Sa\u011fl\u0131k Bakan\u0131 Recep Akda\u011f, &#8220;Tam G\u00fcn Tasar\u0131s\u0131&#8221;n\u0131n yasala\u015fmas\u0131yla &#8220;Tarihi bir i\u015f yap\u0131ld\u0131\u011f\u0131n\u0131&#8221; s\u00f6yledi. <!--more--><\/p>\n<p style=\"text-align: justify;\">Yasaya g\u00f6re, personelin katk\u0131s\u0131yla elde edilen d\u00f6ner sermaye gelirlerinden personele bir ayda yap\u0131lacak ek \u00f6demenin tutar\u0131, ilgili personelin bir ayda alaca\u011f\u0131 ayl\u0131k (ek g\u00f6sterge dahil), yan \u00f6deme ve her t\u00fcrl\u00fc tazminat (makam, temsil ve g\u00f6rev tazminat\u0131 ile yabanc\u0131 dil tazminat\u0131 hari\u00e7) toplam\u0131n\u0131n; klinik \u015fefleri ve \u015fef yard\u0131mc\u0131lar\u0131 ile uzman tabip kadrosuna atanan profes\u00f6r ve do\u00e7entlerde y\u00fczde 800&#8217;\u00fcn\u00fc ge\u00e7emeyecek.<\/p>\n<p style=\"text-align: justify;\">Bu \u00f6demeler; uzman tabip ve t\u0131pta uzmanl\u0131k mevzuat\u0131nda belirtilen dallarda, bu mevzuat h\u00fck\u00fcmlerine g\u00f6re uzman olanlar ile uzman di\u015f tabiplerinde y\u00fczde 700, pratisyen tabip ve di\u015f tabiplerinde y\u00fczde 500, idari sa\u011fl\u0131k m\u00fcd\u00fcr yard\u0131mc\u0131s\u0131, hastane m\u00fcd\u00fcr\u00fc ve eczac\u0131larda y\u00fczde 250, ba\u015fhem\u015firelerde y\u00fczde 200, di\u011fer personelde ise y\u00fczde 150 ile s\u0131n\u0131rl\u0131 olacak. \u0130\u015fin ve hizmetin \u00f6zelli\u011fi dikkate al\u0131narak yo\u011fun bak\u0131m, do\u011fumhane, yeni do\u011fan, s\u00fct \u00e7ocu\u011fu, yan\u0131k, diyaliz, ameliyathane, enfeksiyon, \u00f6zel bak\u0131m gerektiren ruh sa\u011fl\u0131\u011f\u0131, organ ve doku nakli, acil servis ve benzeri hizmetlerde \u00e7al\u0131\u015fan personel i\u00e7in y\u00fczde 150 oran\u0131, y\u00fczde 200 olarak uygulanacak.<\/p>\n<p style=\"text-align: justify;\">S\u00f6zle\u015fmeli olarak istihdam edilen personele yap\u0131lacak ek \u00f6demenin tutar\u0131 ise ayn\u0131 birimde ayn\u0131 unvanl\u0131 kadroda \u00e7al\u0131\u015fan ve hizmet y\u0131l\u0131 ayn\u0131 olan emsali personel esas al\u0131narak belirlenecek ve bunlara yap\u0131lacak ek \u00f6deme hi\u00e7bir \u015fekilde emsaline yap\u0131labilecek ek \u00f6deme \u00fcst s\u0131n\u0131r\u0131n\u0131 ge\u00e7emeyecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>\u00dcniversite elamanlar\u0131 <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Y\u00fcksek\u00f6\u011fretim Kanununa g\u00f6re Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 merkez te\u015fkilat\u0131 ile ba\u011fl\u0131 sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131nda g\u00f6revlendirilenler, ilave \u00f6demelerden yararlanmamak kayd\u0131yla, Bakanl\u0131k merkez veya ba\u011fl\u0131 sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131nda g\u00f6rev yapt\u0131klar\u0131 unvan i\u00e7in belirlenen ek \u00f6demeden faydaland\u0131r\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">Sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131nda ihtiya\u00e7 duyulmas\u0131 halinde, ilgilinin iste\u011fi ve kurumlar\u0131n\u0131n onamas\u0131yla di\u011fer kamu kurum ve kurulu\u015flar\u0131nda g\u00f6revli sa\u011fl\u0131k personeli, haftan\u0131n belirli g\u00fcn veya saatlerinde veya belirli vakalar ve i\u015fler i\u00e7in g\u00f6revlendirilebilecek.<\/p>\n<p style=\"text-align: justify;\">Y\u0131l veya ay itibar\u0131yla belirli bir s\u00fcre i\u00e7in g\u00f6revlendirme halinde bu ki\u015filere, sadece g\u00f6revlendirildikleri sa\u011fl\u0131k kurulu\u015fundaki d\u00f6ner sermaye i\u015fletmesinden \u00f6deme yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">Belirli bir vaka ve i\u015f i\u00e7in g\u00f6revlendirilenlere ise kadrosunun bulundu\u011fu kurumdaki d\u00f6ner sermaye i\u015fletmesinden yap\u0131lan \u00f6demenin yan\u0131 s\u0131ra, katk\u0131 sa\u011flad\u0131klar\u0131 vaka ve i\u015f dolay\u0131s\u0131yla g\u00f6revlendirildi\u011fi sa\u011fl\u0131k kurulu\u015fundaki d\u00f6ner sermaye i\u015fletmesinden, toplamda tavan oranlar\u0131 ge\u00e7memek \u00fczere d\u00f6ner sermayeden ek \u00f6deme yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 ve Refik Saydam H\u0131fz\u0131ss\u0131hha Merkezinde kadro ve pozisyonlar\u0131na (d\u00f6ner sermaye dahil) atanan ve d\u00f6ner sermaye gelirlerinden ek \u00f6deme alan klinik \u015fef ve \u015fef yard\u0131mc\u0131lar\u0131na, ek g\u00f6sterge dahil en y\u00fcksek devlet memuru ayl\u0131\u011f\u0131n\u0131n y\u00fczde 410&#8217;u, uzman tabip, T\u0131pta Uzmanl\u0131k T\u00fcz\u00fc\u011f\u00fcne g\u00f6re uzman olanlar ve uzman di\u015f tabiplerine y\u00fczde 335&#8217;i ve pratisyen tabip ve di\u015f tabiplerine ise y\u00fczde 180&#8217;i oran\u0131nda, her ay herhangi bir katk\u0131ya ba\u011fl\u0131 olmadan d\u00f6ner sermaye gelirlerinden ek \u00f6deme yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">Bu \u00f6demeye hak kazan\u0131lmas\u0131nda ve \u00f6denmesinde, ayl\u0131klara ili\u015fkin h\u00fck\u00fcmler uygulanacak.