Y\u00f6netmeli\u011fe g\u00f6re su\u00e7u ihbar etmeyen memur hapis cezas\u0131 alacak. \u0130hbar eden ise korunacak<\/p>\n<p style=\"text-align: justify;\">Yeni T\u00fcrk Ceza Kanunu ile getirilen d\u00fczenleme do\u011frultusunda Devlet Memurlar\u0131n\u0131n \u015eikayet ve M\u00fcracaatlar\u0131 Hakk\u0131ndaki Y\u00f6netmeli\u011fe memurlar\u0131n \u2018su\u00e7u ihbar y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc\u2019 konusunda d\u00fczenlenme eklendi. Ayr\u0131ca su\u00e7u ihbar eden memurlar\u0131n bu nedenle ceza almalar\u0131 ya da g\u00f6revlerinin a\u011f\u0131rla\u015ft\u0131r\u0131lmas\u0131n\u0131n \u00f6nlenmesi i\u00e7in de d\u00fczenleme yap\u0131ld\u0131. Bakanlar Kurulu taraf\u0131ndan yap\u0131lan y\u00f6netmelik de\u011fi\u015fikli\u011fi Resmi Gazete\u2019de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girdi. Y\u00f6netmeli\u011fin \u201cDevlet Memurlar\u0131 kurumlar\u0131 ile ilgili resmi ve \u015fahsi i\u015flerinden dolay\u0131 m\u00fcracaat hakk\u0131na sahiptirler\u201d maddesine \u201cAyr\u0131ca Devlet memurlar\u0131, g\u00f6revleri s\u0131ras\u0131nda haberdar olduklar\u0131 konusu su\u00e7 te\u015fkil eden durumlar\u0131 yetkili makamlara bildirmekle y\u00fck\u00fcml\u00fcd\u00fcrler\u201d f\u0131kras\u0131 eklendi.<!--more--><\/p>\n<p style=\"text-align: justify;\">Bu d\u00fczenleme 1 Haziran 2005\u2019de y\u00fcr\u00fcrl\u00fc\u011fe giren yeni T\u00fcrk Ceza Kanunu\u2019nun 278. maddesinde getirilen \u201csu\u00e7u ihbar y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc\u201d ne uyum amac\u0131yla yap\u0131ld\u0131. TCK\u2019daki d\u00fczenlemeye g\u00f6re i\u015flenmekte olan bir su\u00e7u yetkili makamlara bildirmeyen ki\u015fi, bir y\u0131la kadar hapis cezas\u0131 ile cezaland\u0131r\u0131l\u0131yor. Kanun, memurlar\u0131n su\u00e7u ihbar etmemesi halinde verilecek cezay\u0131 daha da art\u0131r\u0131yor. Buna g\u00f6re soru\u015fturma ve kovu\u015fturmay\u0131 gerektiren bir su\u00e7un i\u015flendi\u011fini g\u00f6reviyle ba\u011flant\u0131l\u0131 olarak \u00f6\u011frenip de yetkili makamlara bildirimde bulunmay\u0131 ihmal eden veya gecikerek bildiren kamu g\u00f6revlisine 6 aydan 2 y\u0131la kadar hapis veriliyor. Bildirimde bulunmayan adl\u00ee kolluk g\u00f6revini yapan bir kamu g\u00f6revlisi ise ceza 9 aydan 3 y\u0131la kadar \u00e7\u0131k\u0131yor.<\/p>\n<p style=\"text-align: justify;\"><strong><em>\u0130hbarc\u0131ya ceza olmaz <\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Y\u00f6netmeli\u011fe ayr\u0131ca \u201c\u0130hbar y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getiren Devlet memurlar\u0131na ihbarlar\u0131ndan dolay\u0131 bir ceza verilemez, do\u011frudan veya dolayl\u0131 olarak hizmet ko\u015fullar\u0131 k\u0131smen de olsa a\u011f\u0131rla\u015ft\u0131r\u0131lamaz ve de\u011fi\u015ftirilemez\u201d h\u00fckm\u00fc eklendi.
