{"id":21390,"date":"2010-04-12T20:40:53","date_gmt":"2010-04-12T17:40:53","guid":{"rendered":"http:\/\/www.korhanyilmaz.com\/?p=21390"},"modified":"2010-04-12T20:40:53","modified_gmt":"2010-04-12T17:40:53","slug":"yargitay-baskanlar-kurulundan-mesruiyet-uyarisi","status":"publish","type":"post","link":"http:\/\/www.korhanyilmaz.com\/?p=21390","title":{"rendered":"Yarg\u0131tay Ba\u015fkanlar Kurulu&#8217;ndan Me\u015fruiyet Uyar\u0131s\u0131"},"content":{"rendered":"<p style=\"text-align: center;\"><a href=\"http:\/\/www.korhanyilmaz.com\/wp-content\/uploads\/2010\/04\/yarg\u0131tay1.jpg\"  class=\"lightview\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-21391\" src=\"http:\/\/www.korhanyilmaz.com\/wp-content\/uploads\/2010\/04\/yarg\u0131tay1.jpg\" alt=\"\" width=\"266\" height=\"198\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">Yarg\u0131tay Ba\u015fkanlar Kurulu, Anayasa&#8217;da \u00e7ok k\u0131sa s\u00fcre i\u00e7erisinde ger\u00e7ekle\u015ftirilmek istenen temel de\u011fi\u015fikliklerin, hakl\u0131 nedenleri olsa bile genel kabul g\u00f6rebilecek de\u011fi\u015fiklikler bi\u00e7iminde olmamas\u0131n\u0131n, k\u0131sa s\u00fcrede toplum vicdan\u0131nda rahats\u0131zl\u0131k yaratmas\u0131 ve mevcut Anayasa&#8217;da oldu\u011fu gibi, me\u015fruluk tart\u0131\u015fmas\u0131na sebebiyet vermesinin ka\u00e7\u0131n\u0131lmaz oldu\u011funu bildirdi. <!--more--><\/p>\n<p style=\"text-align: justify;\">Yarg\u0131tay Ba\u015fkanlar Kurulu&#8217;ndan yap\u0131lan yaz\u0131l\u0131 a\u00e7\u0131klamada, T\u00fcrkiye Cumhuriyeti Anayasas\u0131&#8217;n\u0131n Baz\u0131 Maddelerinde De\u011fi\u015fiklik Yap\u0131lmas\u0131&#8221; hakk\u0131ndaki teklif edilen metinin, Anayasa&#8217;n\u0131n temel ve de\u011fi\u015ftirilemez ilkelerinden birini olu\u015fturan &#8220;<strong>Hukuk Devleti<\/strong>&#8221; ile ilgili oldu\u011fu kaydedildi.<\/p>\n<p style=\"text-align: justify;\">Hukuk Devletinin temel felsefesinin ise kuvvetler\/erkler ayr\u0131l\u0131\u011f\u0131na dayand\u0131\u011f\u0131 belirtilen a\u00e7\u0131klamada, &#8220;<strong>Erkler ayr\u0131l\u0131\u011f\u0131nda, daha do\u011frusu hukuk devletinde, ba\u011f\u0131ms\u0131z yarg\u0131n\u0131n do\u011fal olarak as\u0131l yetki ve g\u00f6revi yasama ve y\u00fcr\u00fctmenin i\u015flemlerini denetlemektir. Yarg\u0131, yasama organ\u0131nca\/erkince \u00e7\u0131kar\u0131lan yasalar\u0131n yorumunu yapar. Yarg\u0131n\u0131n hukuksal yorumu ba\u011flay\u0131c\u0131d\u0131r. B\u00f6ylece yarg\u0131, y\u00fcr\u00fctme ve yasaman\u0131n i\u015flem ve faaliyetlerinin hukuk \u00e7er\u00e7evesi i\u00e7inde kalmas\u0131n\u0131 sa\u011flar. Demokratik sistemde kuvvetler\/erkler ayr\u0131l\u0131\u011f\u0131n\u0131 korumak, yasalar\u0131 yorumlayarak ya\u015fama ge\u00e7irmek yarg\u0131n\u0131n g\u00f6revidir<\/strong>&#8221; denildi.