<\/p>\n<p style=\"text-align: justify;\"><strong><em>T\u0131p fak\u00fcltelerinde de tam g\u00fcn <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Yasaya g\u00f6re, \u00f6\u011fretim elemanlar\u0131, \u00fcniversitede devaml\u0131 stat\u00fcde g\u00f6rev yapacak. Bu durumda, \u00fcniversitelerin t\u0131p fak\u00fcltelerinde g\u00f6rev yapan \u00f6\u011fretim elemanlar\u0131 da tam g\u00fcn \u00e7al\u0131\u015facak.<\/p>\n<p style=\"text-align: justify;\">\u00d6\u011fretim elemanlar\u0131, bu Kanun ile di\u011fer kanunlarda belirlenen g\u00f6revler ve telif haklar\u0131 hari\u00e7 olmak \u00fczere, y\u00fcksek\u00f6\u011fretim kurumlar\u0131ndan ba\u015fka yerlerde \u00fccretli veya \u00fccretsiz, resmi veya \u00f6zel ba\u015fka herhangi bir i\u015f g\u00f6remeyecekler, ek g\u00f6rev alamayacaklar, serbest meslek icra edemeyecekler.<\/p>\n<p style=\"text-align: justify;\">\u00d6\u011fretim \u00fcyesi, kadrosunun bulundu\u011fu y\u00fcksek\u00f6\u011fretim birimi ile s\u0131n\u0131rl\u0131 olmaks\u0131z\u0131n ve ihtiya\u00e7 bulunmas\u0131 halinde g\u00f6revli oldu\u011fu \u00fcniversitede haftada asgari 10 saat ders vermekle y\u00fck\u00fcml\u00fc tutulacak. \u00d6\u011fretim g\u00f6revlisi ve okutmanlar ise haftada asgari 12 saat ders verecekler.<\/p>\n<p style=\"text-align: justify;\">\u00d6\u011fretim elemanlar\u0131n\u0131n, ders d\u0131\u015f\u0131ndaki uygulama, seminer, proje, bitirme \u00f6devi ve tez dan\u0131\u015fmanl\u0131klar\u0131n\u0131n ka\u00e7 ders saatine kar\u015f\u0131l\u0131k geldi\u011fi; kendi \u00fcniversitesi d\u0131\u015f\u0131ndaki devlet veya vak\u0131f \u00fcniversitelerine ba\u011fl\u0131 y\u00fcksek\u00f6\u011fretim kurumlar\u0131nda haftada verebilece\u011fi azami ders saatleri ve uzaktan \u00f6\u011fretim programlar\u0131nda verdikleri derslerin \u00f6rg\u00fcn \u00f6\u011fretim programlar\u0131nda verilen ka\u00e7 ders saatine kar\u015f\u0131l\u0131k geldi\u011fi Y\u00d6K taraf\u0131ndan belirlenecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>Rekt\u00f6rlerin ders zorunlulu\u011fu yok <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Rekt\u00f6r, rekt\u00f6r yard\u0131mc\u0131s\u0131, dekan, enstit\u00fc ve y\u00fcksekokul m\u00fcd\u00fcrlerinin ders verme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmayacak.<\/p>\n<p style=\"text-align: justify;\">Ba\u015fhekimler, dekan yard\u0131mc\u0131lar\u0131, enstit\u00fc ve y\u00fcksekokul m\u00fcd\u00fcr yard\u0131mc\u0131lar\u0131 ve b\u00f6l\u00fcm ba\u015fkanlar\u0131 haftada asgari 5 saat ders vermekle y\u00fck\u00fcml\u00fc olacak.<\/p>\n<p style=\"text-align: justify;\">\u00d6\u011fretim elemanlar\u0131; ilgili kurumlar\u0131n talebi ve kendisinin kabul etmesi, \u00fcniversite y\u00f6netim kurulunun uygun g\u00f6rmesi ve rekt\u00f6r\u00fcn onay\u0131 ile ihtiya\u00e7 duyulan konularda, \u00f6zl\u00fck i\u015flemleri kendi kurumlar\u0131nca y\u00fcr\u00fct\u00fclmek kayd\u0131yla, di\u011fer kamu kurum ve kurulu\u015flar\u0131 ile kamu kurumu niteli\u011findeki meslek kurulu\u015flar\u0131nda ge\u00e7ici olarak g\u00f6revlendirilebilecek.<\/p>\n<p style=\"text-align: justify;\">Bu \u015fekilde g\u00f6revlendirilenlerin, kadrosunun bulundu\u011fu y\u00fcksek\u00f6\u011fretim kurumlar\u0131ndaki ayl\u0131k ve di\u011fer \u00f6demeler ile \u00f6teki haklar\u0131 devam edecek.<\/p>\n<p style=\"text-align: justify;\">Y\u00d6K, ba\u011fl\u0131 birimleri ve \u00dcniversiteleraras\u0131 Kurul ile Adli T\u0131p Kurumunda g\u00f6revlendirilenler hari\u00e7 olmak \u00fczere g\u00f6revlendirilenler, d\u00f6ner sermayeden yararlanamayacak.<\/p>\n<p style=\"text-align: justify;\">Kamu kurumu niteli\u011findeki meslek kurulu\u015flar\u0131 ile dernek veya vak\u0131flar\u0131n y\u00f6netim ve denetim organlar\u0131nda g\u00f6rev yapanlar bak\u0131m\u0131ndan, ayr\u0131ca bir g\u00f6revlendirme karar\u0131 aranmayacak. Ancak, bu g\u00f6revler, \u00f6\u011fretim eleman\u0131n\u0131n bu Kanundan kaynaklanan mesaisini aksatmayacak \u015fekilde y\u00fcr\u00fct\u00fclecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>\u00dcniversitelerde d\u00f6ner sermaye <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Y\u00fcksek\u00f6\u011fretim kurumlar\u0131nda, \u00fcniversite y\u00f6netim kurulunun \u00f6nerisi ve Y\u00d6K&#8217;\u00fcn onay\u0131 ile d\u00f6ner sermaye i\u015fletmesi kurulabilecek. Kurulacak d\u00f6ner sermaye i\u015fletmesinin ba\u015flang\u0131\u00e7 sermayesine ilgili y\u00fcksek\u00f6\u011fretim kurumu b\u00fct\u00e7esinde bu ama\u00e7 i\u00e7in \u00f6denek \u00f6ng\u00f6r\u00fclmek \u015fart\u0131yla katk\u0131 sa\u011flayabilecek.