Takdir onlar\u0131nd\u0131r\u201d dedi.<\/p>\n<p style=\"text-align: justify;\">ANKARA &#8211; Anayasa Mahkemesi Ba\u015fkan\u0131 Ha\u015fim K\u0131l\u0131\u00e7, Anayasa Mahkemesiyle ilgili de\u011fi\u015fiklikler veya \u00f6ng\u00f6r\u00fclen imkanlar\u0131n tamamen parlamentonun takdiriyle \u015fekillendi\u011fini belirterek, &#8221;S\u00f6z konusu takdirin baz\u0131 milletvekillerinin burada tekrarlamaktan utan\u00e7 duydu\u011fum s\u00f6zc\u00fcklerle yapt\u0131klar\u0131 de\u011ferlendirmeleri \u015fiddetle reddediyoruz. K\u00fcrs\u00fc dokunulmazl\u0131\u011f\u0131n\u0131n imkanlar\u0131ndan faydalanarak ahlaki ve hukuki temelden yoksun ithamlarla mahkemeyi kirletmeye kimsenin hakk\u0131 yoktur&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesinin kurulu\u015funun 49. y\u0131l d\u00f6n\u00fcm\u00fc dolay\u0131s\u0131yla Anayasa Mahkemesi binas\u0131nda t\u00f6ren d\u00fczenlendi. T\u00f6rene, Cumhurba\u015fkan\u0131 Abdullah G\u00fcl, TBMM Ba\u015fkan\u0131 Mehmet Ali \u015eahin, Ba\u015fbakan Recep Tayyip Erdo\u011fan, baz\u0131 bakanlar, Ankara Valisi Alaaddin Y\u00fcksel, Ankara B\u00fcy\u00fck\u015fehir Belediye Ba\u015fkan\u0131 Melih G\u00f6k\u00e7ek, Y\u00fcksek\u00f6\u011fretim Kurulu Ba\u015fkan\u0131 Yusuf Ziya \u00d6zcan ve baz\u0131 y\u00fcksek yarg\u0131 \u00fcyeleri kat\u0131l\u0131rken Yarg\u0131tay ve Dan\u0131ytay \u00fcst d\u00fczeyinden kat\u0131l\u0131m olmad\u0131.<\/p>\n<p style=\"text-align: justify;\">Konuklar\u0131 Anayasa Mahkemesi Ba\u015fkan\u0131 Ha\u015fim K\u0131l\u0131\u00e7 ve Anayasa Mahkemesi Ba\u015fkanvekili Serruh Kaleli kap\u0131da kar\u015f\u0131lad\u0131. K\u0131l\u0131\u00e7, t\u00f6rende yapt\u0131\u011f\u0131 konu\u015fmada, 12 Eyl\u00fcl 2010&#8217;da yap\u0131lan referandum sonucu kabul edilen anayasa de\u011fi\u015fiklikleriyle Anayasa Mahkemesinde de yap\u0131sal ve fonksiyonel anlamda \u00e7ok \u00f6nemli de\u011fi\u015fiklikler yap\u0131ld\u0131\u011f\u0131n\u0131 s\u00f6yledi.<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7, d\u00fcnyada hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkin yeni bak\u0131\u015flar\u0131n, demokratik geli\u015fmelerin, dayatmac\u0131 anlay\u0131\u015flardan bunalan halk\u0131n bundan kurtulma aray\u0131\u015flar\u0131n\u0131n ve t\u00fcm bu geli\u015fmelere kay\u0131ts\u0131z kalan yarg\u0131sal direncin anayasa de\u011fi\u015fikliklerinin zorunlu sebepleri aras\u0131nda say\u0131labilece\u011fini ifade etti. Yarg\u0131da ya\u015fanan olumsuzluklara \u00e7\u00f6z\u00fcm bulunmas\u0131 i\u00e7in yap\u0131lan de\u011fi\u015fikliklerin yeni sorunlar\u0131n ortaya \u00e7\u0131kmas\u0131na neden olmamas\u0131n\u0131 dileyen K\u0131l\u0131\u00e7, \u015f\u00f6yle konu\u015ftu:<\/p>\n<p style=\"text-align: justify;\">&#8221;Her sorunu yasal d\u00fczenlemelerle \u00e7\u00f6zme anlay\u0131\u015f\u0131 d\u00fcnyada en \u00e7ok kanuna sahip olan \u00fclkeler aras\u0131na girmemiz sonucunu do\u011furmu\u015ftur. Demokratik hukuk devleti inanc\u0131 ve gelene\u011fi kimi \u00fclkelerde yaz\u0131l\u0131 anayasa