<\/p>\n<p style=\"text-align: justify;\">Bu ba\u011flamda, &#8220;Yarg\u0131 Ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131&#8221;n\u0131n, demokrasinin, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fcn olmazsa olmaz ko\u015fulu oldu\u011fu kaydedilen a\u00e7\u0131klamada, adalete, yans\u0131zl\u0131\u011fa ancak, ba\u011f\u0131ms\u0131z yarg\u0131yla ula\u015f\u0131labilece\u011fi belirtildi. A\u00e7\u0131klamada, &#8220;<strong>Yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 sa\u011flayamam\u0131\u015f bir toplum, hukuk d\u0131\u015f\u0131 y\u00f6netime boyun e\u011fmek zorundad\u0131r. B\u00f6yle bir y\u00f6netimin ad\u0131 ise demokrasi de\u011fildir<\/strong>&#8221; g\u00f6r\u00fc\u015f\u00fc savunuldu.<\/p>\n<p style=\"text-align: justify;\">Anayasa&#8217;n\u0131n, toplumun temel yasas\u0131 ve bir toplum s\u00f6zle\u015fmesi oldu\u011fu vurgulanan a\u00e7\u0131klamada, dolay\u0131s\u0131yla Anayasa&#8217;da ger\u00e7ekle\u015ftirilecek temel de\u011fi\u015fikliklerin \u00f6ncelikle t\u00fcm toplum kesimlerinin g\u00f6r\u00fc\u015flerinin yans\u0131t\u0131lmas\u0131 suretiyle haz\u0131rlanmas\u0131nda zorunluluk oldu\u011fu ifade edildi.<\/p>\n<p style=\"text-align: justify;\">A\u00e7\u0131klamada, \u015funlar kaydedildi: &#8220;Ayr\u0131ca yarg\u0131\/hukuk devleti\/hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc ve bunlar\u0131n etkinli\u011fini sa\u011flayacak olan yetkili organlar\u0131n g\u00f6r\u00fc\u015flerinin \u00f6ncelikle al\u0131nmas\u0131 gerekir. Yarg\u0131 organlar\u0131n\u0131n temel yap\u0131s\u0131nda de\u011fi\u015fiklik ger\u00e7ekle\u015ftirmeyi de hedefleyen Anayasa teklifinin, hukuk devleti\/hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc ilkeleri bak\u0131m\u0131ndan yetkili yarg\u0131 organlar\u0131n\u0131n g\u00f6r\u00fc\u015f, \u00f6neri ve birikimlerinden yararlan\u0131lmas\u0131 gerekti\u011fi yasal\/anayasal bir zorunluluk de\u011filse de hukuk devleti ve hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc ilkesinin ka\u00e7\u0131n\u0131lmaz gere\u011fidir.<\/p>\n<p style=\"text-align: justify;\">Bu de\u011fi\u015fikliklerin geni\u015f bir de\u011ferlendirme s\u00fcreci i\u00e7erisinde yap\u0131lmas\u0131n\u0131n \u00e7ok daha sa\u011fl\u0131kl\u0131 olaca\u011f\u0131nda ku\u015fku bulunmamaktad\u0131r. Demokrasi, hukuk devleti ve insan haklar\u0131n\u0131n g\u00fcvencesidir. Ayn\u0131 zamanda hukuk devleti ve insan haklar\u0131 da demokratik devleti belirleyen de\u011ferlerdir. Bu nedenle, demokrasi, sadece se\u00e7ime indirgenmeyip, insan haklar\u0131 ve bunlar\u0131n g\u00fcvencesi olan hukuk devleti ilkesi ile birlikte ger\u00e7ekli\u011fe kavu\u015fabilir. \u00c7\u00fcnk\u00fc demokrasi \u00e7o\u011fulculukla