<\/p>\n<p style=\"text-align: justify;\">D\u00f6ner sermaye i\u015fletmesine tahsis edilen sermaye, \u00fcniversite y\u00f6netim kurulu karar\u0131 ile art\u0131r\u0131labilecek. Art\u0131r\u0131lan sermaye tutar\u0131 y\u0131l sonu karlar\u0131ndan kar\u015f\u0131lanacak. \u00d6denmi\u015f sermaye tutar\u0131, tahsis edilen sermaye tutar\u0131na ula\u015ft\u0131ktan sonra kalan y\u0131l sonu kar\u0131, d\u00f6ner sermaye i\u015fletmesinin hizmetlerinde kullan\u0131lmak \u00fczere ertesi y\u0131l\u0131n gelirine ilave edilecek.<\/p>\n<p style=\"text-align: justify;\">S\u00fcreklilik arz eden hizmet al\u0131mlar\u0131 ile maliyeti y\u00fcksek ve ileri teknoloji \u00fcr\u00fcn\u00fc olan t\u0131bbi cihazlar\u0131n hizmet al\u0131m\u0131 yoluyla temini veya kiralanmas\u0131 i\u00e7in d\u00f6ner sermaye kaynaklar\u0131ndan gelecek y\u0131llara yayg\u0131n y\u00fcklenmelere giri\u015filebilecek.<\/p>\n<p style=\"text-align: justify;\">D\u00f6ner sermaye gelirlerinden tahsil edilen k\u0131sm\u0131n, t\u0131p ve di\u015f hekimli\u011fi fak\u00fclteleri ile ba\u011fl\u0131k uygulama ve ara\u015ft\u0131rma merkezleri i\u00e7in asgari y\u00fczde 35&#8217;i, ziraat ve veteriner fak\u00fclteleri, sivil havac\u0131l\u0131k y\u00fcksekokulu ile b\u00fcnyesinde at\u00f6lye veya laboratuvar bulunan y\u00fcksek\u00f6\u011fretim kurumlar\u0131 i\u00e7in ise y\u00fczde 25&#8217;i, di\u011fer y\u00fcksek\u00f6\u011fretim kurumlar\u0131 i\u00e7in ise y\u00fczde 15&#8217;i; ilgili y\u00fcksek\u00f6\u011fretim kurumunun ihtiyac\u0131 olan mal ve hizmet al\u0131mlar\u0131, her t\u00fcrl\u00fc bak\u0131m, onar\u0131m, kiralama, projelerin tamamlanmas\u0131na y\u00f6nelik in\u015faat i\u015fleri ve y\u00f6netici paylar\u0131 i\u00e7in kullan\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">D\u00f6ner sermaye gelirlerinden tahsil edilen k\u0131sm\u0131n y\u00fczde 5&#8217;i, \u00fcniversite b\u00fcnyesinde y\u00fcr\u00fct\u00fclen bilimsel ara\u015ft\u0131rma projelerinin finansman\u0131na ayr\u0131lacak.<\/p>\n<p style=\"text-align: justify;\"><strong><em>D\u00f6ner sermaye paylar\u0131 <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">T\u0131p ve di\u015f hekimli\u011fi fak\u00fclteleri ile sa\u011fl\u0131k uygulama ve ara\u015ft\u0131rma merkezlerinin hesab\u0131nda toplanan d\u00f6ner sermaye gelirleri bakiyesinden, bu yerlerde; gelir getiren g\u00f6revlerde \u00e7al\u0131\u015fan \u00f6\u011fretim \u00fcyesi ve \u00f6\u011fretim g\u00f6revlilerine ayl\u0131k (ek g\u00f6sterge dahil), yan \u00f6deme, \u00f6denek (geli\u015ftirme \u00f6dene\u011fi hari\u00e7) ve her t\u00fcrl\u00fc tazminat (makam, temsil ve g\u00f6rev tazminat\u0131 ile yabanc\u0131 dil tazminat\u0131 hari\u00e7) toplam\u0131ndan olu\u015fan ek \u00f6deme matrah\u0131n\u0131n y\u00fczde 800&#8217;\u00fcn\u00fc ge\u00e7emeyecek.<\/p>\n<p style=\"text-align: justify;\">Bu oran, ara\u015ft\u0131rma g\u00f6revlilerine ise y\u00fczde 500, bu yerlerde g\u00f6revli olmakla birlikte gelire katk\u0131s\u0131 olmayan \u00f6\u011fretim \u00fcyesi ve \u00f6\u011fretim g\u00f6revlilerine y\u00fczde 600, ara\u015ft\u0131rma g\u00f6revlilerine ise y\u00fczde 300 olarak uygulanacak.<\/p>\n<p style=\"text-align: justify;\">Devlet Memurlar\u0131 Kanununa tabi personel (d\u00f6ner sermaye i\u015fletme m\u00fcd\u00fcrl\u00fc\u011f\u00fc ve d\u00f6ner sermaye saymanl\u0131k personeli dahil) ile s\u00f6zle\u015fmeli olarak \u00e7al\u0131\u015fan personele ek \u00f6deme matrah\u0131n\u0131n; hastaneler ba\u015fm\u00fcd\u00fcr\u00fc ve eczac\u0131lar i\u00e7in y\u00fczde 250&#8217;si, ba\u015fhem\u015fireler i\u00e7in y\u00fczde 200&#8217;\u00fc, di\u011ferleri i\u00e7in y\u00fczde 150&#8217;si, i\u015fin ve hizmetin \u00f6zelli\u011fi dikkate al\u0131narak yo\u011fun bak\u0131m, do\u011fumhane, yeni do\u011fan, s\u00fct \u00e7ocu\u011fu, yan\u0131k, diyaliz, ameliyathane, enfeksiyon, \u00f6zel bak\u0131m gerektiren ruh sa\u011fl\u0131\u011f\u0131, organ ve doku nakli, acil servis ve benzeri sa\u011fl\u0131k hizmetlerinde \u00e7al\u0131\u015fan personel i\u00e7in y\u00fczde 200&#8217;\u00fc ge\u00e7meyecek \u015fekilde ayl\u0131k ek \u00f6deme yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">S\u00f6zle\u015fmeli personele yap\u0131lacak ek \u00f6deme matrah\u0131, s\u00f6zle\u015fmeli personelin \u00e7al\u0131\u015ft\u0131\u011f\u0131 birim ve bulundu\u011fu pozisyon unvan\u0131 itibar\u0131yla ayn\u0131 veya benzer unvanl\u0131 memur kadrosunda \u00e7al\u0131\u015fan, hizmet y\u0131l\u0131 ve \u00f6\u011frenim durumu ayn\u0131 olan emsali personel dikkate al\u0131narak belirlenecek.