\u00fcr\u00fcrl\u00fckte olan 146. maddesine g\u00f6re Cumhurba\u015fkan\u0131, Anayasa Mahkemesi\u2019nin as\u0131l \u00fcyelerinden birini, Say\u0131\u015ftay Genel Kurulu\u2019nun kendi ba\u015fkan ve \u00fcyeleri aras\u0131ndan, \u00fcye tam say\u0131s\u0131n\u0131n salt \u00e7o\u011funlu\u011fu ile g\u00f6sterece\u011fi 3 aday aras\u0131ndan se\u00e7iyordu.<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi Ba\u015fkanl\u0131\u011f\u0131\u2019n\u0131n, 2 Temmuz 1990 g\u00fcnl\u00fc ve 717 say\u0131l\u0131 yaz\u0131 ile Anayasa Mahkemesi\u2019nde Say\u0131\u015ftay\u2019a ayr\u0131lan \u00fcyeli\u011fin bo\u015fald\u0131\u011f\u0131n\u0131 bildirmesi \u00fczerine, Say\u0131\u015ftay Genel Kurulu 3 aday\u0131 belirlemek \u00fczere ilk kez 12 Temmuz 1990 tarihinde toplanm\u0131\u015ft\u0131r. O tarihten itibaren 6 Kas\u0131m 1990 tarihine kadar 19 oturumda 136 oylama yap\u0131lmas\u0131na kar\u015f\u0131n Anayasa\u2019da \u00f6ng\u00f6r\u00fclen \u00e7o\u011funluk sa\u011flanamad\u0131\u011f\u0131 i\u00e7in adaylar belirlenememi\u015ftir. Adayl\u0131k i\u00e7in oy verilenler aras\u0131nda Ha\u015fim K\u0131l\u0131\u00e7 da bulunmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130mdada yeti\u015fen kanun\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Tam bu s\u0131rada 3 Kas\u0131m 1990 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 3677 say\u0131l\u0131 kanun imdada yeti\u015fmi\u015f; ilk 3 maddesi ile Say\u0131\u015ftay Ba\u015fkan\u0131 ve \u00fcyelerinin niteliklerini, bunlar\u0131n se\u00e7iminde TBMM Plan ve B\u00fct\u00e7e Komisyonu i\u00e7in Say\u0131\u015ftay Kanunu\u2019nda \u00f6ng\u00f6r\u00fclen toplanma ve buna ba\u011fl\u0131 olarak karar yeter say\u0131lar\u0131n\u0131 de\u011fi\u015ftirmi\u015ftir. Eski d\u00fczenlemeye g\u00f6re en az 27 \u00fcye ile toplanabilen ve 14 \u00fcye ile karar alabilen komisyon, 14 \u00fcye ile toplan\u0131p 8 \u00fcye ile karar verebilen bir yap\u0131ya d\u00f6n\u00fc\u015ft\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p style=\"text-align: justify;\">B\u00f6ylece komisyon, muhalefet partilerine mensup \u00fcyelerinin kat\u0131lmas\u0131na ihtiya\u00e7 kalmadan, sadece iktidar partisine mensup \u00fcyeleri ile toplanarak karar alabilecektir. Kanun, bununla yetinmemi\u015f, ge\u00e7ici 1. maddesinde de 3162 say\u0131l\u0131 kanunun ge\u00e7ici 3. maddesine \u00f6zde\u015f bir d\u00fczenleme ile komisyona yeniden, do\u011frudan Say\u0131\u015ftay \u00fcyelerini se\u00e7me yetkisi tan\u0131m\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">3677 say\u0131l\u0131 kanunla ilgili teklif, Anavatan Partisi Milletvekili ve Plan ve B\u00fct\u00e7e Komisyonu Ba\u015fkan\u0131 Yusuf Bozkurt \u00d6zal taraf\u0131ndan verilmi\u015f; komisyonda 177 tanesi \u00f6ncelikle ve ivedilikle g\u00f6r\u00fc\u015f\u00fclmesi gereken kanun h\u00fckm\u00fcnde kararname olmak \u00fczere toplam 323 konu var iken bu teklif ilk s\u0131raya al\u0131nm\u0131\u015ft\u0131r (Tutanak Dergisi, 1990 cilt 50, S. say\u0131s\u0131 451).