birlikte tan\u0131mlan\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u00c7o\u011fulculuk, temel yasa ba\u011flam\u0131nda herkesin g\u00f6r\u00fc\u015f\u00fcn\u00fcn al\u0131nmas\u0131n\u0131 gerektirir. Anayasa&#8217;da \u00e7ok k\u0131sa s\u00fcre i\u00e7erisinde ger\u00e7ekle\u015ftirilmek istenen temel de\u011fi\u015fikliklerin, hakl\u0131 nedenleri olsa bile, genel kabul g\u00f6rebilecek de\u011fi\u015fiklikler bi\u00e7iminde olmamas\u0131n\u0131n, k\u0131sa s\u00fcrede toplum vicdan\u0131nda rahats\u0131zl\u0131k yaratmas\u0131 ve mevcut Anayasa&#8217;da oldu\u011fu gibi, me\u015fruluk tart\u0131\u015fmas\u0131na sebebiyet vermesi ka\u00e7\u0131n\u0131lmazd\u0131r. Bu nedenle Anayasa gibi bir temel yasada yap\u0131lan de\u011fi\u015fikliklerde, en y\u00fcksek d\u00fczeyde uzla\u015fma sa\u011flanmamas\u0131\/sa\u011flanamamas\u0131, ilk ad\u0131m\u0131n tart\u0131\u015fmal\u0131 ba\u015flamas\u0131 demektir.<\/p>\n<p style=\"text-align: justify;\">Yap\u0131lmas\u0131 d\u00fc\u015f\u00fcn\u00fclen de\u011fi\u015fikliklerde toplumsal uzla\u015fmay\u0131 sa\u011flayacak bir y\u00f6ntem tercih edilmedi\u011fi gibi, d\u00fczenlemelerden do\u011frudan etkilenecek Yarg\u0131tay ve Dan\u0131\u015ftay&#8217;\u0131n g\u00f6r\u00fc\u015f\u00fc dahi al\u0131nmam\u0131\u015f, daha \u00f6nce bu konuda kurulumuzca haz\u0131rlanan yarg\u0131 reformu strateji raporu ile ortaya koydu\u011fumuz \u00f6neriler de g\u00f6zetilmemi\u015ftir&#8221;<\/p>\n<p style=\"text-align: justify;\"><strong>Y\u00fcce Divan yarg\u0131lamas\u0131 <\/strong><\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi&#8217;nin yap\u0131s\u0131 ve g\u00f6revleri ile ilgili olarak de\u011fi\u015fiklikler \u00f6nerildi\u011fi belirtilen a\u00e7\u0131klamada, &#8220;Anayasa Mahkemesi&#8217;nde yedek \u00fcyeli\u011fe son verilerek, \u00fcye say\u0131s\u0131n\u0131n art\u0131r\u0131lmas\u0131n\u0131n ilke olarak yerinde oldu\u011fu ifade edildi.<\/p>\n<p style=\"text-align: justify;\">De\u011fi\u015fiklik teklifinde, Anayasa Mahkemesi&#8217;ne \u00fcye se\u00e7iminde aday g\u00f6sterme bak\u0131m\u0131ndan \u00e7e\u015fitlilik ve farkl\u0131l\u0131k yarat\u0131ld\u0131\u011f\u0131, ayr\u0131ca Anayasa Mahkemesi \u00fcye say\u0131s\u0131 art\u0131r\u0131l\u0131p yedek \u00fcyelik sistemi kald\u0131r\u0131l\u0131rken, Yarg\u0131tay ve Dan\u0131\u015ftay&#8217;dan se\u00e7ilen \u00fcye say\u0131s\u0131n\u0131n d\u00fc\u015f\u00fcr\u00fcld\u00fc\u011f\u00fc kaydedilen a\u00e7\u0131klamada, &#8220;<strong>Bir\u00e7ok \u00fcyenin, hukuk dal\u0131nda \u00f6\u011frenim g\u00f6rmemi\u015f ki\u015filer aras\u0131ndan se\u00e7ilmeleri ve buna ra\u011fmen bir ceza yarg\u0131lamas\u0131 olan Y\u00fcce Divan yarg\u0131lamas\u0131nda g\u00f6rev alabilmeleri, di\u011fer yurtta\u015flara oranla Y\u00fcce Divan&#8217;da yarg\u0131lanacak olanlar a\u00e7\u0131s\u0131ndan b\u00fcy\u00fck bir g\u00fcvencesizlik ve e\u015fitsizlik olu\u015fturabilecektir<\/strong>&#8221; denildi.