<\/p>\n<p style=\"text-align: justify;\">Emsali bulunmayan s\u00f6zle\u015fmeli personelin ek \u00f6deme matrah\u0131 ise br\u00fct s\u00f6zle\u015fme \u00fccretlerinin y\u00fczde 25&#8217;ini ge\u00e7emeyecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>\u00d6\u011fretim \u00fcyelerine bir y\u0131l s\u00fcre <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Rekt\u00f6r, rekt\u00f6r yard\u0131mc\u0131s\u0131 ve genel sekreterlere, gelir getirici katk\u0131lar\u0131na bak\u0131lmaks\u0131z\u0131n, \u00fcniversite y\u00f6netim kurulunun uygun g\u00f6rd\u00fc\u011f\u00fc birimin d\u00f6ner sermaye hesab\u0131ndan y\u00f6netici pay\u0131 olarak ayr\u0131lan tutardan ek \u00f6deme yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">Yap\u0131lacak ek \u00f6demenin tutar\u0131 ek \u00f6deme matrah\u0131n\u0131n, rekt\u00f6rler i\u00e7in y\u00fczde 600&#8217;\u00fcn\u00fc, rekt\u00f6r yard\u0131mc\u0131lar\u0131 i\u00e7in y\u00fczde 300&#8217;\u00fcn\u00fc, genel sekreterler i\u00e7in y\u00fczde 200&#8217;\u00fcn\u00fc ge\u00e7emeyecek.<\/p>\n<p style=\"text-align: justify;\">D\u00f6ner sermaye gelirinin elde edildi\u011fi birimlerin dekan, ba\u015fhekim ve enstit\u00fc ve y\u00fcksekokul m\u00fcd\u00fcrleri ile bunlar\u0131n yard\u0131mc\u0131lar\u0131na, gelir getirici katk\u0131lar\u0131na bak\u0131lmaks\u0131z\u0131n, g\u00f6rev yapt\u0131klar\u0131 birimin d\u00f6ner sermaye gelirlerinden y\u00f6netici pay\u0131 olarak ayr\u0131lan tutardan ek \u00f6deme yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">Yap\u0131lacak ek \u00f6demenin tutar\u0131, ek \u00f6deme matrah\u0131n\u0131n dekan, enstit\u00fc ve y\u00fcksekokul m\u00fcd\u00fcr\u00fc i\u00e7in y\u00fczde 250&#8217;sini, bunlar\u0131n yard\u0131mc\u0131lar\u0131 i\u00e7in y\u00fczde 100&#8217;\u00fcn\u00fc; t\u0131p ve di\u015f hekimli\u011fi fak\u00fclteleri dekanlar\u0131 ile sa\u011fl\u0131k uygulama ve ara\u015ft\u0131rma merkezleri ba\u015fhekimleri i\u00e7in y\u00fczde 500&#8217;\u00fcn\u00fc, bunlar\u0131n yard\u0131mc\u0131lar\u0131 i\u00e7in y\u00fczde 300&#8217;\u00fcn\u00fc ge\u00e7emeyecek.<\/p>\n<p style=\"text-align: justify;\">Kanunun Resmi Gazetede yay\u0131mland\u0131\u011f\u0131 tarihte, k\u0131smi stat\u00fcde g\u00f6rev yapan \u00f6\u011fretim \u00fcyelerinden, yay\u0131m tarihinden itibaren 1 y\u0131l i\u00e7erisinde talepte bulunanlar, devaml\u0131 stat\u00fcye ge\u00e7irilecek. Bu s\u00fcre i\u00e7erisinde talepte bulunmayanlar istifa etmi\u015f say\u0131lacak.<\/p>\n<p style=\"text-align: justify;\"><strong><em>Sa\u011fl\u0131k kurumlar\u0131 <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Tababet ve \u015euabat\u0131 Sanatlar\u0131n\u0131n Tarz\u0131 \u0130cras\u0131na Dair Kanunda de\u011fi\u015fiklik yapan kanun, tabip, di\u015f tabibi ve t\u0131pta uzmanl\u0131k mevzuat\u0131na g\u00f6re uzman olanlar\u0131n, g\u00f6revlerini yapabilecekleri sa\u011fl\u0131k kurumlar\u0131n\u0131 da yeniden belirliyor.<\/p>\n<p style=\"text-align: justify;\">Buna g\u00f6re, hekimler \u015fu kurulu\u015flardan yaln\u0131zca birinde g\u00f6rev yapabilecek: -Kamu kurum ve kurulu\u015flar\u0131. -Sosyal G\u00fcvenlik Kurumu ve kamu kurumlar\u0131 ile s\u00f6zle\u015fmeli \u00e7al\u0131\u015fan \u00f6zel sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131, Sosyal G\u00fcvenlik Kurumu ve kamu kurumlar\u0131 ile s\u00f6zle\u015fmeli \u00e7al\u0131\u015fan vak\u0131f \u00fcniversiteleri. -Sosyal G\u00fcvenlik Kurumu ve kamu kurumlar\u0131 ile s\u00f6zle\u015fmesi bulunmayan \u00f6zel sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131, Sosyal G\u00fcvenlik Kurumu ve kamu kurumlar\u0131 ile s\u00f6zle\u015fmesi bulunmayan vak\u0131f \u00fcniversiteleri, serbest meslek icras\u0131. Tabipler, di\u015f tabibi ve t\u0131pta uzmanl\u0131k mevzuat\u0131na g\u00f6re uzman olanlar, birden fazla sa\u011fl\u0131k kurum ve kurulu\u015funda \u00e7al\u0131\u015fabilecek.<\/p>\n<p style=\"text-align: justify;\">Sosyal G\u00fcvenlik Kurumunca bran\u015f baz\u0131nda s\u00f6zle\u015fme yap\u0131lan \u00f6zel sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131 ve vak\u0131f \u00fcniversiteleri, yaln\u0131zca s\u00f6zle\u015fme yapt\u0131klar\u0131 bran\u015flarda hasta kabul edebilecek.<\/p>\n<p style=\"text-align: justify;\">Mesle\u011fini serbest olarak yapanlar, hizmet bedeli hasta taraf\u0131ndan kar\u015f\u0131lanmak ve Sosyal G\u00fcvenlik Kurumundan talep edilmemek kayd\u0131yla hastalar\u0131n te\u015fhis ve tedavisini yapabilecekler. S\u00f6zle\u015fmeli stat\u00fcde olanlar da dahil olmak \u00fczere mahalli idareler ile kamu tabipliklerinde \u00e7al\u0131\u015fan ve d\u00f6ner sermaye ek \u00f6demesi almayan tabipler, i\u015f yeri hekimli\u011fi yapabilecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>Zorunlu sigorta yapt\u0131racak <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Kamu sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131nda \u00e7al\u0131\u015fan tabip, di\u015f tabibi ve t\u0131pta uzmanl\u0131k mevzuat\u0131na g\u00f6re uzman olanlar, &#8220;t\u0131bbi k\u00f6t\u00fc uygulama&#8221; nedeniyle kendilerinden talep edilebilecek zararlarla, kurumlar\u0131nca kendilerine yap\u0131lacak r\u00fcculara kar\u015f\u0131 sigorta yapt\u0131rmak zorunda olacak.