yap\u0131lmas\u0131na dahi ihtiya\u00e7 g\u00f6stermemi\u015ftir. T\u00fcrk hukuk d\u00fcnyas\u0131nda ortaya \u00e7\u0131kan yasa enflasyonunun temelinde yasama organ\u0131 ile yarg\u0131 organlar\u0131 aras\u0131ndaki g\u00fcvensizli\u011fe dayal\u0131 bir m\u00fccadelenin etkileri vard\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bu organlar\u0131n egemenlik anlay\u0131\u015f\u0131nda ortaya \u00e7\u0131kan farkl\u0131 yakla\u015f\u0131mlar g\u00fcvensizli\u011fin ana kayna\u011f\u0131n\u0131 olu\u015fturmaktad\u0131r. Hukuksal metinlerle uygulama aras\u0131ndaki kopukluklar, bilin\u00e7li veya bilin\u00e7siz yap\u0131lan yorumlar sonunda ortaya \u00e7\u0131kan sapmalar sorunlar\u0131 yasayla \u00e7\u00f6zme anlay\u0131\u015f\u0131n\u0131 tetikleyen di\u011fer bir fakt\u00f6rd\u00fcr. \u00c7ok ciddi bilimsel ara\u015ft\u0131rmalara konu olmu\u015f parlamento-yarg\u0131 ili\u015fkisinden do\u011fan sorunlar\u0131 bir kurulu\u015f y\u0131l d\u00f6n\u00fcm\u00fc konu\u015fmas\u0131nda geni\u015f bir \u015fekilde dile getirmenin yersizli\u011fi ve yetersizli\u011fi kar\u015f\u0131s\u0131nda fazla konu\u015fmak istemiyorum.&#8221;<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7, anayasa de\u011fi\u015fiklikleri ile mahkemenin yeniden yap\u0131land\u0131r\u0131lmas\u0131 sonucu yeni g\u00f6rev ve yetki \u00e7er\u00e7evesinde TBMM&#8217;de g\u00f6r\u00fc\u015f\u00fclerek kabul edilen Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun&#8217;un y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fini hat\u0131rlatt\u0131.<\/p>\n<p style=\"text-align: justify;\">Anayasa de\u011fi\u015fikli\u011finden sonra uygulamada ciddi sorunlar ya\u015fayan Anayasa Mahkemesine \u00e7\u00f6z\u00fcm getirenlere yasa hakk\u0131nda olumlu veya olumsuz de\u011ferlendirme yapmadan \u00f6nce te\u015fekk\u00fcr eden K\u0131l\u0131\u00e7, \u015funlar\u0131 kaydetti:<\/p>\n<p style=\"text-align: justify;\">&#8221;Ancak bu yasan\u0131n komisyonlarda ve TBMM&#8217;de g\u00f6r\u00fc\u015f\u00fclmesi a\u015famas\u0131nda baz\u0131 milletvekillerinin mahkememiz ve \u00fcyeleri hakk\u0131nda yapt\u0131\u011f\u0131 de\u011ferlendirmeler \u015fa\u015fk\u0131nl\u0131k ve b\u00fcy\u00fck \u00fcz\u00fcnt\u00fcyle kar\u015f\u0131lanm\u0131\u015ft\u0131r. Mahkememizle ilgili de\u011fi\u015fiklikler veya \u00f6ng\u00f6r\u00fclen imkanlar tamamen parlamentonun takdiriyle \u015fekillenmi\u015ftir. S\u00f6z konusu takdirin baz\u0131 milletvekillerinin burada tekrarlamaktan utan\u00e7 duydu\u011fum s\u00f6zc\u00fcklerle yapt\u0131klar\u0131 de\u011ferlendirmeleri \u015fiddetle reddediyoruz.<\/p>\n<p style=\"text-align: justify;\">K\u00fcrs\u00fc dokunulmazl\u0131\u011f\u0131n\u0131n imkanlar\u0131ndan faydalanarak ahlaki ve hukuki temelden yoksun ithamlarla mahkemeyi kirletmeye kimsenin hakk\u0131 yoktur. Mahkeme \u00fcyelerinin onur ve \u015ferefle y\u00fcr\u00fctt\u00fc\u011f\u00fc g\u00f6rev s\u0131ras\u0131nda verdi\u011fi kararlar\u0131n kimi sevindirdi\u011fini veya \u00fczd\u00fc\u011f\u00fcn\u00fc d\u00fc\u015f\u00fcnmedi\u011fimizi ve ilgilenmedi\u011fimizi herkesin bilmesini isteriz. Dostluk ve husumet duygular\u0131 mahkeme kararlar\u0131n\u0131n y\u00f6nlendiricisi olamaz. Hakaret ve su\u00e7 i\u00e7ermeyen her t\u00fcrl\u00fc ele\u015ftiriyi sayg\u0131yla kar\u015f\u0131l\u0131yor ve korumak durumunda oldu\u011fumuz temel hak ve \u00f6zg\u00fcrl\u00fckler kapsam\u0131nda g\u00f6r\u00fcyoruz.