<\/p>\n<p style=\"text-align: justify;\"><strong>Adaylar i\u00e7in \u00f6zel toplant\u0131\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Komisyona muhalefet partilerinden kat\u0131lan 9 \u00fcye teklif i\u00e7in olumsuz oy kullanm\u0131\u015flard\u0131r. Bu \u00fcyelerin muhalefet \u015ferhlerinde ve TBMM Genel Kurulu\u2019ndaki g\u00f6r\u00fc\u015fmelerde, komisyonun toplant\u0131 ve karar yeter say\u0131lar\u0131n\u0131n de\u011fi\u015ftirilmesi ve Say\u0131\u015ftay Kanunu\u2019nun 19. maddesi gere\u011fince Say\u0131\u015ftay Genel Kurulu\u2019nun g\u00f6r\u00fc\u015f\u00fcn\u00fcn al\u0131nmamas\u0131 ele\u015ftirilmi\u015ftir. Teklifin amac\u0131n\u0131n Say\u0131\u015ftay\u2019\u0131 iktidar partisinin kontrol\u00fcne vermek ve bo\u015f bulunan Anayasa Mahkemesi \u00fcyeli\u011fi i\u00e7in iktidar yanl\u0131s\u0131 ve Cumhurba\u015fkan\u0131\u2019na \u201cHay\u0131r\u201d diyemeyecek adaylar se\u00e7mek oldu\u011fu ifade edilmi\u015ftir. Ana muhalefet partisi, Anayasa Mahkemesi\u2019nde dava a\u00e7aca\u011f\u0131n\u0131 da beyan etmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Teklifin kanunla\u015fmas\u0131ndan sonra Plan ve B\u00fct\u00e7e Komisyonu, Say\u0131\u015ftay\u2019da bo\u015f bulunan kadrolara, aralar\u0131nda eski Say\u0131\u015ftay Ba\u015fkan\u0131 Mehmet Damar\u2019\u0131n da bulundu\u011fu 9 \u00fcye se\u00e7mi\u015ftir. Muhalif kalan \u00fcyeler, kar\u015f\u0131 oy yaz\u0131lar\u0131nda, adaylar\u0131n sicil dosyalar\u0131n\u0131n komisyon \u00fcyelerinin incelemesine sunulmad\u0131\u011f\u0131n\u0131 ve komisyonun ANAP\u2019l\u0131 \u00fcyelerinin resmi toplant\u0131 \u00f6ncesinde \u00f6zel bir toplant\u0131 yaparak adaylar\u0131 belirlediklerini ifade etmi\u015flerdir. Muhalif \u00fcyeler, 3677 say\u0131l\u0131 kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren ge\u00e7ici 1. maddesi gere\u011fince 15 g\u00fcn i\u00e7inde Say\u0131\u015ftay Genel Kurulu\u2019nun toplant\u0131ya \u00e7a\u011fr\u0131lmas\u0131 gerekirken bunun yap\u0131lmad\u0131\u011f\u0131n\u0131 belirtmi\u015flerdir. O tarihte \u0130stanbul Barosu Ba\u015fkan\u0131 olan Turgut Kazan, Say\u0131\u015ftay Kanunu\u2019nun baz\u0131 maddelerini de\u011fi\u015ftiren 3677 say\u0131l\u0131 kanunun Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011funu, bu kurallara dayan\u0131larak tarikat mensubu bir Say\u0131\u015ftay \u00fcyesinin Anayasa Mahkemesi \u00fcyeli\u011fine se\u00e7ilece\u011fini, ismini de belirterek baz\u0131 gazetelere ve k\u00f6\u015fe yazarlar\u0131na duyuruyor. Bunun \u00fczerine bas\u0131n konu ile ilgileniyor, gazetelerin bir k\u0131sm\u0131 habere birinci sayfada ve man\u015fette yer veriyor, baz\u0131 yazarlar da konuyu k\u00f6\u015felerine ta\u015f\u0131yor (Milliyet 27, 28, 30 Kas\u0131m, 1, 2 Aral\u0131k 1990; Sabah 25, 30 Kas\u0131m 1990; H\u00fcrriyet 24, 27, 28, 29 Kas\u0131m, 1 Aral\u0131k 1990).