<\/p>\n<p style=\"text-align: justify;\">A\u00e7\u0131klamada \u015fu ifadelere yer verildi: &#8220;Ayr\u0131ca ceza yarg\u0131\u00e7lar\u0131n\u0131n \u00e7o\u011funlukta olmad\u0131klar\u0131 bir yarg\u0131 d\u00fczenindeki yarg\u0131lamalar\u0131n belli d\u00f6nemler bak\u0131m\u0131ndan yarg\u0131lanacak olanlar\u0131n lehlerine olaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclebilir ise de bunun her zaman b\u00f6yle olmayabilece\u011fini de \u00f6ng\u00f6rmek yerinde olur. Ceza Yarg\u0131lama Yasas\u0131&#8217;n\u0131n 23\/3. maddesinin, &#8216;Yarg\u0131laman\u0131n yenilenmesi halinde, \u00f6nceki yarg\u0131lamada g\u00f6rev yapan hakim, ayn\u0131 i\u015fte g\u00f6rev alamaz&#8217; \u015feklindeki h\u00fckm\u00fc uyar\u0131nca yarg\u0131laman\u0131n yenilenmesi s\u00f6z konusu oldu\u011funda, Anayasa Mahkemesi&#8217;nde ilk karar\u0131 vermi\u015f olan heyetteki \u00fcye kadar \u00fcyeyi ayn\u0131 mahkemeden sa\u011flamak m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi&#8217;nin Y\u00fcce Divan s\u0131fat\u0131yla bakt\u0131\u011f\u0131 davalar ceza davas\u0131 oldu\u011fundan, genel ceza yarg\u0131lamas\u0131na ili\u015fkin kurallar burada da ge\u00e7erlidir. \u00d6zellikle Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;nin Y\u00fcce Divan&#8217;da yarg\u0131lanm\u0131\u015f olanlarla ilgili olarak verece\u011fi &#8216;ihlal&#8217; karar\u0131 kar\u015f\u0131s\u0131nda sorunun nas\u0131l \u00e7\u00f6z\u00fclebilece\u011fi \u00e7ok \u00f6nemli bir konudur.<\/p>\n<p style=\"text-align: justify;\">Ayr\u0131ca di\u011fer mahkemelerde yarg\u0131lananlar bak\u0131m\u0131ndan temyiz incelemesi m\u00fcmk\u00fcn oldu\u011fu halde, Y\u00fcce Divan kararlar\u0131na kar\u015f\u0131 b\u00f6yle bir ba\u015fvuru yolunun olmamas\u0131, Anayasa&#8217;n\u0131n 40, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesinin 13, 5271 say\u0131l\u0131 Ceza Yarg\u0131lamas\u0131 Yasas\u0131&#8217;n\u0131n 34\/2. ve 232\/6. maddeleriyle de \u00f6rt\u00fc\u015fmemektedir. Avrupa&#8217;da yarg\u0131 kararlar\u0131na kar\u015f\u0131 ba\u015fvuru yolunun en temel ilkesi kabul edilmesine kar\u015f\u0131n, \u00fclkemizde bu hakk\u0131n Y\u00fcce Divan&#8217;da yarg\u0131lananlardan esirgenmesi gibi bir sonu\u00e7 do\u011furacakt\u0131r.