Bu s\u00f6z acaba ne kadar ger\u00e7e\u011fi yans\u0131t\u0131yor? Bizim sav\u0131m\u0131z da bu Anayasa de\u011fi\u015fikli\u011fi, tam tersine, \u201chukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fc yok edip, \u00fcst\u00fcnlerin hukukunu egemen k\u0131lmak i\u00e7in\u201d yap\u0131l\u0131yor. <!--more--><\/p>\n<p style=\"text-align: justify;\">Bu sav\u0131m\u0131z\u0131 kan\u0131tlamak i\u00e7in Anayasa Mahkemesi ve HSYK\u2019n\u0131n yap\u0131lar\u0131n\u0131n de\u011fi\u015ftirilip, bu y\u00fcksek yarg\u0131 yerlerinin \u201cAKP\u2019nin, dolay\u0131s\u0131yla bu siyasal partinin Genel Ba\u015fkan\u0131\u201dn\u0131n, yani \u201c\u00fcst\u00fcnlerin\u201d egemenli\u011fine nas\u0131l verildi\u011fini ge\u00e7en iki yaz\u0131m\u0131zda a\u00e7\u0131klam\u0131\u015ft\u0131k.<\/p>\n<p style=\"text-align: justify;\">Bu yaz\u0131m\u0131zda da, k\u00fcresel g\u00fc\u00e7lerle birlikte, kamu varl\u0131klar\u0131na, denetimsiz ve sorgusuz el konulabilmesi i\u00e7in idari yarg\u0131n\u0131n yetkisini nas\u0131l t\u0131rpanlanmaya \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131n\u0131 g\u00f6zler \u00f6n\u00fcne sermek istiyoruz. Bundan ama\u00e7, halk\u0131n katk\u0131lar\u0131yla \u00fclke ekonomisine \u00f6nc\u00fcl\u00fck etmek \u00fczere kurulan, arsalar\u0131, binalar\u0131 de\u011fer bi\u00e7ilemez durumda olan kamu i\u015fletmelerinin, yarg\u0131sal denetimden uzak, \u201ckime ve ka\u00e7a\u201d sat\u0131laca\u011f\u0131n\u0131 t\u00fcm\u00fcyle siyasal iktidar\u0131n keyfine b\u0131rakmakt\u0131r. Bir ba\u015fka \u00f6nemli ama\u00e7 da, kadrola\u015fma \u00e7al\u0131\u015fmalar\u0131n\u0131 sona ula\u015ft\u0131rmak i\u00e7in t\u00fcm kamu kurum ve kurulu\u015flar\u0131n\u0131, cemaat ya da AKP yanda\u015flar\u0131yla doldurarak ele ge\u00e7irirken yarg\u0131 denetiminden kurtulmakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">R\u0131za T\u00fcrmen, 03 Eyl\u00fcl 2010 g\u00fcnl\u00fc Milliyet Gazetesindeki k\u00f6\u015fesinde, \u201cG\u00fcn\u00fcm\u00fczde ge\u00e7erli olan hukuk devleti anlay\u0131\u015f\u0131n\u0131n temel \u00f6zelli\u011fi \u015fu: Yasama, y\u00fcr\u00fctme ve yarg\u0131 yetkilerini anayasadan al\u0131yorlar. \u0130ktidar\u0131 kullanma yetkisi ancak anayasaya ve hukuka uygun oldu\u011fu \u00f6l\u00e7\u00fcde me\u015fru say\u0131l\u0131yor. \u0130ktidar\u0131n, hukukun s\u0131n\u0131rlar\u0131 i\u00e7inde kal\u0131p kalmad\u0131\u011f\u0131na karar verecek olan ise yarg\u0131. Yarg\u0131n\u0131n yasama ve y\u00fcr\u00fctme \u00fczerindeki hukuksal denetimini \u2018vesayet\u2019 olarak nitelemek ve kurtulmaya \u00e7al\u0131\u015fmak hukuk devletinin reddi anlam\u0131na geliyor\u201d diyerek, durumu \u00f6zetlemi\u015f g\u00f6r\u00fcn\u00fcyor.<\/p>\n<p style=\"text-align: justify;\">Biz de de\u011fi\u015fiklikteki \u00fc\u00e7 d\u00fczenleme \u00fczerinde durmak ve yarg\u0131ya vurulan darbenin son noktas\u0131n\u0131 g\u00f6zler \u00f6n\u00fcne sermek istiyoruz.