<\/p>\n<p style=\"text-align: justify;\">Ha\u015fim K\u0131l\u0131\u00e7, hakk\u0131ndaki \u201cNak\u015fibendi\u201d tarikat\u0131 mensubu oldu\u011fu iddias\u0131n\u0131 \u00e7ok basit buldu\u011funu bildirip \u201cBu g\u00f6revin ehemmiyeti ve \u00fclkenin i\u00e7inde bulundu\u011fu \u015fartlar nedeniyle bu iddialar kar\u015f\u0131s\u0131nda cevap vermemekten \u00f6t\u00fcr\u00fc beni ho\u015f kar\u015f\u0131lay\u0131n\u2019\u2019 diyor. Ulusal Bas\u0131n Ajans\u0131 haberine g\u00f6re tarikat\u00e7\u0131 oldu\u011fu iddialar\u0131n\u0131n ger\u00e7e\u011fi yans\u0131tmad\u0131\u011f\u0131n\u0131 ifade eden K\u0131l\u0131\u00e7, \u201cLaik bir d\u00fcnya g\u00f6r\u00fc\u015f\u00fcn\u00fc benimsedi\u011finizi s\u00f6yleyebilir misiniz?\u201d sorusunu, \u201cPolemi\u011fe girmek istemiyorum. \u00c7\u00fcnk\u00fc bunun arkas\u0131 gelir\u201d diye yan\u0131tl\u0131yor. T\u00fcrkiye Barolar Birli\u011fi (TBB) Ba\u015fkan\u0131, yan\u0131nda Ankara ve \u0130stanbul baro ba\u015fkanlar\u0131 oldu\u011fu halde, Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n Anayasa Mahkemesi\u2019nde yemin t\u00f6reninin yap\u0131ld\u0131\u011f\u0131 g\u00fcn (7 Aral\u0131k 1990) ve saatte (10.00) bir bas\u0131n toplant\u0131s\u0131 d\u00fczenliyor. Anayasa Mahkemesi\u2019nin 3677 say\u0131l\u0131 kanunu iptal etmesi halinde, herhangi bir i\u015fleme gerek kalmadan hem Say\u0131\u015ftay\u2019a \u00fcye olarak se\u00e7ilen 9 ki\u015finin, hem de Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n \u00fcyeliklerinin, herhangi bir i\u015fleme gerek kalmadan d\u00fc\u015fece\u011fini savunuyor.<\/p>\n<p style=\"text-align: justify;\">Ben bu haberleri ilk kez okudu\u011fumda bir yanl\u0131\u015fl\u0131k olabilece\u011fini d\u00fc\u015f\u00fcnerek gazeteleri belli bir tarihe kadar tarad\u0131m; Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n bu haberlere ili\u015fkin bir a\u00e7\u0131klamas\u0131n\u0131 veya d\u00fczeltmesini bulamad\u0131m. K\u00fcnyede Ha\u015fim K\u0131l\u0131\u00e7 diye ge\u00e7se de asla ilgim yoktur. Baran diye bir dergiyi g\u00f6rmedim, bilmiyorum. O dedi\u011finiz ki\u015fiyi tan\u0131mam. \u00d6yle ki\u015filerle bir alakam yoktur. \u0130smimi nas\u0131l yazarlarm\u0131\u015f, aray\u0131p tahkik edece\u011fim. Ben, o tarihlerde Say\u0131\u015ftay\u2019da g\u00f6revli devlet memuruydum. M\u00fcstafi addedilmem gerekir. Benim olmam m\u00fcmk\u00fcn de\u011fildir\u201d diyor ve iddiay\u0131 t\u00fcm\u00fcyle reddediyor. B\u00f6ylece, 17 sene gecikmeli de olsa H\u00fcrriyet Gazetesi\u2019nde \u00e7\u0131kan haberi de yalanlam\u0131\u015f oluyor.<\/p>\n<p style=\"text-align: justify;\">AYDINLIK Dergisi\u2019nin sordu\u011fu sorulardan birine, ben de k\u0131smen cevap verebilirim. G\u00d6LGE Dergisi\u2019nin mevcut 9 say\u0131s\u0131nda Ha\u015fim K\u0131l\u0131\u00e7 imzas\u0131 ile yay\u0131mlanm\u0131\u015f bir yaz\u0131 yoktur.