&#8221;<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi Ba\u015fkan\u0131 Ha\u015fim K\u0131l\u0131\u00e7, son g\u00fcnlerde siyasi hayatta meydana gelen olaylar\u0131n Anayasa ile siyasi hayat\u0131 d\u00fczenleyen yasalar\u0131n i\u00e7eri\u011finin ne zaman patlayaca\u011f\u0131 belli olmayan may\u0131nlarla dolu oldu\u011fu ger\u00e7e\u011fini bir kez daha ortaya \u00e7\u0131kard\u0131\u011f\u0131n\u0131 belirterek, &#8221;Sorunlar daha ortaya \u00e7\u0131kmadan anayasa ve yasalardaki siyasi haklar\u0131 etkileyen antidemokratik kurallar\u0131n acilen ortadan kald\u0131r\u0131lmas\u0131, yasama organ\u0131n\u0131n \u00fclke bar\u0131\u015f\u0131na yapaca\u011f\u0131 en hay\u0131rl\u0131 hizmet olacakt\u0131r. Zira uyu\u015fmazl\u0131klar\u0131n do\u011fmas\u0131 ile ortaya \u00e7\u0131kan \u00e7\u00f6z\u00fcm gayretlerinin bedeli a\u011f\u0131r olmaktad\u0131r&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7, Anayasa Mahkemesinin kurulu\u015funun 49. y\u0131l d\u00f6n\u00fcm\u00fc dolay\u0131s\u0131yla d\u00fczenlenen t\u00f6rende yapt\u0131\u011f\u0131 konu\u015fmada, toplumun son y\u0131llarda siyasi, ekonomik, sosyal ve demokratik alanlarda kaydetti\u011fi geli\u015fmelerin \u00fclkeyi koruma ve kollama konusunda ola\u011fan\u00fcst\u00fc kurtar\u0131c\u0131lara y\u00f6nelik \u00e7a\u011fr\u0131 d\u00f6nemini kapatt\u0131\u011f\u0131n\u0131 s\u00f6yledi.<\/p>\n<p style=\"text-align: justify;\">Sorunlar\u0131n art\u0131k demokratik yol ve y\u00f6ntemlerle \u00e7\u00f6z\u00fcld\u00fc\u011f\u00fc bir s\u00fcrecin ya\u015fanmak zorunda olundu\u011funu vurgulayan K\u0131l\u0131\u00e7, T\u00fcrkiye Cumhuriyeti&#8217;nin kimlik belgesi olarak da tan\u0131mlanan Anayasa&#8217;da devletin insan haklar\u0131na dayal\u0131, laik, demokratik, sosyal bir hukuk devleti olarak tan\u0131mland\u0131\u011f\u0131n\u0131 belirtti. K\u0131l\u0131\u00e7, &#8221;Bu ilkelerin evrensel anlamlar\u0131n\u0131n yap\u0131s\u0131 de\u011fi\u015ftirilerek &#8216;bize \u00f6zg\u00fc modeller&#8217; yarat\u0131lmas\u0131 sorunlar\u0131m\u0131z\u0131 \u00e7o\u011faltmaktan ba\u015fka sonu\u00e7 do\u011furmam\u0131\u015ft\u0131r. Bu de\u011ferlerin evrensel orijinall\u0131\u011f\u0131 bozulmadan hayata ge\u00e7irilebilmesi i\u00e7in gerekli olan toplumsal k\u00fclt\u00fcr olu\u015fmu\u015ftur. Art\u0131k bu evrensel ger\u00e7ekler \u00fczerinde uzla\u015fma sa\u011flama imkan ve iradesini ortaya koyabilmeliyiz&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">Siyasi Partiler Kanunu&#8217;nun demokratik devlet s\u00fcrecini do\u011frudan etkileyen siyasi partilerin i\u015fleyi\u015fine ili\u015fkin konulardaki mevcut olumsuzluklar\u0131n ilgililer taraf\u0131ndan her vesile