&#8221;<\/p>\n<p style=\"text-align: justify;\"><strong>Anayasa Mahkemesi&#8217;ne bireysel ba\u015fvuru <\/strong><\/p>\n<p style=\"text-align: justify;\">Yarg\u0131tay Ba\u015fkanlar Kurulu&#8217;ndan yap\u0131lan yaz\u0131l\u0131 a\u00e7\u0131klamada, Anayasa Mahkemesi&#8217;ne bireysel ba\u015fvuru yoluna ili\u015fkin d\u00fczenlemenin, hukuk\u00e7u yarg\u0131\u00e7larca verilen ve kesinle\u015fen kararlar\u0131n, bir k\u0131sm\u0131 hukuk\u00e7u olmayan yarg\u0131\u00e7larca denetlenmesini \u00f6ng\u00f6rd\u00fc\u011f\u00fc ifade edilerek, bu d\u00fczenlemenin kesinle\u015fen yarg\u0131 kararlar\u0131n\u0131n otoritesini sars\u0131c\u0131 ve Y\u00fcksek Mahkemeler aras\u0131nda var olan yetki ve g\u00f6rev ayr\u0131m\u0131 ile denkli\u011fi bozucu nitelikte oldu\u011fu kaydedildi.<\/p>\n<p style=\"text-align: justify;\">A\u00e7\u0131klamada, \u015fu g\u00f6r\u00fc\u015fler ifade edildi: &#8220;Kald\u0131 ki bireysel ba\u015fvurunun sadece Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nde yer alan haklarla s\u0131n\u0131rl\u0131 tutuldu\u011fu anla\u015f\u0131lmaktad\u0131r. Yasama i\u015flemleri i\u00e7in do\u011frudan bireysel ba\u015fvuru yolu tan\u0131nmay\u0131p, &#8216;kamu g\u00fcc\u00fc taraf\u0131ndan ihlal edildi\u011fi&#8217; ve devam\u0131nda kamu g\u00fcc\u00fcn\u00fcn ne oldu\u011fu, &#8216;kanun yollar\u0131n\u0131n t\u00fcketilmi\u015f olmas\u0131 \u015fart\u0131yla&#8217; denilmek suretiyle bireysel ba\u015fvurunun sadece yarg\u0131 kararlar\u0131na kar\u015f\u0131 kabul edildi\u011fi \u015feklinde a\u00e7\u0131klanm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">Dolay\u0131s\u0131yla Anayasa Mahkemesi, sadece Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nde yer alan ve mahkemelerce verilip kesinle\u015fen kararlara kar\u015f\u0131 bireysel ba\u015fvurular\u0131 inceleyebilecektir. Hukuk devletinde yasama ve y\u00fcr\u00fctme i\u015flemlerinin yarg\u0131sal denetiminde yarg\u0131\u00e7lar\u0131n \u00f6n plana \u00e7\u0131kar\u0131lmas\u0131 gerekirken, sistem ters y\u00fcz edilerek, \u00f6zellikle bireysel ba\u015fvuru yolunda yarg\u0131\u00e7 s\u0131n\u0131f\u0131ndan olmayanlar\u0131n yarg\u0131\u00e7lar\u0131n kararlar\u0131n\u0131 denetlemeleri sa\u011flanm\u0131\u015f olacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Anayasa Mahkemesi&#8217;ne yap\u0131lacak bireysel ba\u015fvuru, Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;ne yap\u0131lacak ba\u015fvurular\u0131 engellemeyece\u011fi veya azaltmayaca\u011f\u0131 gibi, Anayasa Mahkemesi&#8217;nin mevcut yap\u0131s\u0131yla bu ba\u015fvurular\u0131 ad\u0131l yarg\u0131lama ilkelerine uygun olarak makul s\u00fcrede sonu\u00e7land\u0131rmas\u0131 olana\u011f\u0131 da bulunmamaktad\u0131r. Ayr\u0131ca di\u011fer yarg\u0131 organlar\u0131n\u0131n i\u015f y\u00fcklerinin azalt\u0131lmas\u0131, alt yap\u0131 eksikliklerinin giderilmesi yerine bireysel ba\u015fvurunun g\u00fcvencesiz bi\u00e7imde getirilmesi yerinde de\u011fildir. As\u0131l yap\u0131lmas\u0131 gereken i\u015f, \u00f6ncelikle yarg\u0131n\u0131n sorunlar\u0131 \u00e7\u00f6z\u00fclerek hak aramadaki t\u0131kan\u0131kl\u0131klar\u0131n giderilmesi ve sonra Anayasa Mahkemesi&#8217;ne \u00fcye se\u00e7me y\u00f6ntem ve i\u00e7eri\u011finin istenilen sonucu elde etmeye elveri\u015fli hale getirilmesi daha uygun olurdu.