Bu arsa toplam 3 bin 62 metrekare. \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi&#8217;ne ait bu arsa 1997 y\u0131l\u0131nda ihaleyle sat\u0131ld\u0131. 11 Mart 1997 tarihli &#8220;\u0130hale Onay F\u00f6y\u00fc&#8221; ndeki ifadelere g\u00f6re arsay\u0131 Erem Uluslararas\u0131 Tan\u0131t\u0131m toplam 596 milyar 646 bin TL bedel ile ald\u0131. Enc\u00fcmen ise ihaleyi 8 Nisan 1997 tarihinde onad\u0131. Bu belgelerin alt\u0131nda ise d\u00f6nemin \u0130BB Ba\u015fkan\u0131 Erdo\u011fan&#8217;\u0131n imzas\u0131 bulunuyor. Arsay\u0131 alan \u015firketin ortaklar\u0131 incelendi\u011finde ise kar\u015f\u0131m\u0131za Erem ailesi \u00e7\u0131k\u0131yor. \u015eirketin hissedarlar\u0131 Mustafa \u00d6zhan Erem ve Ahmet \u0130lhan Erem. Ticaret Sicil Gazetesi kay\u0131tlar\u0131na g\u00f6re 2006 y\u0131l\u0131nda Ahmet \u0130lhan Erem 18 ya\u015f\u0131n\u0131 doldurmad\u0131\u011f\u0131 i\u00e7in annesi Ceyda Zeliha Erem taraf\u0131ndan temsil ediliyor. Ceyda Erem ise T\u00fcrkiye&#8217;de fuarlar krali\u00e7esi olarak biliniyor.<\/p>\n<p style=\"text-align: justify;\"><strong>Sonra ye\u015fil alan oldu<\/strong><\/p>\n<p style=\"text-align: justify;\">Bu sat\u0131\u015f yap\u0131ld\u0131\u011f\u0131nda arsan\u0131n imar plan\u0131 2.5 emsal in\u015faat alan\u0131na, 0,25 TAKS oran\u0131na sahipti. Ancak 22 Temmuz 2002 tarihinde \u0130BB taraf\u0131ndan b\u00f6lgesel imar plan\u0131 haz\u0131rland\u0131 ve 30-31-32-34 parselden, 30-31-34 parseller ye\u015fil alan i\u00e7ine al\u0131nd\u0131. Sadece 32. parsel ye\u015fil alan d\u0131\u015f\u0131nda tutuldu. Arsa sahibi taraf\u0131ndan hemen bu tadilata itiraz edildi ve konu mahkemeye ta\u015f\u0131nd\u0131. \u0130stanbul 3. \u0130dare Mahkemesi 26 \u015eubat 2004 tarihinde, 2002\/1784 say\u0131l\u0131 esas karar\u0131 ile davac\u0131lar\u0131 hakl\u0131 buldu ve imar tadilat\u0131n\u0131 iptal etti. Bu tarihten sonra arsa &#8216;plans\u0131z&#8217; kald\u0131.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130mar tadilat\u0131 ba\u015flad\u0131<\/strong><\/p>\n<p style=\"text-align: justify;\">Arsa plans\u0131z kal\u0131nca Aral\u0131k 2004&#8217;te arsa sahipleri \u0130BB&#8217;nin kap\u0131s\u0131n\u0131 \u00e7ald\u0131. Arsa i\u00e7in 3 emsal, TAKS: 0,25, h: max istendi. Ayr\u0131ca s\u00f6z konusu parselin ticaret + hizmet + konut alan\u0131 olarak i\u015flenmesini talep etti. Bu talepler, 18 Mart 2005 tarihinde \u0130BB B\u00fcy\u00fck\u015fehir Belediye Meclisi&#8217;nde g\u00f6r\u00fc\u015f\u00fcld\u00fc. Talep edilen 3 emsal, 2.5 oran\u0131na d\u00fc\u015f\u00fcr\u00fcld\u00fc. Emsalde bu azaltma yap\u0131l\u0131rken bodrum katlar\u0131n emsal d\u0131\u015f\u0131 kalaca\u011f\u0131 notu eklendi. Ayr\u0131ca kot fark\u0131n\u0131n bulunan yerler de emsal d\u0131\u015f\u0131 b\u0131rak\u0131ld\u0131 ve ortalama y\u00fckseklikten hesaplanmas\u0131na karar verildi. Bu de\u011fi\u015fiklik \u0130BB Meclisi&#8217;nden oy birli\u011fi ile ge\u00e7ti. Yani hi\u00e7bir meclis \u00fcyesi, ba\u015fta da CHP&#8217;li hi\u00e7bir \u00fcye itiraz etmedi.<\/p>\n<p style=\"text-align: justify;\"><strong>Ba\u015fbakan&#8217;\u0131n arkada\u015f\u0131 ortak<\/strong><\/p>\n<p style=\"text-align: justify;\">1\/5 binlik ge\u00e7tikten sonra s\u0131ra 1\/binlik \u0130mar Uygulama Plan\u0131&#8217;na s\u0131ra geldi. Ancak bu a\u015famada arsan\u0131n sahipli\u011fi de\u011fi\u015fti. 1\/5 binlik Naz\u0131m \u0130mar Plan\u0131n\u0131n ge\u00e7mesinden tam 11 g\u00fcn sonra yani 29 Mart 2005 tarihinde Seren \u0130n\u015faat A.