ile dile getirildi\u011fini s\u00f6yleyen K\u0131l\u0131\u00e7, \u015f\u00f6yle devam etti:<\/p>\n<p style=\"text-align: justify;\">&#8221;Ancak, son g\u00fcnlerde siyasi hayatta meydana gelen olaylar, anayasa ile siyasi hayat\u0131 d\u00fczenleyen yasalar\u0131n i\u00e7eri\u011finin ne zaman patlayaca\u011f\u0131 belli olmayan may\u0131nlarla dolu oldu\u011fu ger\u00e7e\u011fini bir kez daha ortaya \u00e7\u0131karm\u0131\u015ft\u0131r. Sorunlar daha ortaya \u00e7\u0131kmadan anayasa ve yasalardaki siyasi haklar\u0131 etkileyen antidemokratik kurallar\u0131n acilen ortadan kald\u0131r\u0131lmas\u0131, yasama organ\u0131n\u0131n \u00fclke bar\u0131\u015f\u0131na yapaca\u011f\u0131 en hay\u0131rl\u0131 hizmet olacakt\u0131r. Zira uyu\u015fmazl\u0131klar\u0131n do\u011fmas\u0131 ile ortaya \u00e7\u0131kan \u00e7\u00f6z\u00fcm gayretlerinin bedeli a\u011f\u0131r olmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Uygulamalardan ya da yasal d\u00fczenlemelerden kaynaklanan olumsuz geli\u015fmeler bahane edilerek toplumun ter\u00f6rize edilmesi, sokaklar\u0131n ve meydanlar\u0131n ya\u015fanmaz hale getirilmesi tarihin hi\u00e7bir d\u00f6neminde sorunlar\u0131 \u00e7\u00f6zmemi\u015ftir. Hak ihlallerine kar\u015f\u0131 ter\u00f6r ve \u015fiddet ba\u011f\u0131 kurulmadan demokratik tepkilerin g\u00f6sterilmesi anayasal bir hak oldu\u011fu kadar bireylerin ya da \u00f6rg\u00fctlerin g\u00f6rev ve sorumluluklar\u0131 kapsam\u0131ndad\u0131r. Dile\u011fimiz sorunlar \u00e7\u00f6z\u00fcl\u00fcrken demokrasi ile ba\u011f\u0131n kopar\u0131lmamas\u0131d\u0131r. Hi\u00e7bir \u00f6zg\u00fcrl\u00fck ter\u00f6r ve \u015fiddetin teminat\u0131 olamaz. Hak ve \u00f6zg\u00fcrl\u00fcklerini kullan\u0131rken ter\u00f6rle ortakl\u0131k kuranlar\u0131n hi\u00e7 kimseden demokratik tav\u0131r ya da sab\u0131r beklemeye hakk\u0131 yoktur.&#8221;<\/p>\n<p style=\"text-align: justify;\"><strong>PARLAMENTO DI\u015eINDA BULUNAN S\u0130YAS\u0130 PART\u0130LERLE SICAK B\u0130R D\u0130YALOG KURULMALI<\/strong><\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi Ba\u015fkan\u0131 Ha\u015fim K\u0131l\u0131\u00e7, &#8221;Y\u00fczde 10 se\u00e7im baraj\u0131 nedeniyle temsil oran\u0131 sorunlu olan bir Meclis&#8217;in t\u00fcm kesimleri yeni anayasa yap\u0131m s\u00fcrecine dahil edebilmesinin yolu, parlamento d\u0131\u015f\u0131nda bulunan siyasi partilerle s\u0131cak bir diyalo\u011fun kurulmas\u0131na ba\u011fl\u0131&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7, Anayasa Mahkemesinin kurulu\u015funun 49. y\u0131l d\u00f6n\u00fcm\u00fc dolay\u0131s\u0131yla d\u00fczenlenen t\u00f6rende yapt\u0131\u011f\u0131 konu\u015fmada, mahkemenin yeni kurulu\u015f yasas\u0131nda, anayasa de\u011fi\u015fikli\u011fi nedeniyle yap\u0131lmas\u0131 gereken zorunlu d\u00fczenlemeler d\u0131\u015f\u0131nda idari ve teknik konularda da baz\u0131 yeniliklerin getirildi\u011fini an\u0131msatt\u0131.