&#8221;<\/p>\n<p style=\"text-align: justify;\"><strong>HSYK&#8217;ya ili\u015fkin d\u00fczenlemeler<\/strong><\/p>\n<p style=\"text-align: justify;\">&#8220;Mahkemelerin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve hakimlik teminat\u0131 esaslar\u0131na g\u00f6re&#8221; kurulan ve g\u00f6rev yapan HSYK&#8217;da Yarg\u0131tay ve Dan\u0131\u015ftay&#8217;dan se\u00e7ilen \u00fcyelerin say\u0131s\u0131n\u0131n azalt\u0131lmakta oldu\u011fu kaydedilen a\u00e7\u0131klamada, &#8220;B\u00f6ylece Yarg\u0131tay ve Dan\u0131\u015ftay&#8217;\u0131n Anayasa Mahkemesi ve HSYK&#8217;daki temsili azalt\u0131l\u0131rken, bu kurumlarda g\u00f6rev alacak olanlar bak\u0131m\u0131ndan gerek Yarg\u0131tay ve Dan\u0131\u015ftay&#8217;la ilgileri, gerekse meslekle ba\u011flant\u0131lar\u0131 olmayan veya az olan kimselere a\u011f\u0131rl\u0131k verilmesi nedeniyle bu Anayasa de\u011fi\u015fikliklerine y\u00f6nelecek ele\u015ftiriler, 1982 Anayasas\u0131&#8217;na y\u00f6neltilenlerden daha az olmayacakt\u0131r&#8221; denildi.<\/p>\n<p style=\"text-align: justify;\">&#8220;<strong>HSYK&#8217;n\u0131n, daha ba\u011f\u0131ms\u0131z, daha g\u00fcvenceli, yasama ve y\u00fcr\u00fctme erklerinin siyasi etkilerinden uzak bir yap\u0131ya kavu\u015fturulmas\u0131 gerekirken, geni\u015f tabanl\u0131 temsil esas\u0131, demokratik me\u015fruiyet gibi kavramlar ad\u0131 alt\u0131nda erkler ayr\u0131l\u0131\u011f\u0131 ilkesini ihlal eder bi\u00e7imde yap\u0131land\u0131r\u0131larak, siyasi etkilere a\u00e7\u0131k ve Adalet Bakanl\u0131\u011f\u0131&#8217;n\u0131n artan kontrol\u00fcnde olu\u015fturulmas\u0131 istendi\u011fi<\/strong>&#8221; ileri s\u00fcr\u00fclen a\u00e7\u0131klamada, &#8220;Avrupa Birli\u011fi ve Avrupa Konseyince haz\u0131rlanan yarg\u0131ya ili\u015fkin rapor ve \u00f6nerilerde de belirtilen ve Kurulda bulunmamalar\u0131 konusunda herkesin \u00fczerinde anla\u015fm\u0131\u015f olmas\u0131na kar\u015f\u0131n, Adalet Bakan\u0131 ve M\u00fcste\u015far\u0131na yer verilerek varl\u0131k ve etkinli\u011fi s\u00fcrd\u00fcr\u00fclmek suretiyle, Y\u00fcksek Yarg\u0131 organlar\u0131n\u0131n Kurulun olu\u015fumundaki etkinlikleri zay\u0131flat\u0131lm\u0131\u015ft\u0131r&#8221; g\u00f6r\u00fc\u015f\u00fc savunuldu.