<\/p>\n<p style=\"text-align: justify;\">S\u00f6z konusu sigorta priminin yar\u0131s\u0131 kendileri taraf\u0131ndan, di\u011fer yar\u0131s\u0131 d\u00f6ner sermayesi bulunan kurumlarda d\u00f6ner sermayeden, d\u00f6ner sermayesi bulunmayan kurumlarda ise kurum b\u00fct\u00e7elerinden \u00f6denecek.<\/p>\n<p style=\"text-align: justify;\">\u00d6zel sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131nda \u00e7al\u0131\u015fan ya da mesleklerini serbest yapan tabip, di\u015f tabibi ve t\u0131pta uzmanl\u0131k mevzuat\u0131na g\u00f6re uzman olanlar, t\u0131bbi k\u00f6t\u00fc uygulama nedeniyle ki\u015filere verebilecekleri zararlarla, bu nedenle kendilerine yap\u0131lacak r\u00fccular\u0131 kar\u015f\u0131lamak \u00fczere mesleki mali sorumluluk sigortas\u0131 yapt\u0131racak.<\/p>\n<p style=\"text-align: justify;\">Zorunlu mesleki mali sorumluluk sigortas\u0131, mesleklerini serbest olarak yapanlar\u0131n kendileri, \u00f6zel sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131nda \u00e7al\u0131\u015fanlar\u0131n ilgili \u00f6zel sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131 taraf\u0131ndan yapt\u0131r\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">\u00d6zel sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131nda \u00e7al\u0131\u015fanlar\u0131n sigorta primlerinin yar\u0131s\u0131 kendileri taraf\u0131ndan, yar\u0131s\u0131 istihdam edenler taraf\u0131ndan \u00f6denecek. Zorunlu sigortalar\u0131 yapt\u0131rmayanlara, sigortas\u0131 yapt\u0131r\u0131lmayan her ki\u015fi i\u00e7in 5 bin TL idari para cezas\u0131 verilecek.<\/p>\n<p style=\"text-align: justify;\">\u0130yonla\u015ft\u0131r\u0131c\u0131 radyasyonla te\u015fhis, tedavi veya ara\u015ft\u0131rman\u0131n yap\u0131ld\u0131\u011f\u0131 yerlerde \u00e7al\u0131\u015fan personel i\u00e7in haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi 35 saat olacak. Bu s\u00fcre i\u00e7inde Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131nca \u00e7\u0131kar\u0131lacak y\u00f6netmelikte belirtilen radyasyon dozu, limitleri ayr\u0131ca dikkate al\u0131nacak.<\/p>\n<p style=\"text-align: justify;\"><strong><em>N\u00f6bet \u00fccretleri <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Yatakl\u0131 tedavi kurumlar\u0131, seyyar hastaneler, a\u011f\u0131z ve di\u015f sa\u011fl\u0131\u011f\u0131 merkezleri ve 112 acil sa\u011fl\u0131k hizmetlerinde, haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi d\u0131\u015f\u0131nda normal, acil veya bran\u015f n\u00f6beti tutan, ancak bu n\u00f6bet kar\u015f\u0131l\u0131\u011f\u0131nda kurumunca izin kullanmas\u0131na m\u00fcsaade edilmeyen memurlar ile s\u00f6zle\u015fmeli personele, izin suretiyle kar\u015f\u0131lanamayan her bir n\u00f6bet saati i\u00e7in (n\u00f6bet s\u00fcresi kesintisiz 6 saatten az olmamak \u00fczere) \u00fccret \u00f6denecek. \u00dccretler, kanunda haz\u0131rlanan g\u00f6sterge rakamlar\u0131n\u0131n, ayl\u0131k katsay\u0131s\u0131 ile \u00e7arp\u0131lmas\u0131yla hesaplanacak.<\/p>\n<p style=\"text-align: justify;\">Ancak ayda 130 saatten fazla \u00e7al\u0131\u015fma s\u00fcresi i\u00e7in \u00f6deme yap\u0131lmayacak. \u00dccretler, damga vergisi hari\u00e7 herhangi bir vergi ve kesintiye tabi tutulmayacak.<\/p>\n<p style=\"text-align: justify;\">\u0130cap n\u00f6beti tutan ancak kar\u015f\u0131l\u0131\u011f\u0131nda kurumunca izin kullanmas\u0131na izin verilmeyen memurlar ile s\u00f6zle\u015fmeli personele, her bir icap n\u00f6beti saati i\u00e7in, -icap n\u00f6beti s\u00fcresi kesintisiz 12 saatten az olmamak \u00fczere- ayn\u0131 \u00fccretin y\u00fczde 40&#8217;\u0131 tutar\u0131nda n\u00f6bet \u00fccreti \u00f6denecek.<\/p>\n<p style=\"text-align: justify;\">Bu \u015fekilde \u00fccretlendirilebilecek toplam icap n\u00f6betinin s\u00fcresi, ayl\u0131k 120 saati ge\u00e7emeyecek. \u00d6demeler, d\u00f6ner sermayesi bulunan kurumlarda d\u00f6ner sermaye b\u00fct\u00e7esinden kar\u015f\u0131lanacak. Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131 ile \u00fcniversitelerin ilgili birimleri, Bakanl\u0131k ve \u00fcniversitelerce kar\u015f\u0131l\u0131kl\u0131 olarak i\u015fbirli\u011fi \u00e7er\u00e7evesinde, birlikte kullan\u0131labilecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>TSK kadrolar\u0131nda bulunanlar <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">T\u00fcrk Silahl\u0131 Kuvvetleri kadrolar\u0131nda bulunan personelden, r\u00fctbelerine g\u00f6re, \u00f6\u011fretim \u00fcyesi tabip, \u00f6\u011fretim \u00fcyesi di\u015f tabibi, uzman tabip, uzman di\u015f tabibi, tabip, di\u015f tabibi ve t\u0131pta uzmanl\u0131k mevzuat\u0131ndaki dallarda, bu mevzuat h\u00fck\u00fcmlerine g\u00f6re uzman olanlara, kanunda belirtilen oranlar\u0131 ge\u00e7memek \u00fczere, orgeneral ayl\u0131\u011f\u0131n\u0131n br\u00fct tutar\u0131 ile \u00e7arp\u0131m\u0131 sonucu bulunan miktarda sa\u011fl\u0131k hizmetleri tazminat\u0131 ayr\u0131ca \u00f6denecek.