<\/p>\n<p style=\"text-align: justify;\">Yasan\u0131n en \u00f6nemli b\u00f6l\u00fcm\u00fcn\u00fcn anayasada \u00f6ng\u00f6r\u00fclen bireysel ba\u015fvuruya ili\u015fkin d\u00fczenlemeler oldu\u011funu dile getiren K\u0131l\u0131\u00e7, Anayasa Mahkemesinin bu tarihi s\u00fcre\u00e7te kendisinden beklenen &#8221;\u00f6zg\u00fcrl\u00fcklerin mahkemesi&#8221; i\u015flevini yerine getirebilmesi ve Avrupa \u0130nsan Haklar\u0131 mahkemesine yap\u0131lan \u00e7ok say\u0131da ba\u015fvuru ve bunun sonunda verilen ihlal kararlar\u0131n\u0131n azalt\u0131labilmesi i\u00e7in bireysel ba\u015fvuru hakk\u0131n\u0131n tan\u0131nmas\u0131n\u0131n ka\u00e7\u0131n\u0131lmaz hale geldi\u011fini s\u00f6yledi.<\/p>\n<p style=\"text-align: justify;\">&#8221;Yarg\u0131 sistemimizde birikmi\u015f sorunlar\u0131 \u00e7\u00f6zecek yasal d\u00fczenlemeler yap\u0131lmad\u0131\u011f\u0131 takdirde bireysel ba\u015fvurunun ba\u015far\u0131 \u015fans\u0131n\u0131n \u00e7ok d\u00fc\u015f\u00fck oldu\u011funu bir kez daha yineliyorum&#8221; diyen K\u0131l\u0131\u00e7, bunun yap\u0131lmamas\u0131 halinde bireysel ba\u015fvuru yolunun adil yarg\u0131lanma konusundaki sorunlar\u0131 daha da b\u00fcy\u00fctece\u011fini ifade etti. K\u0131l\u0131\u00e7, &#8221;Anayasa Mahkemesi bireysel ba\u015fvuruyu etkin bir denetim yolu olarak uygulayamad\u0131\u011f\u0131 s\u00fcrece Avrupa \u0130nsan Haklar\u0131 Mahkemesine yap\u0131lan ba\u015fvurular azalmayacakt\u0131r. Kurulu\u015f yasas\u0131yla d\u00fczenlenen bireysel ba\u015fvuruya ili\u015fkin sistemin etkin bir denetim sa\u011flay\u0131p sa\u011flayamayaca\u011f\u0131 2012 y\u0131l\u0131n\u0131n Eyl\u00fcl ay\u0131nda ba\u015flayacak \u00e7al\u0131\u015fma s\u00fcreci i\u00e7erisinde g\u00f6r\u00fclecektir. Temennimiz etkin bir denetimin ger\u00e7ekle\u015ftirilmesidir&#8221; diye konu\u015ftu.<\/p>\n<p style=\"text-align: justify;\">12 Haziran&#8217;da yap\u0131lacak genel se\u00e7imlerin haz\u0131rl\u0131k a\u015famas\u0131nda siyasi partilerin projeleri hakk\u0131nda yapt\u0131klar\u0131 a\u00e7\u0131klamalardan, sivil toplum \u00f6rg\u00fctlerinin \u00e7al\u0131\u015fmalar\u0131ndan se\u00e7im sonras\u0131nda Anayasa&#8217;da yap\u0131lacak de\u011fi\u015fikliklerin siyasi hayatta \u00f6nemli bir g\u00fcndem olu\u015fturaca\u011f\u0131n\u0131 dile getiren K\u0131l\u0131\u00e7, &#8221;Toplumun ortak sorunlar\u0131n\u0131 dile getiren siyasi partilerimizin \u00f6zg\u00fcrle\u015fme, siville\u015fme ve demokratikle\u015fme konular\u0131nda ortaya \u00e7\u0131kan iradeyi g\u00f6rmezlikten gelmesi d\u00fc\u015f\u00fcn\u00fclemez. Halk\u0131n iradesine emanet etmedi\u011fi odaklar\u0131n haz\u0131rlad\u0131\u011f\u0131, bu nedenle de evrensel de\u011ferlerin, ilkelerin, \u00f6l\u00e7\u00fclerin esas al\u0131nmas\u0131 sonucunda ortaya \u00e7\u0131kan sorunlar\u0131 \u00e7\u00f6zebilmek i\u00e7in Anayasam\u0131z\u0131 s\u0131k\u00e7a de\u011fi\u015ftirme ihtiyac\u0131 ile kar\u015f\u0131 kar\u015f\u0131ya oldu\u011fumuz bir ger\u00e7ektir&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7, bu nedenle yo\u011fun bir \u015fekilde dillendirilen, toplumsal sorunlara kay\u0131ts\u0131z kalamayan siyasi partiler ve sivil toplum \u00f6rg\u00fctlerinin yeni bir Anayasa yap\u0131m\u0131na ili\u015fkin projelerini a\u00e7\u0131klad\u0131klar\u0131n\u0131 hat\u0131rlatt\u0131.