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130DAR\u0130 YARGININ YETK\u0130S\u0130 NEDEN SINIRLANDIRILIYOR <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>1)<\/strong> Anayasa\u2019n\u0131n 125. maddesinde yap\u0131lan de\u011fi\u015fiklikle, idari yarg\u0131n\u0131n yetkisi s\u0131n\u0131rland\u0131r\u0131lmakta, bu yetkinin, \u201chi\u00e7bir surette yerindelik denetimi bi\u00e7iminde kullan\u0131lamayaca\u011f\u0131\u201d kurala ba\u011flanmaktad\u0131r. B\u00f6ylece, \u0130dari Yarg\u0131lama Usul\u00fc Yasas\u0131\u2019nda da bulunan bir kural, a\u015fa\u011f\u0131da a\u00e7\u0131klanacak ama\u00e7la, anayasal d\u00fczleme \u00e7ekilmekte ve bir anlamda \u201chak aramaya s\u0131n\u0131rlama\u201d getirilmeye \u00e7al\u0131\u015f\u0131lmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130dari yarg\u0131 bug\u00fcne kadar, ba\u015fta \u00f6zelle\u015ftirmeler, hidro elektrik santraller (HES), kentsel d\u00f6n\u00fc\u015f\u00fcm tasar\u0131mlar\u0131, \u00e7evre koruma konular\u0131 ve atamalar olmak \u00fczere bir\u00e7ok davay\u0131 \u201ckamu yarar\u0131 amac\u0131na\u201d ve \u201chizmetin gereklerine\u201d uygunluk y\u00f6nlerinden incelemi\u015f ve bu y\u00f6nde \u00f6nemli kararlar vermi\u015ftir. De\u011fi\u015fikli\u011fin amac\u0131, idari yarg\u0131n\u0131n yetkisini s\u0131n\u0131rlayarak, kamu g\u00f6revlileri ve \u00f6zelle\u015ftirmeler gibi konularda, bu \u00f6l\u00e7\u00fctlere g\u00f6re karar verilmesini \u00f6nlemektir.<\/p>\n<p style=\"text-align: justify;\">Dan\u0131\u015ftay\u2019\u0131n yukar\u0131da yer verilen konulara ili\u015fkin kararlar\u0131, \u00f6nce Turgut \u00d6zal taraf\u0131ndan, 1990 y\u0131l\u0131nda bir yasayla engellenmeye \u00e7al\u0131\u015f\u0131lm\u0131\u015f; Anayasa Mahkemesi bu yasay\u0131 iptal etmi\u015ftir. \u015eimdi Recep Tayip Erdo\u011fan, ayn\u0131 sonucu Anayasa de\u011fi\u015fikli\u011fi ile almaya \u00e7al\u0131\u015fmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130dari yarg\u0131n\u0131n iptal etti\u011fi ya da y\u00fcr\u00fctmeyi durdurma karar\u0131 verdi\u011fi \u00f6nemli davalar\u0131 an\u0131msamak, getirilen d\u00fczenlemenin neleri engellemek amac\u0131 g\u00fctt\u00fc\u011f\u00fcn\u00fc ortaya koymas\u0131 y\u00f6n\u00fcnden \u00f6nemlidir:<\/p>\n<p style=\"text-align: justify;\">Seka, Tekel, T\u00fcpra\u015f ve Galataport ihalesi, G\u00fcneysu\u2019da yap\u0131m\u0131 d\u00fc\u015f\u00fcn\u00fclen 2 HES projesi, Akkuyu n\u00fckleer santrali, Alia\u011fa termik santrali, 9 otoyol ve 2 bo\u011faz k\u00f6pr\u00fcs\u00fcn\u00fcn i\u015fletme hakk\u0131n\u0131n \u00f6zelle\u015ftirilmesi, \u0130zmir liman\u0131n\u0131n \u00f6zelle\u015ftirilmesi, T\u00fcrkiye \u015eeker Fabrikalar\u0131\u2019na ili\u015fkin 6 fabrikan\u0131n (Kastamonu, K\u0131r\u015fehir, Turhal, Yozgat, \u00c7orum ve \u00c7ar\u015famba) birden \u00f6zelle\u015ftirilmesi, K\u0131\u015flada\u011f\u2019da alt\u0131n arama faaliyeti, Erdemir\u2019in devri, Petkim\u2019in % 51 hissesinin blok sat\u0131\u015f\u0131, \u0130gda\u015f\u2019\u0131n \u00f6zelle\u015ftirilmesi. (Cumhuriyet, 16.07.2010)<\/p>\n<p style=\"text-align: justify;\">Bir T\u00dcPRA\u015e olay\u0131 bile