<\/p>\n<p style=\"text-align: justify;\"><strong>\u2018\u00d6zal bu ekipte\u2019\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n telefonla verdi\u011fi yan\u0131ta kar\u015f\u0131n AYDINLIK Dergisi, Salih Mirzabeyo\u011flu\u2019nun \u201cTilki G\u00fcnl\u00fc\u011f\u00fc\u201d isimli 6 ciltlik kitab\u0131nda, cilt ve sayfa say\u0131lar\u0131n\u0131 da belirterek, bir\u00e7ok kez Ha\u015fim K\u0131l\u0131\u00e7\u2019tan s\u00f6z edildi\u011fini yaz\u0131yor. AYDINLIK Dergisi\u2019ne g\u00f6re Ha\u015fim K\u0131l\u0131\u00e7, ba\u015f\u0131ndan itibaren Mirzabeyo\u011flu ile beraber. Ancak derginin 4. say\u0131s\u0131nda Ankara temsilcisi, ismi de zikredilerek \u201cHa\u015fim K\u0131l\u0131\u00e7\u201d olarak g\u00f6sterilmi\u015f. Bu Ha\u015fim K\u0131l\u0131\u00e7 kim?<\/p>\n<p style=\"text-align: justify;\"><strong>Say\u0131\u015ftay\u2019daki arkada\u015f&#8230;\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">2. Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n s\u00f6zl\u00fc ve yaz\u0131l\u0131 a\u00e7\u0131klamalar\u0131nda s\u00f6yledi\u011fi gibi kendisinin G\u00d6LGE Dergisi ile veya \u00f6yle ki\u015filerle, gruplarla uzaktan yak\u0131ndan bir ilgisi yoksa, bu derginin yay\u0131n kurulunda olan ve dergide a\u00e7\u0131k ismiyle yaz\u0131lar yazan Salih Mirzabeyo\u011flu ile de ilgisi yok demektir.<\/p>\n<p style=\"text-align: justify;\">a) Ayn\u0131 derginin Eski\u015fehir temsilcisi Av. Harun Y\u00fcksel, \u0131srarla K\u0131l\u0131\u00e7 ve Mirzabeyo\u011flu\u2019nun tan\u0131\u015ft\u0131klar\u0131n\u0131, dost ve yolda\u015f olduklar\u0131n\u0131 s\u00f6yl\u00fcyor.<\/p>\n<p style=\"text-align: justify;\">b) \u0130BDA-C lideri Salih Mirzabeyo\u011flu\u2019nun T\u0130LK\u0130 G\u00dcNL\u00dc\u011e\u00dc adl\u0131 6 ciltlik kitab\u0131n\u0131n UFUK \u0130LE HAF\u0130YE alt ba\u015fl\u0131kl\u0131 3. cildinde yazar, Ha\u015fim K\u0131l\u0131\u00e7\u2019tan \u201cSay\u0131\u015ftay\u201d m\u00fcfetti\u015fi olarak s\u00f6z ediyor (s. 54); bir ba\u015fka sayfada (s. 563) \u201cHa\u015fim K\u0131l\u0131\u00e7\u2019\u0131n Say\u0131\u015ftay\u2019daki arkada\u015f\u0131 Ahmet Ar\u0131ca, vefat etti &#8230;\u201d ibaresi var. Say\u0131\u015ftay\u2019da m\u00fcfetti\u015flik kadrosu yok. Ha\u015fim K\u0131l\u0131\u00e7 o tarihte Say\u0131\u015ftay denet\u00e7isi. Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n arkada\u015f\u0131 olarak tan\u0131t\u0131lan Ahmet Ar\u0131ca ise ger\u00e7ekten Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n arkada\u015f\u0131 ve kendisi ile birlikte Say\u0131\u015ftay \u00fcyeli\u011fine se\u00e7ilen 21 ki\u015fiden biri (14 Kas\u0131m 1985 g\u00fcnl\u00fc, 18928 say\u0131l\u0131 Resmi Gazete); \u00fcye se\u00e7ildikten sonra da vefat ediyor. G\u00fcnl\u00fcklerin yaz\u0131ld\u0131\u011f\u0131 tarihte Say\u0131\u015ftay\u2019da ba\u015fka bir Ha\u015fim K\u0131l\u0131\u00e7 ve ba\u015fka bir Ahmet Ar\u0131ca yok.<\/p>\n<p style=\"text-align: justify;\">Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n a\u00e7\u0131klamas\u0131n\u0131 esas al\u0131rsak, Av. Harun Y\u00fcksel\u2019in ve \u0130BDA yay\u0131nlar\u0131nda \u00e7\u0131kan \u0130\u015eKENCE isimli kitab\u0131nda (s. 132-133) kendisine \u201cArkada\u015f\u0131m\u201d diyen Salih Mirzabeyo\u011flu\u2019nun ger\u00e7ek d\u0131\u015f\u0131 yazd\u0131klar\u0131n\u0131, anlatt\u0131klar\u0131n\u0131n hayal \u00fcr\u00fcn\u00fc oldu\u011funu kabul etmemiz gerekiyor.