<\/p>\n<p style=\"text-align: justify;\"><strong>&#8221;YAPILAN DO\u011eRU DA OLSA KAYNAK SORUNLUDUR&#8221;<\/strong><\/p>\n<p style=\"text-align: justify;\">T\u00fcrkiye&#8217;nin anayasac\u0131l\u0131k tarihinin 1876 tarihli Kanuni Esasi&#8217;den ba\u015flayarak bug\u00fcne kadar 1924, 1961 ve 1982 anayasalar\u0131 ile olu\u015fturuldu\u011funu an\u0131msatan K\u0131l\u0131\u00e7, &#8221;Bu tarihi geli\u015fimde de g\u00f6r\u00fcld\u00fc\u011f\u00fc gibi milletin iradesinin egemen oldu\u011fu bir anlay\u0131\u015fa dayal\u0131 anayasal s\u00fcre\u00e7lerini devlet kurumlar\u0131nca haz\u0131rlanan ve bu kurumlar\u0131n vesayetini tahkim eden bir anlay\u0131\u015f\u0131n uyguland\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r. Yap\u0131lan do\u011fru da olsa kaynak sorunludur. Bu sorun ancak bireyin onurunu, temel hak ve \u00f6zg\u00fcrl\u00fcklerini etkin bi\u00e7imde koruyan, daha demokratik, kat\u0131l\u0131mc\u0131, \u00e7o\u011fulcu yeni bir anayasa d\u00fczeninin olu\u015fturulmas\u0131 ve devlet-birey ili\u015fkisini daha g\u00fcvenceli bir yap\u0131ya kavu\u015fturulmas\u0131 ile \u00e7\u00f6z\u00fclebilir&#8221; diye konu\u015ftu.<\/p>\n<p style=\"text-align: justify;\">Gerek ekonomik geli\u015fme gerekse bu geli\u015fmelerin tetikledi\u011fi k\u00fclt\u00fcrel ve bireysel \u00f6zg\u00fcrl\u00fck taleplerinin ka\u00e7\u0131n\u0131lmaz olarak bast\u0131r\u0131lan farkl\u0131l\u0131klar\u0131n, k\u00fclt\u00fcrel, etnik ve inan\u00e7 kimliklerinin g\u00fcn y\u00fcz\u00fcne \u00e7\u0131kmas\u0131na neden oldu\u011funu belirten K\u0131l\u0131\u00e7, \u015funlar\u0131 kaydetti:<\/p>\n<p style=\"text-align: justify;\">&#8221;Bilgi \u00e7a\u011f\u0131n\u0131n imkanlar\u0131yla bu ger\u00e7ekler daha da netle\u015fti. Geleneksel tarihle siyasal kabuller sorgulanmaya ba\u015fland\u0131. Art\u0131k T\u00fcrkiye farkl\u0131l\u0131klar\u0131n\u0131n bilincinde olarak gelece\u011fi \u00f6z g\u00fcvenle kucaklayacak bir anlay\u0131\u015fla kendini yeniden tan\u0131mlama a\u015famas\u0131na geldi. Toplum, ula\u015ft\u0131\u011f\u0131 seviyede insan\u0131 merkeze alan bir anlay\u0131\u015fla k\u00fclt\u00fcrlere, inan\u00e7lara, dillere ve d\u00fcnya g\u00f6r\u00fc\u015flerine sayg\u0131 ekseninde kendi ortak paydas\u0131n\u0131 \u00fcretmeye ba\u015flad\u0131. Bu geli\u015fim de her \u015feyden \u00f6nce toplumun ve bireyin ergin olmay\u0131\u015f\u0131 ve g\u00fcvensizlik \u00fczerine kurulu bir Anayasal d\u00fczenin ayakta kalmas\u0131n\u0131 imkans\u0131z k\u0131l\u0131yor.