<\/p>\n<p style=\"text-align: justify;\">A\u00e7\u0131klamada, \u015funlar kaydedildi: &#8220;Mukayeseli hukuktan \u00f6rnekler verilmek suretiyle, Kurulun yap\u0131s\u0131n\u0131n olu\u015fturuldu\u011fu ve bu \u015fekilde olu\u015fumun uluslararas\u0131 normlar ve uygulamalara uygun oldu\u011fu belirtilmi\u015f ise de \u00f6rneksenen \u00fclkelerin tarihi ve sosyal ko\u015fullar\u0131 ile yarg\u0131 makamlar\u0131n\u0131n olu\u015fumu ve yap\u0131s\u0131 dikkate al\u0131nmam\u0131\u015ft\u0131r. Yeni d\u00fczenlemeye g\u00f6re, Kurulun y\u00f6netimi ve temsili Ba\u015fkan\u0131 olan Adalet Bakan\u0131&#8217;na aittir. Adalet Bakan\u0131, sahip oldu\u011fu yetkilerden bir k\u0131sm\u0131n\u0131 ba\u015fkanvekiline devredebilmektedir.<\/p>\n<p style=\"text-align: justify;\">B\u00f6ylece, Adalet Bakan\u0131&#8217;n\u0131n kuruldaki yetkisi, erkler ayr\u0131l\u0131\u011f\u0131 ilkesini ortadan kald\u0131racak bi\u00e7imde geni\u015fletilmi\u015ftir. Hakim ve savc\u0131lar hakk\u0131nda Kurulun, ilgili dairesince inceleme ve soru\u015fturma yap\u0131lmas\u0131na karar verilmesi halinde, bu soru\u015fturma ve inceleme i\u015fleminin yapt\u0131r\u0131lmas\u0131n\u0131n Kurul Ba\u015fkan\u0131 olan Adalet Bakan\u0131&#8217;na verilmesi, Kurul m\u00fcfetti\u015flerinin \u015fu andaki d\u00fczenlemedeki gibi, Kurula de\u011fil de Adalet Bakan\u0131&#8217;na ba\u011fl\u0131 olduklar\u0131n\u0131 a\u00e7\u0131k\u00e7a g\u00f6stermektedir.<\/p>\n<p style=\"text-align: justify;\">Teklif metninde Kurul m\u00fcfetti\u015fleri d\u0131\u015f\u0131nda, savc\u0131lar\u0131n y\u00f6netsel i\u015flerini denetleme g\u00f6revi olan Adalet M\u00fcfetti\u015flerinin Kurula de\u011fil de Adalet Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 olmas\u0131 savc\u0131l\u0131k g\u00fcvencesine ayk\u0131r\u0131d\u0131r. Kurula ba\u011fl\u0131 Adalet m\u00fcfetti\u015fleri ile Adalet Bakanl\u0131\u011f\u0131&#8217;na ba\u011fl\u0131 m\u00fcfetti\u015flik ihdas edilirken, bu olu\u015fumun, 1961 Anayasas\u0131&#8217;n\u0131n Y\u00fcksek Hakimler Kurulu ile Y\u00fcksek Savc\u0131lar Kurulu \u015feklindeki yap\u0131lanmadan kaynakland\u0131\u011f\u0131 g\u00f6z ard\u0131 edilmi\u015f, net bir g\u00f6rev tan\u0131m\u0131 yap\u0131lmam\u0131\u015ft\u0131r.&#8221;<\/p>\n<p style=\"text-align: justify;\"><strong>Parti kapatmalar\u0131<\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">Anayasa de\u011fi\u015fiklik teklif metninde, siyasi partilerin kapat\u0131lmalar\u0131 konusunda Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n dava a\u00e7ma yetkisinin, Yasama Organ\u0131 b\u00fcnyesinde olu\u015fturulacak bir komisyonun iznine ba\u011flanmas\u0131n\u0131n, erkler ayr\u0131l\u0131\u011f\u0131 ilkesi ile ba\u011fda\u015fmad\u0131\u011f\u0131 belirtilen a\u00e7\u0131klamada<\/span>, &#8220;<strong>Ayr\u0131ca, bu d\u00fczenleme sonucu bir siyasi parti hakk\u0131nda dava a\u00e7\u0131lmas\u0131 iznini verme yetkisi o partinin de temsil edildi\u011fi bir komisyona verildi\u011fi i\u00e7in partilerin hukuki y\u00f6nden denetimi ortadan kald\u0131r\u0131lmaktad\u0131r.