<\/p>\n<p style=\"text-align: justify;\"><strong>Tazminat davas\u0131 yok\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">3. AYDINLIK Dergisi, 12 Nisan 2009 tarihli say\u0131s\u0131nda Ha\u015fim K\u0131l\u0131\u00e7\u2019la ilgili haberler nedeniyle a\u00e7\u0131lan davada beraat etti\u011fini duyurdu. Ald\u0131\u011f\u0131m duyuma g\u00f6re mahkeme karar\u0131na kar\u015f\u0131 temyiz yoluna ba\u015fvurulmu\u015f; Ha\u015fim K\u0131l\u0131\u00e7 ayr\u0131ca tazminat davas\u0131 a\u00e7mam\u0131\u015f.<\/p>\n<p style=\"text-align: justify;\"><strong>Ba\u015fkanl\u0131k g\u00f6revine nas\u0131l getirildi?\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Demokrasinin var oldu\u011fu toplumlarda herkes din ve vicdan h\u00fcrriyetine, d\u00fc\u015f\u00fcnce ve kanaat h\u00fcrriyetine sahiptir. Kimse dini inan\u00e7lar\u0131 ve g\u00f6r\u00fc\u015fleri, d\u00fc\u015f\u00fcnce ve kanaatleri nedeniyle k\u0131nanamaz ve bunlar\u0131 a\u00e7\u0131klamaya zorlanamaz. Bu samimi inanc\u0131ma kar\u015f\u0131n Anayasa Mahkemesi Ba\u015fkan\u0131\u2019n\u0131n hukuki durumunu tart\u0131\u015ft\u0131\u011f\u0131m bu incelemede, kendisinin bir dini \u00f6rg\u00fctle ili\u015fkisi oldu\u011fu yolundaki iddialara ve verdi\u011fi cevaplara ana \u00e7izgileri ile de\u011finmemin nedeni, mensup oldu\u011fu kurumun ve bu kurumdaki g\u00f6revinin \u00f6nemi ve niteli\u011fidir.<\/p>\n<p style=\"text-align: justify;\">Ha\u015fim K\u0131l\u0131\u00e7\u2019a y\u00f6neltilen bu iddialar, kendisinin Anayasa Mahkemesi\u2019nin verdi\u011fi baz\u0131 kararlarda kulland\u0131\u011f\u0131 oylarla ili\u015fkilendirildi\u011finden, daha a\u00e7\u0131k deyimle dini g\u00f6r\u00fc\u015f ve d\u00fc\u015f\u00fcncelerinin g\u00f6revine yans\u0131d\u0131\u011f\u0131 ileri s\u00fcr\u00fcld\u00fc\u011f\u00fcnden, bu iddialar hukuki bir boyut da kazanmaktad\u0131r. Kald\u0131 ki s\u00f6z konusu \u00f6rg\u00fct\u00fcn amac\u0131 hakk\u0131nda ileri s\u00fcr\u00fclen g\u00f6r\u00fc\u015fler, g\u00f6revinin kendisinde bulunmas\u0131n\u0131 gerekli k\u0131ld\u0131\u011f\u0131 nitelikler y\u00f6n\u00fcnden de bir de\u011ferlendirmeyi zorunlu k\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>Hukuki dayana\u011f\u0131 olmadan&#8230;\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">TBMM Genel Kurulu\u2019ndaki a\u00e7\u0131klamalar\u0131na uygun olarak Sosyal Demokrat Halk\u00e7\u0131 Parti, 3677 say\u0131l\u0131 kanunun iptali i\u00e7in Anayasa Mahkemesi\u2019nde dava a\u00e7\u0131yor. Anayasa Mahkemesi, 11 Temmuz 1991 g\u00fcnl\u00fc, 21 say\u0131l\u0131 karar\u0131 ile Say\u0131\u015ftay Kanunu\u2019nun ad\u0131 ge\u00e7en kanunla de\u011fi\u015ftirilmi\u015f olan 5. maddesini, 6. maddesinin 3., 4., 5. f\u0131kralar\u0131n\u0131 ve ge\u00e7ici 1. maddeyi oy \u00e7oklu\u011fu ile iptal ediyor (AMKD, Say\u0131 27, s. 423-466). O tarihte Anayasa Mahkemesi as\u0131l \u00fcyesi