&#8221;<\/p>\n<p style=\"text-align: justify;\">T\u00fcm toplumsal farkl\u0131l\u0131klar\u0131n siyasal etkinlikleri ve g\u00fc\u00e7leri ne olursa olsun anayasa yap\u0131m s\u00fcrecinde kurucu ve de\u011ferli olarak g\u00f6r\u00fclmesi onlar\u0131n talep ve beklentilerinin anayasa yap\u0131m\u0131nda temel me\u015fruiyet olarak kabul edilmesinin \u015fart oldu\u011funu ifade eden K\u0131l\u0131\u00e7, \u015f\u00f6yle devam etti:<\/p>\n<p style=\"text-align: justify;\">&#8221;Toplumun merkeze al\u0131nd\u0131\u011f\u0131 Meclis&#8217;in toplumsal talep ve beklentiler ekseninde, anayasa metninin kaleme ald\u0131\u011f\u0131 ve nihai karar\u0131n yine toplum taraf\u0131ndan verildi\u011fi bir anayasa yap\u0131m s\u00fcreci bar\u0131\u015f\u0131m\u0131z\u0131 sa\u011flaman\u0131n yolu olarak g\u00f6r\u00fclmektedir. Yeni anayasan\u0131n bar\u0131\u015f ve dinamiklerin \u00f6n\u00fcn\u00fc a\u00e7mas\u0131, etkin ve h\u0131zl\u0131 bir siyasal yap\u0131lanmay\u0131 esas almas\u0131, siyasal yap\u0131n\u0131n karar s\u00fcre\u00e7lerinin yabanc\u0131la\u015fmay\u0131 ortadan kald\u0131racak \u015fekilde topluma ve bireylere yak\u0131nla\u015ft\u0131rmas\u0131 ve T\u00fcrkiye&#8217;yi uluslararas\u0131 hukukun sayg\u0131n ve etkin bir \u00fcyesi haline getirecek \u015fekilde yap\u0131land\u0131rmas\u0131 gerekir. D\u0131\u015flay\u0131c\u0131 hi\u00e7bir referans anayasal d\u00fczen ilkelerine d\u00f6n\u00fc\u015fmemelidir. Y\u00fczde 10 se\u00e7im baraj\u0131 nedeniyle temsil oran\u0131 sorunlu olan bir Meclis&#8217;in t\u00fcm kesimleri yeni Anayasa yap\u0131m s\u00fcrecine dahil edebilmesinin yolunun, parlamento d\u0131\u015f\u0131nda bulunan siyasi partilerle s\u0131cak bir diyalo\u011fun kurulmas\u0131na ba\u011fl\u0131 oldu\u011funu belirtmeden ge\u00e7emeyece\u011fim. Anayasa&#8217;n\u0131n 175. maddesinde Anayasa de\u011fi\u015fikli\u011fi i\u00e7in \u00f6ng\u00f6r\u00fclen nitelikli \u00e7o\u011funluk anlay\u0131\u015f\u0131n\u0131n i\u00e7inde, uzla\u015fmaya d\u00f6n\u00fck \u00f6rt\u00fcl\u00fc bir yakla\u015f\u0131m oldu\u011fu d\u00fc\u015f\u00fcn\u00fclebilirse de bu \u00e7o\u011funlu\u011fu elde edenlerin az\u0131nl\u0131kta kalan di\u011fer g\u00f6r\u00fc\u015fleri ve farkl\u0131l\u0131klar\u0131 yok sayma, d\u0131\u015flama ya da dayatma yolunu hakl\u0131 k\u0131lamaz. Ancak, nitelikli \u00e7o\u011funluk d\u0131\u015f\u0131ndaki g\u00f6r\u00fc\u015f sahiplerinin de bu g\u00fcc\u00fc bloke etme etkisizle\u015ftirme gibi davran\u0131\u015f sergilemelerine de asla izin verilemez. Siyaset kurumlar\u0131 ge\u00e7mi\u015fte ya\u015fanan fahi\u015f hatalarla hesapla\u015farak sorunlara \u00e7\u00f6z\u00fcm \u00f6nerilerini samimiyetle sunabilmelidirler. \u00dcmit ediyorum ki bu gayret Anayasa Mahkemesine dava a\u00e7mak suretiyle sorun \u00e7\u00f6zme kolayc\u0131l\u0131\u011f\u0131n\u0131 da ortadan kald\u0131racakt\u0131r.&#8221;<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi Ba\u015fkan\u0131 K\u0131l\u0131\u00e7, T\u00fcrkiye&#8217;de demokratikle\u015fmeyi engelleyen en \u00f6nemli sebeplerden birisinin de Siyasi Partiler Kanunu&#8217;nun \u00e7a\u011f\u0131 yakalayan, \u00e7o\u011fulculuk ve temsil esas\u0131na uygun bir yap\u0131ya kavu\u015fturulamamas\u0131 oldu\u011funu vurgulad\u0131. K\u0131l\u0131\u00e7, &#8221;Anayasa&#8217;da yap\u0131lan de\u011fi\u015fikliklere paralel olarak Siyasi Partiler Kanunu&#8217;nda gerekli de\u011fi\u015fiklikler yap\u0131lmad\u0131\u011f\u0131ndan dolay\u0131 Anayasa Mahkemesinin siyasi ve mali denetim g\u00f6revi g\u00fc\u00e7l\u00fckte y\u00fcr\u00fct\u00fclmektedir. Anayasa&#8217;da belirtilen siyasi partilerin kapat\u0131lmas\u0131na ili\u015fkin sebeplerin, Siyasi Partiler Kanunu&#8217;nda yeterli ve anla\u015f\u0131labilir \u015fekilde a\u00e7\u0131l\u0131mlar\u0131n\u0131n yap\u0131lmam\u0131\u015f olmas\u0131 su\u00e7lar\u0131n yasall\u0131\u011f\u0131 ilkesiyle de \u00e7eli\u015fmektedir&#8221; diye konu\u015ftu.