\u015e arsay\u0131 toplam 7 milyon 35 bin YTL bedel ile Erem Uluslararas\u0131 Tan\u0131t\u0131m Ltd&#8217;den sat\u0131n ald\u0131. \u015eirketin ortaklar\u0131 aras\u0131nda ise tan\u0131d\u0131k bir isim var: Mehmet Emin Erkan. Erdo\u011fan&#8217;\u0131n \u0130stanbul \u0130mam Hatip Lisesi&#8217;nden arkada\u015f\u0131 olan Erkan, ayr\u0131ca 5 milyar dolarl\u0131k Zeytinburnu Yat Liman\u0131, di\u011fer ad\u0131yla Zeyport&#8217;un ortaklar\u0131 aras\u0131nda. \u015eirket merkezi olarak g\u00f6sterilen \u00c7aml\u0131ca Konaklar\u0131 ise orta\u011f\u0131 oldu\u011fu Erkan \u0130n\u015faat taraf\u0131ndan yap\u0131ld\u0131. Villa tipi sitenin sakinlerinden biri de Maliye Bakan\u0131 Kemal Unak\u0131tan&#8217;\u0131n o\u011flu Abdullah Unak\u0131tan. Seren \u0130n\u015faat&#8217;\u0131n di\u011fer ortaklar\u0131 ise i\u015fadam\u0131 Erol Kohen&#8217;in e\u015fi Sandra Kohen ve Erkan&#8217;\u0131n karde\u015fi Mahmut Erkan.<\/p>\n<p style=\"text-align: justify;\"><strong>S\u00f6zle\u015fmeler imzaland\u0131<\/strong><\/p>\n<p style=\"text-align: justify;\">Arsay\u0131 bu \u015firket ald\u0131ktan sonra 1\/binlik uygulama imar planlar\u0131 da h\u0131zl\u0131 bir \u015fekilde \u00e7\u0131kar\u0131ld\u0131. \u00d6nce 8 Temmuz 2005 tarihinde Be\u015fikta\u015f Belediye Meclisi taraf\u0131ndan imar tadilat\u0131 teklifi kabul edildi. Teklif hi\u00e7bir ret oyu almadan oybirli\u011fi ile Be\u015fikta\u015f Belediye Meclisi&#8217;nden ge\u00e7ti ve \u0130BB yolunu tuttu. 1\/ binlik imar uygulama plan\u0131 16 Eyl\u00fcl 2005 tarihinde \u0130BB Meclisi&#8217;ne geldi. 2060 nolu karar yine oy birli\u011fi ile yani tek bir ret oyu almadan \u0130BB Meclisi taraf\u0131ndan onand\u0131.<\/p>\n<p style=\"text-align: justify;\"><strong>Yar\u0131 yar\u0131ya ortakl\u0131k <\/strong><\/p>\n<p style=\"text-align: justify;\">SEREN \u0130n\u015faat, m\u00fcteahhit firma A\u015f\u00e7\u0131o\u011flu \u0130n\u015faat ile &#8220;Gayrimenkul Sat\u0131\u015f Vaadi ve Arsa Pay\u0131 Karl\u0131\u011f\u0131nda \u0130n\u015faat ve Has\u0131lat Payla\u015f\u0131m&#8217; s\u00f6zle\u015fmesi imzalad\u0131. S\u00f6zle\u015fme 22 Temmuz 2005 tarihinde, Beyo\u011flu 31. Noteri, Erkan \u0130n\u015faat&#8217;\u0131n merkezi olarak kullan\u0131lan \u00c7aml\u0131ca Evleri No:13&#8217;e \u00e7a\u011fr\u0131ld\u0131. S\u00f6zle\u015fmeye Seren \u0130n\u015faat ad\u0131na Sandra Kohen, A\u015f\u00e7\u0131o\u011flu \u0130n\u015faat ad\u0131na da Ya\u015far A\u015f\u00e7\u0131o\u011flu imza att\u0131. Noter kay\u0131tlar\u0131na bu s\u00f6zle\u015fme 40879 numara ile i\u015flendi. S\u00f6zle\u015fme, arsa sahibi ve m\u00fcteahhit aras\u0131nda, y\u00fczde 50 oran\u0131 m\u00fcteahhide, y\u00fczde 50 oran\u0131 ise arsa sahibine verilmek \u015fart\u0131yla has\u0131lat payla\u015f\u0131m esas\u0131na g\u00f6re yap\u0131ld\u0131. 13 maddeden olu\u015fan s\u00f6zle\u015fmede sat\u0131\u015f ve pazarlaman\u0131n m\u00fcteahhit taraf\u0131ndan yap\u0131laca\u011f\u0131 ve pe\u015finatlar ise senetlerin y\u00fczde 50&#8217;sinin arsa sahibine derhal verilece\u011fi belirtiliyor. Vadeli \u00f6demelerin ise in\u015faat\u0131n bitim s\u00fcresini 6 ay ge\u00e7emeyece\u011finin alt\u0131 \u00e7iziliyor. Projenin 30 ay i\u00e7inde bitirilme \u015fart\u0131 yine maddelere konuyor.