getirilen de\u011fi\u015fikli\u011fin olumsuz etkisini g\u00f6zler \u00f6n\u00fcne sermeye yeterlidir. Bilindi\u011fi gibi, ham petrol rafinaj\u0131 konusunda T\u00fcrkiye\u2019nin tekeli durumunda olan T\u00dcPRA\u015e\u2019\u0131n % 65.8 oran\u0131ndaki hissesi blok sat\u0131\u015f y\u00f6ntemiyle 1.302 milyon dolara sat\u0131lmas\u0131 i\u015flemini Dan\u0131\u015ftay iptal etmi\u015f; daha sonra ayn\u0131 pay toplam olarak 4.594 milyon dolara sat\u0131lm\u0131\u015f; b\u00f6ylece devlet, yarg\u0131 sayesinde yakla\u015f\u0131k 3.300 milyon dolar zarardan kurtar\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fte Anayasa de\u011fi\u015fikli\u011fi ile, idari yarg\u0131n\u0131n \u00f6zelle\u015ftirme kararlar\u0131n\u0131 denetlemesi \u00f6nlenmekte; b\u00f6ylece, siyasal iktidar\u0131n, \u201cistedi\u011fi \u015firketi, istedi\u011fi ki\u015fiye, istedi\u011fi fiyattan\u201d verebilmesinin yolu a\u00e7\u0131lmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130dari yarg\u0131n\u0131n \u00f6zelle\u015ftirmeler konusunda devreden \u00e7\u0131kar\u0131lmas\u0131n\u0131n k\u00fcresel sermayenin \u00e7\u0131kar\u0131 i\u00e7in yap\u0131ld\u0131\u011f\u0131, AKP\u2019nin referandumla ilgili olarak haz\u0131rlad\u0131\u011f\u0131 kitap\u00e7\u0131kta a\u00e7\u0131k\u00e7a itiraf edilmektedir. Kitap\u00e7\u0131kta aynen \u015f\u00f6yle denilmektedir: \u201cKamu yarar\u0131 gibi subjektif bir kavramla bir\u00e7ok \u00f6zelle\u015ftirme karar\u0131 iptal edilmi\u015f, b\u00f6ylece k\u00fcresel sermayenin T\u00fcrkiye\u2019de yat\u0131r\u0131m yapmas\u0131 ile ilgili bir\u00e7ok zorluk \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.\u201d A\u00e7\u0131k\u00e7a itiraf edildi\u011fi gibi, yap\u0131lan anayasa de\u011fi\u015fikli\u011fi ile k\u00fcresel sermayenin T\u00fcrkiye\u2019deki yat\u0131r\u0131mlar\u0131n\u0131n \u00f6n\u00fcn\u00fc a\u00e7mak i\u00e7in, yarg\u0131 etkisiz k\u0131l\u0131nmakta, yetkisi t\u0131rpanlanmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">AKP Genel Ba\u015fkan Yard\u0131mc\u0131s\u0131 H\u00fcseyin \u00c7elik, \u201cKamu yarar\u0131na karar vermek yarg\u0131n\u0131n i\u015fi de\u011fildir\u201d diyerek, bu de\u011fi\u015fikli\u011fin amac\u0131n\u0131 a\u00e7\u0131k bi\u00e7imde ortaya koymu\u015ftur.<\/p>\n<p style=\"text-align: justify;\">\u00c7ok \u00e7arp\u0131c\u0131 olmas\u0131 y\u00f6n\u00fcnden verilebilecek bir \u00f6rnek de Erzurum \u0130l Milli E\u011fitim M\u00fcd\u00fcr\u00fc\u2019n\u00fcn durumudur. Ba\u015fbakan Recep Tayip Erdo\u011fan, hukukun ba\u011flay\u0131c\u0131l\u0131\u011f\u0131n\u0131 ve gerek\u00e7esiz i\u015flem yap\u0131lamayaca\u011f\u0131n\u0131 unutarak, \u201cistedi\u011fimiz m\u00fcd\u00fcr\u00fc istedi\u011fimiz yere atayam\u0131yoruz\u201d yak\u0131nmas\u0131nda bulunmaktad\u0131r. Bu yak\u0131nma ancak, \u201cistedi\u011fini asars\u0131n, istedi\u011fi kesersin\u201d fa\u015fist yakla\u015f\u0131m\u0131nda olanakl\u0131d\u0131r. \u0130\u015fte bu yakla\u015f\u0131mla, \u201cka\u015f\u0131 g\u00f6z\u00fc\u201d be\u011fenilmeyen Erzurum \u0130l