olan Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n kararda isminin yer almamas\u0131, yerine bir yedek \u00fcyenin kat\u0131lmas\u0131 anlaml\u0131 bir davran\u0131\u015f olarak dikkati \u00e7ekiyor. Teklifin, komisyonda 323 konu atlanarak ilk s\u0131raya al\u0131nmas\u0131; komisyonun toplant\u0131 ve karar yeter say\u0131lar\u0131n\u0131n de\u011fi\u015ftirilerek sadece iktidar partisi mensuplar\u0131n\u0131n kat\u0131l\u0131m\u0131 ile toplanabilmesine imkan sa\u011flanmas\u0131; Say\u0131\u015ftay Genel Kurulu\u2019nun g\u00f6r\u00fc\u015f\u00fcn\u00fcn al\u0131nmamas\u0131 gibi hususlar, kanunun Say\u0131\u015ftay \u00fcyeli\u011fine se\u00e7imlerde t\u0131kan\u0131kl\u0131\u011f\u0131 gidermek i\u00e7in de\u011fil, Say\u0131\u015ftay\u2019da kadrola\u015fma amac\u0131yla y\u00fcr\u00fcrl\u00fc\u011fe konuldu\u011funu g\u00f6stermektedir. 3677 say\u0131l\u0131 kanun bu y\u00f6nden de hukuka ayk\u0131r\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>21 ki\u015filik \u00f6zel liste\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">2. 1985 ve 1990 y\u0131llar\u0131nda Plan ve B\u00fct\u00e7e Komisyonu taraf\u0131ndan do\u011frudan yap\u0131lan se\u00e7imlerde \u00e7ok say\u0131da aday aras\u0131ndan uygun ki\u015fileri se\u00e7ebilmek i\u00e7in adaylar\u0131n sicillerinin incelenmesine imkan verilmemi\u015f; 1985 se\u00e7iminde ayr\u0131ca, sicillerin incelenmesi i\u00e7in a\u00e7\u0131k bir talep olmas\u0131na kar\u015f\u0131n bu talep reddedilmi\u015f ve 1990 se\u00e7iminde de komisyon toplant\u0131s\u0131ndan \u00f6nce, komisyonun iktidar partisine mensup \u00fcyeleri kendi aralar\u0131nda toplanm\u0131\u015flard\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bu tespitler \u00e7ok \u00f6nemlidir: 1985 y\u0131l\u0131nda yap\u0131lan se\u00e7imlerde 225 ki\u015fi \u00fcyelik i\u00e7in ba\u015fvurmu\u015f, bunlar\u0131n i\u00e7inden 21 ki\u015fi ilk oylamada; 1990 y\u0131l\u0131nda yap\u0131lan se\u00e7imde, Say\u0131\u015ftay Genel Kurulu\u2019nca daha \u00f6nce aday adayl\u0131klar\u0131 kabul edilen 128 ki\u015fiden 9 ki\u015fi, Say\u0131\u015ftay \u00fcyesi olarak se\u00e7ilmi\u015ftir. Her iki se\u00e7imde de se\u00e7ilenlerin ald\u0131klar\u0131 oy say\u0131lar\u0131 birbirine \u00e7ok yak\u0131nd\u0131r. Adaylar\u0131n ehliyet ve liyakatlar\u0131n\u0131n tespiti i\u00e7in siciller incelettirilmedi\u011fine g\u00f6re komisyonlardaki se\u00e7imler hangi \u00f6l\u00e7\u00fctler esas al\u0131narak \u00e7ok k\u0131sa s\u00fcrede sonu\u00e7lanm\u0131\u015ft\u0131r?<\/p>\n<p style=\"text-align: justify;\">Cevab\u0131 a\u00e7\u0131kt\u0131r. Se\u00e7ilecek olanlar komisyonun iktidar partisine mensup \u00fcyeleri taraf\u0131ndan \u00f6nceden tespit edilmi\u015f; ehliyet ve liyakat \u00f6l\u00e7\u00fctleri bir yana b\u0131rak\u0131larak Say\u0131\u015ftay\u2019da kadrola\u015fmak, b\u00f6ylece bu anayasal kurumu iktidar partisinin denetimi alt\u0131na sokmak amac\u0131 izlenmi\u015ftir. Her iki se\u00e7im de ama\u00e7 (maksat) unsuru y\u00f6n\u00fcnden hukuka ayk\u0131r\u0131d\u0131r (G\u00fcn\u00fcm\u00fczde yap\u0131lan baz\u0131 se\u00e7imlere ne kadar da benziyor!).