<\/p>\n<p style=\"text-align: justify;\">T\u00fcrk Silahl\u0131 Kuvvetleri kadrolar\u0131nda g\u00f6revli sivil \u00f6\u011fretim \u00fcyesi tabipler ile Devlet Memurlar\u0131 Kanunu&#8217;na tabi olarak g\u00f6rev yapan uzman tabip, uzman di\u015f tabibi, tabip ve di\u015f tabiplerine de kanunda belirtilen oranlar\u0131 ge\u00e7memek \u00fczere, en y\u00fcksek devlet memuru ayl\u0131\u011f\u0131n\u0131n, br\u00fct tutar\u0131 ile \u00e7arp\u0131m\u0131 sonucu bulunan miktarda sa\u011fl\u0131k hizmetleri tazminat\u0131 ayr\u0131ca \u00f6denecek.<\/p>\n<p style=\"text-align: justify;\">Sa\u011fl\u0131k hizmetleri tazminat\u0131n\u0131n oranlar\u0131 ile usul ve esaslar\u0131; personelin r\u00fctbesi, unvan\u0131, g\u00f6revi, \u00e7al\u0131\u015fma \u015fartlar\u0131 ve s\u00fcresi, g\u00f6rev yeri ve \u00f6zellikleri, e\u011fitim-\u00f6\u011fretim ve ara\u015ft\u0131rma faaliyetleri, mesleki uygulamalar\u0131 ile \u00f6zellik arz eden riskli b\u00f6l\u00fcmlerde \u00e7al\u0131\u015fma gibi hizmete katk\u0131 unsurlar\u0131 esas al\u0131narak, Maliye Bakanl\u0131\u011f\u0131n\u0131n g\u00f6r\u00fc\u015f\u00fc, Genelkurmay Ba\u015fkanl\u0131\u011f\u0131n\u0131n uygun g\u00f6r\u00fc\u015f\u00fcyle Milli Savunma Bakanl\u0131\u011f\u0131nca belirlenecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>TSK&#8217;n\u0131n sa\u011fl\u0131k personeli ihtiyac\u0131 <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">G\u00fclhane Askeri T\u0131p Akademisi Komutanl\u0131\u011f\u0131na ba\u011fl\u0131 e\u011fitim hastaneleri ile askeri t\u0131p fak\u00fcltesinde \u00f6\u011fretim \u00fcyesi veya tabip ihtiyac\u0131 do\u011fmas\u0131 halinde, TSK Sa\u011fl\u0131k Komutanl\u0131\u011f\u0131n\u0131n talebi \u00fczerine, Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 ve Y\u00fcksek \u00d6\u011fretim Kurulu taraf\u0131ndan \u00f6ncelikli olarak g\u00f6revlendirme yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">TSK&#8217;ya ba\u011fl\u0131 sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131nda ihtiya\u00e7 duyulmas\u0131 ve TSK Sa\u011fl\u0131k Komutanl\u0131\u011f\u0131n\u0131n talep etmesi halinde, Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 kurum ve kurulu\u015flarda veya \u00fcniversite hastanelerinde g\u00f6revli \u00f6\u011fretim \u00fcyeleri ile di\u011fer sa\u011fl\u0131k personeli, haftan\u0131n belirli g\u00fcn veya saatlerinde ya da belirli vakalar ve i\u015fler i\u00e7in, Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 veya Y\u00fcksek \u00d6\u011fretim Kurulu taraf\u0131ndan g\u00f6revlendirilecek.<\/p>\n<p style=\"text-align: justify;\">Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131nda vekaleten atama ve g\u00f6revlendirilenler ile kanunun ilgili maddesince ek \u00f6deme alanlar hari\u00e7, d\u00f6ner sermaye gelirlerinden ek \u00f6deme alanlar, tabip ve di\u015f tabipleri ile uzmanlar; sigorta priminin i\u015fveren pay\u0131 da dahil tamam\u0131n\u0131 \u00f6deyerek, malull\u00fck, ya\u015fl\u0131l\u0131k ve \u00f6l\u00fcm sigortas\u0131yla s\u0131n\u0131rl\u0131 olmak kayd\u0131yla ilave olarak sigorta primine tabi tutulacak.<\/p>\n<p style=\"text-align: justify;\">Kanun, ilave prim \u00f6demesinde bulunanlardan, malull\u00fck, ya\u015fl\u0131l\u0131k, vazife malull\u00fc\u011f\u00fc, emeklilik ayl\u0131\u011f\u0131 ya da s\u00fcrekli tam i\u015f g\u00f6remezlik geliri ba\u011flanmas\u0131na hak kazananlara verilecek ilave ayl\u0131k \u00f6demesini de d\u00fczenliyor.<\/p>\n<p style=\"text-align: justify;\">Bu ki\u015filere; ilave olarak \u00f6dedikleri her y\u0131la ait sigorta prim matrah\u0131n\u0131n, kazanc\u0131n ait oldu\u011fu y\u0131ldan itibaren s\u00f6z konusu ayl\u0131k veya geliri talep etti\u011fi tarihe kadar ge\u00e7en y\u0131llar i\u00e7in her y\u0131l ger\u00e7ekle\u015fen g\u00fcncelleme katsay\u0131s\u0131 ile g\u00fcncellenerek bulunan kazan\u00e7lar toplam\u0131n\u0131n, ilave prim \u00f6dedikleri g\u00fcn say\u0131s\u0131na b\u00f6l\u00fcnmesi sonucu bulunacak ortalama g\u00fcnl\u00fck kazanc\u0131n 30 kat\u0131n\u0131n, ilave prim \u00f6dedikleri g\u00fcn say\u0131s\u0131n\u0131n her 360 g\u00fcn\u00fc i\u00e7in y\u00fczde 2&#8217;si oran\u0131nda bulunacak tutarda ilave ayl\u0131k \u00f6denecek.<\/p>\n<p style=\"text-align: justify;\">Kamu kurum ve kurulu\u015flar\u0131nda memur stat\u00fcs\u00fcnde \u00e7al\u0131\u015f\u0131rken, 26 May\u0131s 1995 ile 1 Ocak 2010 tarihleri aras\u0131nda g\u00f6revinden \u00e7ekilen, \u00e7ekilmi\u015f say\u0131lan tabip, di\u015f tabibi, uzman tabip ve uzman olanlar, kanunun yay\u0131m\u0131ndan itibaren 6 ay i\u00e7inde ba\u015fvururlarsa, g\u00f6revden ayr\u0131ld\u0131klar\u0131 ildeki Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131na ait kurum ve kurulu\u015flara a\u00e7\u0131ktan atanabilecek.