Milli E\u011fitim M\u00fcd\u00fcr\u00fc 11 kez g\u00f6revden al\u0131nm\u0131\u015f, her kezinde yarg\u0131 karar\u0131yla g\u00f6revine geri d\u00f6nm\u00fc\u015ft\u00fcr. \u0130dari yarg\u0131 ile \u201cba\u015fa \u00e7\u0131k\u0131lamayaca\u011f\u0131n\u0131n\u201d anla\u015f\u0131lmas\u0131 \u00fczerine \u0130l M\u00fcd\u00fcr\u00fc, bir adli su\u00e7 karalamas\u0131 ile tutuklanarak, 12. kez g\u00f6revden al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">De\u011fi\u015fiklikten sonra, siyasal iktidar, istedi\u011fi kamu g\u00f6revlisini istedi\u011fi yere atayabilecek, buna dur diyecek bir idari yarg\u0131 bulunmayacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Ne var ki, bu de\u011fi\u015fiklikle, siyasal iktidar\u0131n istedi\u011fi sonucu elde edebilece\u011fi tart\u0131\u015fmal\u0131d\u0131r. \u00c7\u00fcnk\u00fc, idare hukuku \u00f6\u011fretisine g\u00f6re idari yarg\u0131, bir idari i\u015flemi \u201cyetki, \u015fekil, sebep, konu ve maksat\u201d y\u00f6nlerinden hukuksal denetime ba\u011fl\u0131 tutmaktad\u0131r. Bir idari i\u015flemin, \u201ckamu yarar\u0131 amac\u0131na\u201d uygun olup olmad\u0131\u011f\u0131n\u0131n denetimi \u201cmaksat\/ama\u00e7\u201d \u00f6\u011fesi y\u00f6n\u00fcnden yap\u0131lan bir denetimdir ki, bu yerindelik de\u011fil, hukuksall\u0131k denetimi kapsam\u0131na girmektedir. (Arif Ali Cang\u0131, Cumhuriyet, 30.08.2010) Yap\u0131lan, \u201ckamu yarar\u0131na\u201d uygunlu\u011fun de\u011fil, i\u015flemin, \u201ckamu yarar\u0131 amac\u0131yla\u201d yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131n incelenmesidir. Bir i\u015flem ki\u015fi ya da ki\u015fileri korumak ya da onlara zarar vermek i\u00e7in de\u011fil, toplum genelinin yarar\u0131 i\u00e7in yap\u0131lm\u0131\u015fsa, o i\u015flemin kamu yarar\u0131 amac\u0131yla ger\u00e7ekle\u015ftirildi\u011finden s\u00f6z edilebilir.<\/p>\n<p style=\"text-align: justify;\">Ger\u00e7i, siyasal iktidar, Ba\u015fbakan\u2019\u0131n s\u00f6ylemiyle \u201caya\u011f\u0131nda pranga\u201d olarak g\u00f6rd\u00fc\u011f\u00fc yarg\u0131n\u0131n bir b\u00f6l\u00fcm\u00fcn\u00fc \u201cyerindelik denetimi s\u0131n\u0131rlamas\u0131\u201d ile engellemeye \u00e7al\u0131\u015fmaktad\u0131r; ama, yukar\u0131da belirtilen gerek\u00e7eyle bunda ba\u015far\u0131l\u0131 olamayaca\u011f\u0131 san\u0131lmaktad\u0131r. Ku\u015fkusuz bu yorum, Dan\u0131\u015ftay\u2019\u0131n \u00fcye yap\u0131s\u0131n\u0131n zaman i\u00e7inde de\u011fi\u015fmesine kadar ge\u00e7erlidir.<\/p>\n<p style=\"text-align: justify;\"><strong>DAHA \u0130SLAM\u0130 B\u0130R YAPI <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>2)<\/strong> Anayasa\u2019n\u0131n 74. maddesinde yap\u0131lan de\u011fi\u015fiklikle bir \u201cKamu Denet\u00e7ili\u011fi Kurumu\u201d kurulmaktad\u0131r. Bu kurumun ba\u015f\u0131nda bir ba\u015fdenet\u00e7i bulunacak; ba\u015fdenet\u00e7iyi AKP iktidar\u0131n\u0131n oylar\u0131 se\u00e7ecektir.