<\/p>\n<p style=\"text-align: justify;\"><strong>Anayasa\u2019ya ayk\u0131r\u0131 atama\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">3- 1990 y\u0131l\u0131nda, Anayasa Mahkemesi taraf\u0131ndan iptal edilmi\u015f olan bir kanuna dayan\u0131larak se\u00e7ilen 9 \u00fcye Say\u0131\u015ftay Genel Kurulu\u2019na kat\u0131lm\u0131\u015f; bu kurulun ald\u0131\u011f\u0131 kararlarda oy kullanm\u0131\u015flard\u0131r. \u00d6rne\u011fin Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n Anayasa Mahkemesi\u2019ne \u00fcye aday\u0131 olarak se\u00e7ildi\u011fi ve 31 oy ald\u0131\u011f\u0131 137\u2019nci oylamada genel kurulda haz\u0131r bulunan 52 \u00fcyenin 9\u2019u, bu se\u00e7imde \u00fcyelik kadrolar\u0131na atanan ki\u015filerdir.<\/p>\n<p style=\"text-align: justify;\">B\u00f6ylece Ha\u015fim K\u0131l\u0131\u00e7, Anayasa\u2019ya ayk\u0131r\u0131l\u0131\u011f\u0131, Anayasa Mahkemesi\u2019nin emsal karar\u0131 ile ortaya \u00e7\u0131kan bir kanuna (3162) dayan\u0131larak ve maksat y\u00f6n\u00fcnden sakat bir idari i\u015flemle Say\u0131\u015ftay \u00fcyeli\u011fine atanm\u0131\u015f; yine ayn\u0131 kanuna ve Anayasa Mahkemesi taraf\u0131ndan iptal edilmi\u015f olan 3677 say\u0131l\u0131 kanuna dayan\u0131larak se\u00e7ilen toplam 27 ki\u015finin fiilen kat\u0131ld\u0131\u011f\u0131 Say\u0131\u015ftay Genel Kurulu taraf\u0131ndan da Anayasa Mahkemesi \u00fcye adayl\u0131\u011f\u0131na se\u00e7ilmi\u015ftir. Bu yap\u0131s\u0131 ile hukuka uygun olarak olu\u015fmu\u015f bir Say\u0131\u015ftay Genel Kurulu\u2019ndan ve hukuken ge\u00e7erli \u201cAnayasa Mahkemesi \u00fcyeli\u011fine aday se\u00e7me\u2019\u2019 karar\u0131ndan s\u00f6z edilemez (Prof. Dr. Pertev Bilgen, Prof. Dr. Bak\u0131r \u00c7a\u011flar, Prof. Dr. Erdo\u011fan Tezi\u00e7, Cumhuriyet Gazetesi, 26 Aral\u0131k 1990, s. 2).<\/p>\n<p style=\"text-align: justify;\"><strong>Kazan\u0131lm\u0131\u015f hak aldatmacas\u0131\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">4- Anayasa Mahkemesi\u2019nin 3677 say\u0131l\u0131 kanunla ilgili 11 Temmuz 1991 g\u00fcnl\u00fc, 21 say\u0131l\u0131 iptal karar\u0131, Ha\u015fim K\u0131l\u0131\u00e7\u2019\u0131n Say\u0131\u015ftay Genel Kurulu taraf\u0131ndan aday g\u00f6sterilmesinden ve Cumhurba\u015fkan\u0131 taraf\u0131ndan Anayasa Mahkemesi \u00fcyeli\u011fine atanmas\u0131ndan sonra Resmi Gazete\u2019de yay\u0131mland\u0131\u011f\u0131 ve y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi i\u00e7in Anayasa\u2019n\u0131n 153. maddesinde yer alan \u201c\u0130ptal kararlar\u0131 geriye y\u00fcr\u00fcmez\u201d kural\u0131n\u0131n bu olayda tart\u0131\u015f\u0131lmas\u0131 gerekir. Bireylerin hukuki g\u00fcvenli\u011finin sa\u011flanmas\u0131 ve hukuk d\u00fczeninin kararl\u0131l\u0131\u011f\u0131n\u0131n korunmas\u0131 amac\u0131yla Anayasa\u2019ya al\u0131nan bu ilke yarg\u0131 i\u00e7tihatlar\u0131nda ve \u00f6\u011fretide mutlak anlamda