<\/p>\n<p style=\"text-align: justify;\">Bu yerlerde ihtiya\u00e7 olmamas\u0131 halinde, atamalar, ihtiya\u00e7 olan yerlere yap\u0131lacak. Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n tabip, uzman tabipler ve di\u015f tabipleri, a\u00e7\u0131ktan atanabilecekler.<\/p>\n<p style=\"text-align: justify;\"><strong><em>Hudut ve sahillerde \u00e7al\u0131\u015fanlara ek \u00f6deme <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Hudut ve Sahiller Sa\u011fl\u0131k Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde \u00e7al\u0131\u015fan memurlar ile s\u00f6zle\u015fmeli personelden ta\u015fra te\u015fkilat\u0131nda g\u00f6rev yapan tabipler i\u00e7in ek g\u00f6sterge dahil, en y\u00fcksek devlet memuru ayl\u0131\u011f\u0131n\u0131n y\u00fczde 400&#8217;\u00fcn\u00fc, merkez ve ta\u015fra te\u015fkilat\u0131nda g\u00f6rev yapan di\u011fer personele y\u00fczde 200&#8217;\u00fcn\u00fc ge\u00e7memek \u00fczere ek \u00f6deme yap\u0131labilecek.<\/p>\n<p style=\"text-align: justify;\">Ek \u00f6demenin oran\u0131 ile usul ve esaslar\u0131; g\u00f6rev yap\u0131lan birim ve i\u015f hacmi, g\u00f6revin \u00f6nem ve g\u00fc\u00e7l\u00fc\u011f\u00fc, \u00e7al\u0131\u015fma s\u00fcresi, personelin s\u0131n\u0131f\u0131, kadro unvan\u0131, derecesi ve atanma bi\u00e7imi gibi kriterler ile personele ayl\u0131k ve \u00f6zl\u00fck haklar\u0131 d\u0131\u015f\u0131nda ilgili mevzuat\u0131na g\u00f6re yap\u0131lan di\u011fer ilave \u00f6demeler dikkate al\u0131nmak suretiyle Maliye Bakanl\u0131\u011f\u0131n\u0131n uygun g\u00f6r\u00fc\u015f\u00fc \u00fczerine Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131nca belirlenecek.<\/p>\n<p style=\"text-align: justify;\">Bu \u00f6demelerden damga vergisi hari\u00e7, herhangi bir vergi kesilmeyecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>K\u0131z\u0131lay&#8217;\u0131n hastaneleri<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">T\u00fcrkiye K\u0131z\u0131lay Derne\u011fine (K\u0131z\u0131lay) ait, 1 May\u0131s 2009 tarihi itibar\u0131yla ruhsatl\u0131 olarak i\u015fletilmekte bulunan hastane ve t\u0131p merkezleri, bu Kanunun yay\u0131m\u0131ndan itibaren 6 ay i\u00e7erisinde Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 ile K\u0131z\u0131lay aras\u0131nda yap\u0131lacak protokolle Bakanl\u0131\u011fa devredilecek.<\/p>\n<p style=\"text-align: justify;\">Bu kurumlarda, 1 May\u0131s 2009 tarihi itibar\u0131yla i\u015f s\u00f6zle\u015fmesine ba\u011fl\u0131 olarak \u00e7al\u0131\u015fmakta olan Devlet Memurlar\u0131 Kanununda \u00f6ng\u00f6r\u00fclen genel ve ilgili kadro veya pozisyon i\u00e7in \u00f6ng\u00f6r\u00fclen \u00f6zel \u015fartlar\u0131 ta\u015f\u0131yan personelden; tabipler ve di\u015f tabipleri, istekleri halinde \u00e7al\u0131\u015fmakta olduklar\u0131 ildeki ihtiya\u00e7 bulunan sa\u011fl\u0131k kurum veya kurulu\u015flar\u0131n\u0131n memur kadrolar\u0131na atanacak.<\/p>\n<p style=\"text-align: justify;\">Tabipler ve di\u015f tabipleri d\u0131\u015f\u0131ndaki di\u011fer personel, istekleri halinde, yapt\u0131klar\u0131 i\u015f, e\u011fitim durumu ve bulunduklar\u0131 pozisyon dikkate al\u0131narak Devlet Personel Ba\u015fkanl\u0131\u011f\u0131n\u0131n g\u00f6r\u00fc\u015f\u00fc \u00fczerine, Maliye Bakanl\u0131\u011f\u0131n\u0131n izni ile \u00e7al\u0131\u015fmakta olduklar\u0131 ildeki sa\u011fl\u0131k kurum veya kurulu\u015flar\u0131nda Bakanl\u0131k veya d\u00f6ner sermaye te\u015fkilat\u0131 ad\u0131na vizelenecek pozisyonlarda istihdam edilecek.<\/p>\n<p style=\"text-align: justify;\">Bu ki\u015filer, s\u00f6zle\u015fmeli personel stat\u00fcs\u00fcne ge\u00e7irilecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>Personel say\u0131s\u0131 bin 375 ki\u015fiyi ge\u00e7meyecek <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Bu \u015fekilde istihdam edilecek toplam tabip say\u0131s\u0131 180&#8217;i, sa\u011fl\u0131k personeli say\u0131s\u0131 490&#8217;\u0131 ve di\u011fer personel say\u0131s\u0131 705&#8217;i ge\u00e7emeyecek.<\/p>\n<p style=\"text-align: justify;\">Kadro ve pozisyonlara atanma ve ge\u00e7irilmede, i\u015f s\u00f6zle\u015fmeleri ask\u0131da bulunanlar, tam zamanl\u0131 \u00e7al\u0131\u015fanlar ile emeklilik veya ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131 kesilmek suretiyle \u00e7al\u0131\u015fanlar dahil herhangi bir sosyal g\u00fcvenlik kurumundan emeklilik veya ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131 ba\u011flanmam\u0131\u015f olanlar dikkate al\u0131nacak. \u0130\u015flemler, sa\u011fl\u0131k kurulu\u015funun devir tarihini m\u00fcteakip 6 ay i\u00e7erisinde tamamlanacak.<\/p>\n<p style=\"text-align: justify;\">Personele, memur ve s\u00f6zle\u015fmeli personel stat\u00fcs\u00fcne ge\u00e7irilmeleri nedeniyle, i\u015f mevzuat\u0131na g\u00f6re Bakanl\u0131k veya K\u0131z\u0131lay taraf\u0131ndan herhangi bir tazminat \u00f6denmeyecek. Kullanmad\u0131klar\u0131 y\u0131ll\u0131k \u00fccretli izin s\u00fcreleri i\u00e7in herhangi bir \u00f6deme yap\u0131lmayacak.