<\/p>\n<p style=\"text-align: justify;\">2820 say\u0131l\u0131 Siyasi Partiler Kanunu&#8217;na g\u00f6re partilere b\u00fct\u00e7eden \u00f6denen devlet yard\u0131m\u0131n\u0131n genel se\u00e7im baraj\u0131n\u0131 a\u015fm\u0131\u015f olan partilerle milletvekili se\u00e7imlerinde en az y\u00fczde 7 ve yukar\u0131 oy alm\u0131\u015f olan partilere yap\u0131ld\u0131\u011f\u0131n\u0131 an\u0131msatan K\u0131l\u0131\u00e7, &#8221;Adil olmayan bu da\u011f\u0131l\u0131m Anayasa&#8217;n\u0131n 69. maddesinde \u00f6ng\u00f6r\u00fclen &#8216;devlet yard\u0131m\u0131ndan k\u0131smen ya da tamamen yoksun b\u0131rakma&#8217; yapt\u0131r\u0131m\u0131n\u0131 devlet yard\u0131m\u0131 almayan partiler y\u00f6n\u00fcnden uygulanamaz hale getirmi\u015ftir&#8221; dedi. Anayasa Mahkemesinin son y\u0131llardaki parti kapatma davalar\u0131nda siyasi \u00f6zg\u00fcrl\u00fckler lehine uygulamalar ortaya koydu\u011funu ifade eden K\u0131l\u0131\u00e7, 1990-2000 y\u0131llar\u0131 aras\u0131nda 19 siyasi parti hakk\u0131nda kapatma davas\u0131 a\u00e7\u0131ld\u0131\u011f\u0131n\u0131, 17 partinin kapat\u0131lmas\u0131na 2&#8217;si hakk\u0131nda da kapatma isteminin reddine karar verildi\u011fini anlatt\u0131. K\u0131l\u0131\u00e7, 2001-2010 y\u0131llar\u0131 aras\u0131nda ise 15 siyasal parti hakk\u0131nda kapatma davas\u0131 a\u00e7\u0131ld\u0131\u011f\u0131n\u0131 bunlardan biri hakk\u0131nda kapatma karar\u0131, 10&#8217;\u00fc hakk\u0131nda ret karar\u0131, 4&#8217;\u00fc hakk\u0131nda ise davan\u0131n d\u00fc\u015f\u00fcr\u00fclmesine karar verildi\u011fini ifade etti.<\/p>\n<p style=\"text-align: justify;\">Bu say\u0131lardan da g\u00f6r\u00fclece\u011fi gibi 2001 y\u0131l\u0131ndan sonra Anayasa Mahkemesinin parti kapatma davalar\u0131nda \u00f6nemli bir tav\u0131r de\u011fi\u015fikli\u011fi sergiledi\u011finin s\u00f6ylenebilece\u011fini kaydeden K\u0131l\u0131\u00e7, Anayasa Mahkemesinin ba\u015flatt\u0131\u011f\u0131 bu \u00f6nemli de\u011fi\u015fikli\u011fin sebebinin Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi ile Anayasa Mahkemesinin kararlar\u0131nda belirtilen kriterleri esas alan bir yakla\u015f\u0131m g\u00f6stermeye ba\u015flamas\u0131 oldu\u011funu s\u00f6yledi. K\u0131l\u0131\u00e7, &#8221;Ba\u015fka bir anlat\u0131mla ter\u00f6r, \u015fiddet ve bask\u0131 ba\u011flant\u0131l\u0131 parti \u00e7al\u0131\u015fmalar\u0131 d\u0131\u015f\u0131nda kalan faaliyetler ifade ve \u00f6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131nda de\u011ferlendirilerek kapatma karar\u0131na dayanak te\u015fkil eden delil olarak kabul edilmemektedir&#8221; diye konu\u015ftu.