de\u011ferlendirilmemektedir. Bu de\u011ferlendirmeleri tart\u0131\u015fmak yaz\u0131n\u0131n amac\u0131n\u0131 ve s\u0131n\u0131rlar\u0131 a\u015far. Ben bu ilkeyle ilgili iki yarg\u0131 karar\u0131n\u0131 vermekle yetinece\u011fim:<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi, 12 Aral\u0131k 1989 g\u00fcnl\u00fc, 48 say\u0131l\u0131 karar\u0131nda (AMKD say\u0131 25, s. 436-437) bu ilkeyi ayr\u0131nt\u0131l\u0131 bir \u015fekilde incelemi\u015f ve g\u00f6r\u00fc\u015f\u00fcn\u00fc ortaya koymu\u015ftur. Anayasa Mahkemesi bu karar\u0131nda \u00f6zetle; Anayasa\u2019ya ayk\u0131r\u0131l\u0131\u011f\u0131 nedeniyle iptal edilen yasaya dayan\u0131larak elde edilen haklar\u0131n kazan\u0131lm\u0131\u015f hak olarak kabul edilemeyece\u011fini; bunlar\u0131n ancak Anayasa Mahkemesi\u2019nin iptal karar\u0131n\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girece\u011fi tarihe kadar ge\u00e7erli say\u0131labilece\u011fini; bir kural i\u015flemle kurulan stat\u00fclerin ve buna ba\u011fl\u0131 \u00f6znel i\u015flemlerin de ge\u00e7ersiz olaca\u011f\u0131n\u0131 tart\u0131\u015fmaya meydan vermeyecek bi\u00e7imde a\u00e7\u0131klam\u0131\u015ft\u0131r. Mahkemenin bu karar\u0131ndaki gerek\u00e7esinin, inceleme konusu olayda do\u011furdu\u011fu sonu\u00e7 \u015fu olmal\u0131d\u0131r:<\/p>\n<p style=\"text-align: justify;\">TBMM Plan ve B\u00fct\u00e7e Komisyonu\u2019nun 21 Kas\u0131m 1990 g\u00fcnl\u00fc, 140 say\u0131l\u0131 karar\u0131 ile Say\u0131\u015ftay \u00fcyeli\u011fine se\u00e7ilen 9 ki\u015finin stat\u00fclerini belirleyen 3677 say\u0131l\u0131 kanunun ge\u00e7ici 1. maddesi Anayasa Mahkemesi taraf\u0131ndan iptal edilmi\u015ftir. Bunlar\u0131n iptal edilen yasaya g\u00f6re elde ettikleri Say\u0131\u015ftay \u00fcyeli\u011fi kendileri i\u00e7in kazan\u0131lm\u0131\u015f hak te\u015fkil etmez; ancak iptal karar\u0131n\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihe kadar ge\u00e7erlidir. Ancak, Anayasa Mahkemesi\u2019nin 1991 y\u0131l\u0131nda vermi\u015f oldu\u011fu bu karar\u0131n gereklerinin, ge\u00e7 de olsa, bug\u00fcn yerine getirilmesi i\u00e7in herhangi bir engel bulunmamaktad\u0131r. Hi\u00e7bir hukuki g\u00f6r\u00fc\u015f, Anayasa Mahkemesi taraf\u0131ndan iptal edilmi\u015f olan bir kanuna dayal\u0131 olarak elde edilen bir kamu g\u00f6revinin, uygulamas\u0131 s\u0131n\u0131rl\u0131 ve tart\u0131\u015fmal\u0131 olan iptal kararlar\u0131n\u0131n geriye y\u00fcr\u00fcmezli\u011fi ilkesine s\u0131\u011f\u0131n\u0131larak sonuna kadar s\u00fcrd\u00fcr\u00fclmesine izin veremez. Buna ra\u011fmen g\u00f6rev s\u00fcrd\u00fcr\u00fcl\u00fcyorsa bu fiili bir duruma i\u015faret eder ve hukuk kurallar\u0131n\u0131n d\u0131\u015f\u0131na ta\u015far. Anayasas\u0131nda hukuk devleti oldu\u011fu tan\u0131mlamas\u0131 bulunan hi\u00e7bir \u00fclkede de b\u00f6yle bir durumun olu\u015fmas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p style=\"text-align: justify;\">Konu bir y\u00f6n\u00fcyle, ki\u015fisel de\u011fer yarg\u0131lar\u0131 ile de ilgilidir.