<\/p>\n<p style=\"text-align: justify;\">Personelin emekli ikramiyesi veya i\u015f sonu tazminat\u0131n\u0131n hesab\u0131na dahil edilecek hizmet s\u00fcrelerinden kaynaklanan ilave maliyetin finansman\u0131na kar\u015f\u0131l\u0131k olmak \u00fczere, devir tarihi itibariyle ilgililerin atand\u0131klar\u0131 kadro unvan\u0131 ile derecesi ve kademesi veya ge\u00e7irildikleri s\u00f6zle\u015fmeli personel pozisyonlar\u0131n\u0131n unvan\u0131 ve hizmet s\u00fcreleri esas al\u0131narak hesaplanacak emekli ikramiyesi veya i\u015f sonu tazminat\u0131 toplam tutar\u0131, 5 y\u0131l i\u00e7erisinde 5 e\u015fit taksitte K\u0131z\u0131lay taraf\u0131ndan Bakanl\u0131\u011f\u0131n d\u00f6ner sermayesine \u00f6denecek veya devredilen sa\u011fl\u0131k kurulu\u015flar\u0131na ait ta\u015f\u0131n\u0131r bedelleri ile devredilen sa\u011fl\u0131k kurulu\u015flar\u0131n\u0131n bulundu\u011fu K\u0131z\u0131lay&#8217;a ait ta\u015f\u0131nmazlar\u0131n kiralanmas\u0131 halinde kira alaca\u011f\u0131ndan mahsubu yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\"><strong><em>Komisyon olu\u015fturulacak <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131na devredilen sa\u011fl\u0131k kurulu\u015flar\u0131na ait ta\u015f\u0131n\u0131rlardan Bakanl\u0131k\u00e7a devral\u0131nacaklar ile bunlar\u0131n bedeli, Maliye Bakanl\u0131\u011f\u0131 temsilcisinin koordinat\u00f6rl\u00fc\u011f\u00fcnde, Bakanl\u0131k ve K\u0131z\u0131lay temsilcilerinden olu\u015facak 3 ki\u015filik komisyonlar taraf\u0131ndan tespit edilecek.<\/p>\n<p style=\"text-align: justify;\">Tespit edilen tutar, Bakanl\u0131k\u00e7a belirlenecek sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131n\u0131n d\u00f6ner sermaye gelirlerinden kar\u015f\u0131lanacak. Komisyonlar, bedel tespit ederken gerekti\u011finde meslek kurulu\u015flar\u0131ndan veya bilirki\u015filerden yararlanabilecek.<\/p>\n<p style=\"text-align: justify;\">Kanunun baz\u0131 maddelerinin uygulanmas\u0131na ge\u00e7i\u015f s\u00fcreci konuldu. Yasa, tam g\u00fcn \u00e7al\u0131\u015fma a\u00e7\u0131s\u0131ndan, \u00fcniversite hastanelerinde bir y\u0131l, Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 hastanelerinde ise 6 ay sonra y\u00fcr\u00fcrl\u00fc\u011fe girecek.<\/p>\n<p style=\"text-align: justify;\"><strong><em>Recep Akda\u011f: &#8220;Tarihi bir i\u015f yapt\u0131k&#8221; <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Sa\u011fl\u0131k Bakan\u0131 Recep Akda\u011f, &#8220;Tam G\u00fcn Tasar\u0131s\u0131&#8221;n\u0131n yasala\u015fmas\u0131yla &#8220;Tarihi bir i\u015f yap\u0131ld\u0131\u011f\u0131n\u0131&#8221; s\u00f6yledi.<\/p>\n<p style=\"text-align: justify;\">Tasar\u0131n\u0131n yasala\u015fmas\u0131 \u00fczerine te\u015fekk\u00fcr konu\u015fmas\u0131 yapan Akda\u011f, T\u00fcrk halk\u0131n\u0131n sa\u011fl\u0131k hizmetine kolay ula\u015fmas\u0131 i\u00e7in kanunun yap\u0131ld\u0131\u011f\u0131n\u0131 belirterek, &#8220;\u0130nan\u0131yorum ki tarih bu i\u015fi hay\u0131rla yad edecektir&#8221; diye konu\u015ftu.<\/p>\n<p style=\"text-align: justify;\">Kanunun bir taraftan vatanda\u015f\u0131n sa\u011fl\u0131k hizmetine daha kolay ula\u015fmas\u0131n\u0131 sa\u011flad\u0131\u011f\u0131n\u0131, di\u011fer taraftan sa\u011fl\u0131k \u00e7al\u0131\u015fanlar\u0131na bir\u00e7ok haklar getirdi\u011fini kaydeden Akda\u011f, sa\u011fl\u0131k \u00e7al\u0131\u015fanlar\u0131n\u0131n seyyanen ald\u0131klar\u0131 ayl\u0131k gelirler, ek \u00f6deme \u00fcst limitleri ve n\u00f6bet \u00fccretlerinin art\u0131r\u0131ld\u0131\u011f\u0131n\u0131 ifade etti.<\/p>\n<p style=\"text-align: justify;\">Mesleki zorunluluk sigortas\u0131 da getirildi\u011fini vurgulayan Akda\u011f, halen muayenehane \u00e7al\u0131\u015ft\u0131ran Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 hastaneleri hekimlerine 6 ay, \u00fcniversite hastaneleri hekimlerine ise 1 y\u0131l ge\u00e7i\u015f s\u00fcreci tan\u0131nd\u0131\u011f\u0131n\u0131 kaydetti.<\/p>\n<p style=\"text-align: justify;\">Tunceli Ba\u011f\u0131ms\u0131z Milletvekili Kamer Gen\u00e7&#8217;in \u0130stanbul \u0130l Sa\u011fl\u0131k M\u00fcd\u00fcr\u00fc Do\u00e7. Dr. Ali \u0130hsan Dokucu&#8217;nun \u015ei\u015fli E\u011fitim-Ara\u015ft\u0131rma Hastanesi Ba\u015fhekimi iken yapt\u0131\u011f\u0131 bir ameliyata namaz i\u00e7in ara verdi\u011fi y\u00f6n\u00fcndeki s\u00f6zlerine de\u011finen Akda\u011f, Dokucu&#8217;nun b\u00fct\u00fcn cerrahlar\u0131n yapt\u0131\u011f\u0131 gibi \u00e7ok uzun ameliyat s\u0131ras\u0131nda mola verdi\u011fini, bunun hastan\u0131n s\u0131hhati i\u00e7in gerekli oldu\u011funu s\u00f6yledi.<\/p>\n<p style=\"text-align: justify;\">Akda\u011f, &#8220;Bir ger\u00e7e\u011fin teslimi a\u00e7\u0131s\u0131ndan bunu ifade etmem gerekir&#8221; dedi.