<\/p>\n<p style=\"text-align: justify;\">Bu kurum, idarenin i\u015fleyi\u015fiyle ilgili \u015fikayetleri inceleyecektir. Kamu Ba\u015fdenet\u00e7isi ve denet\u00e7ilerinin nitelikleri dahil, t\u00fcm d\u00fczenlemeler yasaya b\u0131rak\u0131lmaktad\u0131r. Yani AKP iktidar\u0131 bu kuruma istedi\u011fi \u015fekli verecektir. \u201cYeni Osmanl\u0131\u201d d\u00fczeninde, yeni bir \u201cKad\u0131\u201d kurumu yarat\u0131lmaya \u00e7al\u0131\u015f\u0131lmaktad\u0131r. De\u011filse, idarenin t\u00fcm eylem ve i\u015flemleri idari yarg\u0131 denetimine ba\u011fl\u0131 iken buna neden gerek duyuldu\u011fu tart\u0131\u015fma konusudur.<\/p>\n<p style=\"text-align: justify;\">Washington Instutite for Near East Policy T\u00fcrkiye Ara\u015ft\u0131rmalar\u0131 Program\u0131 Direkt\u00f6r\u00fc Soner \u00c7a\u011faptay, kamu denet\u00e7ili\u011fi kurumunu, devlet ile toplum aras\u0131ndaki hakemlik kurumu olarak nitelemekte, ve bu kurumun, n\u00fcfusunun %99.9\u2019unun M\u00fcsl\u00fcman oldu\u011fu bir \u00fclkede \u0130slami ibadet uygulayan ya da uygulamayanlar\u0131n haklar\u0131n\u0131 koruyaca\u011f\u0131n\u0131 belirtmektedir. (Cumhuriyet, 05.09.2010)<\/p>\n<p style=\"text-align: justify;\">Ba\u015f\u0131ndan beri Kamu Denet\u00e7ili\u011fi Kurumu\u2019na yakla\u015f\u0131m\u0131m\u0131z tam da bu noktada d\u00fc\u011f\u00fcmlenmektedir. Kamu Denet\u00e7ili\u011fi Kurumu Devlet ile toplum aras\u0131nda din konusunda hakemlik rol\u00fc oynayarak, bir t\u00fcr kad\u0131l\u0131k sistemini \u00e7a\u011fr\u0131\u015ft\u0131rmaktad\u0131r. Bu kurum, belirtilen i\u015fleviyle, toplum gibi devleti de, kararlar\u0131yla daha \u0130slami bir yap\u0131ya d\u00f6n\u00fc\u015ft\u00fcrmek \u00fczere tasarlanm\u0131\u015ft\u0131r. \u0130slami ibadet uygulamayanlar\u0131n haklar\u0131n\u0131 korumak bir yana, bu kesimi bask\u0131 alt\u0131na alarak siyasal iktidar\u0131n \u201cdaha \u0130slami bir yap\u0131\u201d amac\u0131n\u0131 ger\u00e7ekle\u015ftirecektir.<\/p>\n<p style=\"text-align: justify;\"><strong>A\u0130HM\u2019E BA\u015eVURUNUN \u00d6NLENMES\u0130 <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>3)<\/strong> Son olarak bu b\u00f6l\u00fcmde dile getirilecek konu, 148. ve 149. maddelerde yap\u0131lan de\u011fi\u015fikliklerle, \u201cbireysel ba\u015fvuru hakk\u0131n\u0131n\u201d getirilmi\u015f olmas\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">1961 Anayasas\u0131\u2019na g\u00f6re, Anayasa Mahkemesi\u2019nde do\u011frudan dava a\u00e7acak kurum ve kurulu\u015flara hala bu hak ve yetkileri yeniden verilmezken, bireysel ba\u015fvuru hakk\u0131n\u0131n getirilmesi; bu hakk\u0131n, \u201cAnayasa\u2019da g\u00fcvenceye al\u0131nm\u0131\u015f temel hak ve \u00f6zg\u00fcrl\u00fcklerden Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi kapsam\u0131ndaki herhangi birinin \u2018kamu g\u00fcc\u00fc\u2019 taraf\u0131ndan \u2018ihlal edilmesi\u2019\u201d durumunda kullan\u0131laca\u011f\u0131n\u0131n belirtilmesi; bir ba\u015fkan ve d\u00f6rt \u00fcyeden olu\u015fan Anayasa Mahkemesi b\u00f6l\u00fcmlerinin son s\u00f6z\u00fc s\u00f6yleyecek olmas\u0131; bu de\u011fi\u015fiklikte bir \u00f6zel ama\u00e7 bulundu\u011fu kayg\u0131s\u0131n\u0131 yaratmaktad\u0131r.
